Agenda 10/12/2010 Item #16G 1 Item No. ')6G1 Octcber 12, 2010 Pa;j6 1 of 26 EXECUTIVE SUMMARY Recommendation that the Board of County Commissioners, acting as the Airport Authority, approve Disadvantaged Business Enterprise (DBE) goals of 2.8 percent for the Marco Island Executive Airport, and 2.7 percent for Everglades Airpark for Federal Aviation Administration (FAA) funded airport improvement projects (AlP) during fiscal year 2011. OBJECTIVE: To approve Disadvantage Business Enterprise (DBE) goals of 2.8 percent for the Marco Island Executive Airport and 2.7 percent for Everglades Airpark for Federal Aviation Administration (FAA) funded airport improvements during fiscal year 2011. CONSIDERATIONS: The Collier County Airport Authority (Authority) is required to submit DBE goals to the FAA for each fiscal year in which a FAA funded airport improvement project may take place at that airport. in accordance with United States Department of Transportation (DOT) regulations, 49 CFR Part 26 the Authority has established a DBE program for this purpose. In fiscal 2011, construction of a taxiway and south apron at the Marco Island Airport will be funded by the FAA. The Authority anticipates that construction of the south taxiway at Everglades may also be funded by the FAA in fiscal 2011. The DBE goals established for fiscal year 2011 are: . 2.8% for Marco Island Executive Airport . 2.7% for Everglades Airpark As required by 49 CFR, Part 26, the Airport Authority has advertised these DBE goals in the local paper and allowed for public comment for forty-five (45) days. FISCAL IMPACT: There is no fiscal impact associated with this Executive Summary. GROWTH IMPACT: There is no growth impact associated with this Executive Summary. ADVISORY BOARD RECOMMENDATION: At the October 11, 2010 meeting, the Airport Advisory Board voted to recommend that the Airport Authority approve DBE goals of 2.8 percent for the Marco Island Executive Airport, and 2.7 percent for Everglades Airpark for FAA funded airport improvements during fiscal year 2011. 'I 6G 1 October 12. 2010 Page 4 of 26 DEE GOALS PROCESS The Collier County Airport Authority (CCAA or the Authority) submits its Disadvantaged Business Enterprise (DBE) goals to the FAA each year. Before establishing the Fiscal Year (FY) 2011 DBE goals, various minority and women trade organizations were consulted to obtain information concerning the availability of disadvantaged and non-disadvantaged businesses, the effects of discrimination on opportunities for DBEs and the Airport's efforts to establish a level playing field for the participation of DBEs. The overall goal for the CCAA's Disadvantaged Business Enterprise Program, for federally assisted projects is established on an annual basis, beginning on October I, 2010, :md ending on Septembcr 30, 20] 1. The overall goal for fiscal year 2011 has been set utilizing the methodologies described in CFR 49 Part 26 as follows: The Authority's overall DBE Goal for FY 2011 is the following: 5.5% of the federal financial assistance, which the Authority will expend in DOT -assisted contracts. Given the amount of FAA-assisted contracts the Authority expects to let during FY 2011 for Marco Island Executive Airport, and Everglades Airpark which is $6,085,140, the Authority has set an overall goal of $334,683 with DBEs in FY 2011. METHODOLOGY The Methodology described in 49CFR 26.45(c)(1) was used to determine the base figure for the relative availability of DBEs. The Authority started the determination of its FY 20 II goal setting process by identifying a base figure for the relative availability of DBEs based on demonstrable evidence of the availability of ready, willing and able DBEs as compared to the availability of all businesses participating on DOT -assisted contracts. The first step is to create a base figure for the relative availability ofready, willing and able DBEs in the Airport's normal market area. The following counties are considered the normal market area for the Authority which are near in location to Immokalee Reb>ional Airport, Marco Island Executive Airport and Everglades Airpark, and constitute those arcas where it is anticipated that the majority of the Authority's contracting dollars will be spent: Collier County, Lee County, Hcndry County, Charlotte County and Momoe County. The second step is to make adjustment(s) to the base figure, relying on an examination of additional cvidence including experience, local expertise and anticipated changes in FAA-assisted contracting ovcr the upcoming year. The Collier County Airport Authority previously received federal funding for construction and engineering at Immokalee Regional Airport, Marco Island Executive Airport and Everglades Airpark. It is anticipated that Marco Island Executive Airport and Everglades Airpark will receive federal funding in FY20l 1. All factors listed in the above-referenced documents were considered in order to determine whether an adjustment is necessary. Considerations of those factors are detailed as follows: A. There is not sufficient, reliable information about the characteristics of the firms (size, age, past experience, bonding, insurance, etc.) available in its local market area to make unjustifiable adjustments in Step Two. _A.nother factor considered, is the Naples Municipal AirpOli's historical DBE construction goal. Naples Municipal Airport, also located in Collier County, has previously received federal funding for similar type projects and has an on-going DBE program. Historically, the airport has been able to maintain DBE goals of 2% - 5%. In the past, CCAA has maintained higher construction goals. However, demonstrable evidence of the availability of ready, willing and able DBEs has been displayed through the fulfillment of Naples Municipal Airport's DBE construction goals. Due to this factor, an adjustment from the base figure of I. 1% to 2.8%, based on average historical DBE participation seems appropriate based on actual historical DBE participation on airport projects in the Collier County area. 2. Due to this factor, an adjustment from the base figure of .9% to 2.7%, based on average historical DBE participation seems appropriate based on actual historical DBE participation on airport projects in the Collier County area. SUMMARY Due to the aforementioned facts and considerations, an adjustment was made to the Step 1 base figures for each airport. Collier County AirlJOrI Authorify Prepared Oil: 31 Jury 2010 8 A:Jenda Item No. 16G1 ~ October 12. 2010 Page 12 of 26 FY 2011 METHODOLOGY FOR DETERMINING GOALS (49 CFR 26.45) COLLIER COUNTY AIRPORT AUTHORITY PUBLIC PARTICIPATION The Authority published a notice of the proposed construction goal, informing the public that the proposed goal and its rationale were available for inspection during normal business hours at the Airport's DBELO Office for 30 days following the date of the notice, and informing the public that Collier County Airport Authority would accept comments on the goals for 45 days from the date of the notice. The notice was published in The Naples Daily News. The notice included addresses to which comments could be sent and the address where the document could be reviewed. The Airport's public notice (advertisement) required under 26.45 (g) (2) was accomplished on August 5, 2010. (See Appendix 2). BREAKOUT OF RACE-NEUTRAL AND RACE-CONSCIOUS PARTICIPATION Prior construction and engineering projects for the Collier County Airport Authority before the recent FAA-grants of the last two years did not include DBE goals; and to the best of knowledge, no DBE firms participated in airport contracts. Since race-neutral efforts historically have not been successful in the absence of defined DBE goals, we estimate that, in meeting the construction and engineering goals of 2.8% and 2.7% respectively, we will obtain 2.8% and 2.7% from race-conscious measures and 0% through race-neutral measures. The DBELO will carefully monitor the award and actual DBE participation and adjust future DBE goals to consider race-neutral and race-conscious participation accordingly. It is the goal of the CCAA to meet the maximum feasible portion of its DBE goals by using race-neutral means of facilitating DBE participation. The CCAA uses the following race-neutral means to increase DBE participation: Arranging solicitations, times for the presentations of bids, proposals, quantities, specifications, and delivery schedules in ways that facilitate DBE, and other small business, participation (e.g., unbundling large contracts to make them more accessible to small businesses, requiring or encouraging prime contractors to subcontract portions of work that they might otherwise perform with their own forces). In order to ensure that our DBE program will be narrowly tailored to overcome the effects of discrimination, if we use contract goals, we will adjust the estimated breakout of race-neutral and race- conscious participation as needed to reflect actual DBE participation (see 26.51(f)) and we will track and report race-neutral and race conscious participation separately.
