EXECUTIVE SUMMARY
Recommendation to approve a Submerged Lands Lease with the Board of
Trustees of the Internal Improvement Trust Fund of the State of Florida at the
Cocohatchee River Park Marina at a first year's annual cost of $6,646.16.
OBJECTIVE: Approve a Submerged Lands Lease with the Board of Trustees of the Internal
Improvement Trust Fund of the State of Florida authorizing the County to construct and operate
a sixteen-slip docking facility with boat ramp and launch area at the Cocohatchee River Park
Marina.
CONSIDERATIONS: Collier County's Parks and Recreation Department has petitioned the
State to secure a Submerged Lands Lease with the State of Florida's Board of Trustees of the
Internal Improvement Trust Fund for use of submerged lands along the County's marina at the
Cocohatchee River Park in North Naples.
The lease, which has an initial term of five years, allows the County to construct and operate
sixteen boat slips, a boat ramp and launch area. The lease provides for a renewal which shall
be at the State's option. If the County wishes to continue its use of these areas at the marina,
the County shall provide a written application to the State no sooner than 120 days, and not
later than 30 days prior to the expiration date of this lease. The improvements have been
completed since 2009, but the State has recently provided the Land Lease to the County.
The annual rent for the initial lease term shall be $4,325.79. The State requires that when six
percent of the gross annual income from the revenue generated by the rental of the slips
exceeds the annual base rent, for any lease year, the State shall invoice the County for the
difference in the amount for that year's additional rent. The State has also submitted an invoice
for the current rent, past rent and the 25% surcharge for a total amount of $6,646.16.
The County will be required to maintain the boat slips, ramp, and launch at its sole cost and
expense, throughout the lease term and any renewals thereto.
The State also requires the County to record the Lease in the Public Records, at the County's
expense, which shall total $170.50.
FISCAL IMPACT: The annual rent, past rent, surcharge fee, and recording costs, as outlined
above, shall be withdrawn from General Fund (001), Marina Operations (156364), Rent Land
(644050).
GROWTH MANAGEMENT IMPACT: There is no impact to the Growth Management Plan.
LEGAL CONSIDERATIONS: The proposed Submerged Lands Lease with the Board of
Trustees of the Internal Improvement Trust Fund of the State of Fiorida is legally sufficient for
Board action. - JBW
RECOMMENDATION: That the Board approves the Submerged Lands Lease with the Board
of Trustees of the Internal Improvement Trust Fund of the State of Florida and authorize its
Chairman to execute same.
