CONSIDERATIONS: Collier County acquired Parcels ](IOFEE and JO]FEE (in fee simple) and ParecIs
](IOSUE and J01SUE (perpetua] non-exclusive slope and utility easements) from Waterways of Naples
Homeowners Association. Inc, for construction of roadway improvements to Oil Well Road by entry of
an Order of Taking and by depositing the sum of $90.S00.00 in the court registry on January] g, 200~.
The County's appraiser and owner's appraiser differed in the valuation of tl1e ]andseaping in the taking
and damages to the remainder development. The Owner's appraisal includes a higher valuation of the
landscaping and the addition of an g- foot concrete wall in this location on the eastern comer of the
\\,' aterways development.
On April 20, 20]0, the pmiics mediated the ease and agreed to a settlement of $J25.000.00 fix Parcels
]OOFEE, 100SUE, ]0]1'1'1' and ]O]SUE. This settlement is conditioned upon the satisfaction of the
terms and conditions in a separate SeUiemc111 Agreement and Relcase, which is a companion item to this
Executive Summary.

MEDIATED SETTLEMENT AGREEMENT
At a Mediation Conference hcld on April 20, 2010, the parties reached the following
Settlement Agreement:
1. Petitioner will pay to Respondent, WATERWAYS OF NAPLES HOMEOWNERS
ASSOC1A TION, INC., the sum of $ I 25,(10(1 in full settlement of all claims by Respondent for
compensatJon from Petitioner whatsoever, including all claims related to the real estate taken by
Petitioner in this casc, including statutory interest, but cxcluding attorney's fees, experts' fees and
costs. Said sum will be subject to claims for apportionment by other parties, if any, with an interest
in the subject property. Petitioner is cntitled to a credit in the amount of $90,800, said amount
haying been previously deposited in the Registry of the Court in this case by Petitioner. l'pon the
satisL1ction of the ternlS and conditions of this Settlement Agreement and the entry of the Stipulated
Final Judgment in this matter, Petitioner will pay to Respondent, WATER WA YS OF NAPLES
HOMEOWNERS ASSOCIATION, ]]\;c., thc sum of $34,200, rcprescnting thc diffcrcnce between
the total settlement sum referenced aboyc and Petitioner's previous deposit referenced above.

Respondent's attorney thc sum of $11,378 in full settlement and satisfaction of all attorney's fees

3. In addition to thc above-refereneed settlement sum and the above-referenced
attorney's fees and attomey's litigation eosts, Petitioner will pay to Respondcnt's expert witnesses
the sum of $20,000 in full satisfaction of all expert witness fees and eosts incurred by Respondent in
this case.
4. This Settlement Agreement is subject to and conditioned upon final approval by the
Board of County Commissioners of Collier Cuunty.

5. This Settlement is subject to and conditioned upon fmal approval of the Board of
Waterways of Naples Homeowners Association, Inc.
6. This Senlement is conditioned upon simultaneous approval of the Settlement
Agreement between Petitioner and Rcspondent, WATERWAYS OF NAPLES HOMEOWNERS
ASSOCIATION. INC., penaining to all claims by Respondent of any nature penaining to those
certain easements conveyed by RespondenllO Petitioner in 2006.
7. Counsel for Petitioner and Respondent will jointly submit to the Court a mutually
approved Stipulated Final Judgment containing the terms and conditions of this Setdement
Agreement within ten days following the final approval of this Senlement Agreemcnt by the Collier
County Board of County Commissioners.
8. Attached hereto is an addendum to this Settlement Agreement.
