EXECUTIVE SUMMARY
Recommendation to approve and execute documents necessary for the conveyance of
water utilities, and the conveyance of an easement for telephone and related services
located at Goodland Boat Park, 750 Palm Point Drive, Goodland Florida, at a cost not to
exceed $98; Project 80611.11.
OBJECTIVE: To obtain approval from the Board of County Commissioners (Board) to convey: 1)
water utilities to the Collier County Water-Sewer District (CCWSD); and 2) an easement to
Century Link for the purpose of providing telephone and related services, all in connection with
the construction of the Goodland Boat Park which is located at 750 Palm Point Drive, Goodland,
Florida.
CONSIDERATIONS: On February 10, 2009, the Board of County Commissioners approved the
award of Contract #09-5169 for the construction of the Goodland Boat Park Project #80611.11.
The project is currently near 100% completion and is scheduled to be opened to the public by late
September, 2010.
. In order to close out the construction project of the Goodland Boat Park and obtain all final
inspections, acceptances and a certificate of occupancy, it is necessary to convey: 1) water
utilities to the CCWSD; and 2) an easement to Century Link for the purpose of providing
telephone and related services.
CCWSD is currently providing the water and Marco is currently providing wastewater utility
services in the area and will be providing the additional water and wastewater utility services to
the newly installed facilities at Goodland Boat Park. As a condition to providing these additional
services, the potable water and fire line facilities constructed by the County and running from the
water main within an existing utility easement to the water meter for the park are to be conveyed
to the CCWSD for future services and maintenance of the infrastructure as specified on the
exhibit attached to the Utility Facility Warranty Deed and Bill of Sale to the CCWSD. The
wastewater infrastructure within the park property will be privately maintained by Collier County.
The easement area for the Century Link easement measures a total of 5,706 square feet, more or
less, and is shown and described on Exhibit "A" to the Easement to Century Link. The County
will not be compensated because the easement is a requirement for Century Link to provide the
facilities necessary for telephone and related services from Century Link.
A location map is attached for reference.
FISCAL IMPACT: The costs associated with the infrastructure installed and the related
construction totals $144,375.00 paid from the budget under Project 80611.11. The total costs for
recording the required documents and obtaining necessary certified copies will not exceed $98.
Funds in the amount of $98 are available in the budget under Project 80611.11. The County will
also be responsible for future related utility charges.
GROWTH MANAGEMENT IMPACT: Goodland Boat Park is inventoried in the Collier County
Growth Management Plan. The conveyance of these facilities is consistent with the Growth
Management Plan.
LEGAL CONSIDERATIONS: The Utility Facility Warranty Deed and Bill of Sale, and Grant of
Easement have been reviewed and approved for form and legal sufficiency by the County

Attorney's Office. The easement document used has been conceptually approved by Century
Link. - JBW
RECOMMENDATION: That the Board approves the Utility Facility Warranty Deed and Bill of
Sale (CCWSD) and Grant of Utility Easements (Century Link), and authorizes the Chairman to
execute the aforementioned documents; and also for the Board to direct the County Manager or
his designee to proceed to follow all appropriate closing procedures and to record the
aforementioned documents in the Public Records of Collier County, Florida.

UTILITY FACILITIES WARRANTY DEED AND BILL OF SALE
THIS INDENTURE mode this day of September, 2010, between COLLIER
COUNTY, a polnical subdivision of fhe State of Florida (hereinafter referred to os
"Grantor"), and the BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA,
AS THE GOVERNING BODY OF COLLIER COUNTY AND AS THE EX-OFFICIO GOVERNING
BOARD OF THE COLLIER COUNTY WATER-SEWER DISTRICT, its successors and assigns,
(hereinafter referred to as "Grantee"), whose post office address is 3301 Tamiami Trail
East, Naples, Florida 34112.
WITNESSETH:
That said Grontor, for and in consideration of the sum of Ten Dollors [$10.00) and
other good and valuable consideration to said Grantor in hand paid by said Grantee,

said Grantee, and Grantee's heirs, successors and assigns forever, all potable water
and fire utility facilities and/or system[s} or portion(s) thereof lying in, on, over and under

and said Grantor does hereby fully warrant the title to said utility facilities and lor

defend such title against 011 claims of all persons whomsoever. for the purposes of this
conveyance, the utiiity facilities. systern[s) and/or portion!sl thereof conveyed herein
shall not be deemed to convey any of the lands described in either exhibit. Grantor
and Grantee are used for singular or plural, as context allows. A sketch or other graphic
representation showing the location of the utility facilities, etc., being conveyed is
attached as Exhibit B.
TO HAVE AND TO HOLD the some unto the Grantee and its assigns. together with
the right to enter upon said land, excavate, relocate and/or take or introduce materials
for the purpose of constructing, relocating, operating, repairing and/or otherwise
maintaining utility systems thereon. Grantor and Grantee are used for singular or plural,
as the context requires.

GRANT OF UTILITY EASEMENT
This indenture made and executed this _ day of ,2010. by and between
COLLIER COUNTY. a political subdivision of the State of Florida, whose mailing address is 3301
Tamaimi Trail East Naples, Fl 34112, hereinafter referred to as GRANTOR. and EMBARQ FLORIDA,
INC.. d/b/a CENTURYLlNK a Florida corporation, whose moiling address is 5454 W. 1101h 51.

and agents, hereinafter referred to as GRANTEE.
WITNESSETH
That for and in consideration of the sum of Ten Dollars ($10.00) and other good and
valuable consideration, receipt of which is hereby acknowledged, the GRANTOR hereby grants
10 GRANTEE, its successors or assigns. a non-exclusive easement for the installation of utility
facilities on the property more particularly described on Exhibit "A" attached hereto and made a
part hereof, hereinafter referred to as Easement Property.
TO HAVE AND TO HOLD the easement hereby granted unto said GRANTEE, its successors or
assigns, for the sole purpose to install. construct, operate, maintain, expand, replace and
remove underground cables and related facilities or structures as are reasonably necessary,
GRANTEE, by acceptance at this easement agrees tor itself, its successors, assigns. lessees,
licensees and agents, to maintain said easement and in no way to intertere with or hinder al any
time access 10 the Easement Property or adjacent lands by GRANTOR. the general public, or
any other party requiring access to any 01 the property over which said easement is granted.
GRANTEE further agrees that it will at all times use extreme care to restore all grounds to 05 good
or beffer condition than found prior to any construction. installation, maintenance or repair work
performed by GRANTEE, or its contractors. successors, assigns, lessees. licensees and agents.
In the event GRANTEE, its successors, assigns, lessees, licensees and agents. shall fail to use
this easement for the purpose of providing data transmission service to fhe County, this Grant of
Utility Easement shall automatically terminale and the GRANTEE. its successors, assigns. lessees,
licensees and agents, shall vacate. cancel and annul said easement or relevant part thereof by
recording in the Public Records an instrument evidencing said cancellation.
GRANTOR, its successors or assigns, shall upon said vacation, have 1he righ1 to require
GRANTEE, its successors. assigns, lessees, licensees and agents, to remove any structures. facilities
