EXECUTIVE SUMMARY
Recommendation to authorize a budget amendment to transfer funding from the
Transportation Supported Gas Tax Fund (313) in the amount of $78,125,00 to the
Bayshore Beautification Municipal Service Taxing Unit Fund (163),
OBJECTIVE: To obtain approval from the Board of County Commissioners for a budget
amendment to transfer recognized capital from the Countywide Pathways Program within the
Transportation Supported Gas Tax Fund (313) in the amount of $78,125.00 to the Bayshore
Beautification Municipal Service Taxing Unit Fund (163).
CONSIDERATIONS: Funds were collected per Ord. 2009-26 from the Naples Botanical
Gardens PUD located in the impact fee district. The conditions of the Naples Botanical Gardens
PUD section 5.H.2 state, in part:
Pursuant to the provisions of the Land Development Code the developer shall
provide a payment of $78,125 based upon FDOT standards in lieu of constructing a
sidewalk along the east side of Hamilton Avenue and a sidewalk along the west side
of Bayshore Drive from the out parcel opposite Republic Drive to the preserve area.
This payment in lieu will be used for sidewalk improvements along Bayshore Drive
as part of the Bayshore Drive South improvement project.
The payment in lieu collected shall be spent on sidewalk improvements inside the Bayshore
Beautification Municipal Service Taxing Unit area. We wish to transfer these funds to the
appropriate project accounts at the Bayshore Beautification Municipal Service Taxing Unit Fund
(163) as follows:

FISCAL IMPACT: In past fiscal years, money was deposited into the Transportation
Supported Gas Tax Fund. A budget amendment is needed to transfer recognized capital into the
correct fund in the amount of$78,125.00.
LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney's Office
and it does not present a legal issue-SRT.
GROWTH MANAGEMENT IMPACT: Provides for transfer of funds to the CRA that allows
for implementation of projects that are consistent with the Growth Management Plan.
RECOMMENDATION: That the Board of County Commissioners authorize the requested
budget amendment.
