EXECUTIVE SUMMARY
Recommendation to direct the County Manager, or his designee, to add to the 2009-
2010 combined cycles of Growth Management Plan Amendments proposed
amendments affecting the Bayshore/Gateway Triangle Redevelopment Overlay,
Future Land Use Element Policy 5.1, other portions of the Future Land Use
Element, and the Future Land Use Map and Map Series, so as to make both
substantive and "housecleaning" revisions to the Growth Management Plan.
OBJECTIVE: For the Board of County Commissioners (BCC) to consider directing
staff to add certain proposed amendments to the 2009-2010 combined cycles of
amendments to the Collier County Growth Management Plan (GMP).
CONSIDERA TIONS: It has become apparent during the use and application of the
GMP, that there is a need for the County to initiate amendments to the GMP. These
proposed amendments, one or more of which may necessitate a subsequent Land
Development Code amendment, include:
1. Changes to the Bayshore/Gateway Triangle Redevelopment Overlay (B/GTRO)
to delete a development standard, add a use, and add a provision to specifically
provide that Future Land Use Element (FLUE) Policy 5.1 applies to non-
residential uses within the Overlay. In part, these amendments will aid the
Community Redevelopment Agency in their efforts to promote development and
redevelopment within the Bayshore/Gateway Triangle area.
2. Changes to FLUE Policy 5.1 so as to allow, through rezoning, re-distribution of
zoning and uses on sites with multiple "non-conforming" zoning districts so long
as acreages remain the same. These amendments will provide greater
development flexibility but will still allow the County to determine
appropriateness of allowing that flexibility through the rezone review and hearing
processes.
3. Changes to text provisions to address an applicability issue for the Office and
Infill Commercial Subdistrict; clarify applicability of the Rural Fringe Mixed Use
District to underlying zoning districts; and, add clarity, provide a missing
reference, correct numbering and date errors, and other non-substantive text
amendments so as to cause the GMP to be better "harmonized" throughout.
4. Changes to the Future Land Use Map and Map Series to reflect annexations by
the City of Naples; to reflect changes in underlying property zoning, plats, etc.;
make boundary corrections in rural areas, such as when a boundary should follow
a roadway; reflect previous amendment approvals; and, other non-substantive
corrective changes.
5. Changes to the Future Land Use Map Series to reflect the most recent hydrologic
modeling of potable water well fields, as required by Objective 1 and subsequent
policies in the Natural Groundwater Aquifer Recharge Sub-Element and
Objective 3.3 and subsequent policies of the Conservation and Coastal
Management Element.

FISCAL IMPACT: The fiscal impact to Collier County will consist of existing staff
time to prepare the amendments, and staff time and mailing costs to fulfill public notice
requirements.
LEGAL CONSIDERATIONS: This Executive Summary has been reviewed by the
County Attorney's office for legal sufficiency. - HFAC
GROWTH MANAGEMENT IMPACT: If the BCC grants the requested
authorization, the proposed amendments will be drafted by staff and incorporated into the
upcoming 2009-2010 combined GMP amendment cycles during which these
amendments will be vetted through the required advertised public hearings before the
Collier County Planning Commission and BCC, presently scheduled to begin in late
2010.
RECOMMENDATION: That the BCC provide the requested direction to add the
proposed amendments to the 2009-2010 combined cycles ofGMP amendments.
