The Honorable Special Magistrate Brenda Garretson called the Hearing to order at 9:00 AM. All those

When he returned a 4:00pm he observed a Citation on his vehicle which alleged two
violations, parking in an unauthorized area and parking in an area reserved for “Trailer
Parking Only.”
When he originally parked is vehicle he observed the sign, however the arrow depicted the
designation for “Trailer Parking Only” to the left of where he parked his vehicle.
He contends he did not park in the space which was restricted for trailer parking.
Evidence Entered: Composite Exhibit A: 3 photos dated 4/29/18 depicting the vehicle parked,
and a sign which designated “Trailer Parking Only.”
Ranger Araquistain represented the County and testified Mr. Suniewick was issued a Citation for
obstructing the area where parking is only permitted for vehicles with trailers, additionally he
parked in a restricted area not designated for parking as it is a grass/gravel area.
County Evidence Entered: Exhibit A: 1 photo dated 4/29/18 depicting the alleged violation.
Mr. Suniewick noted the area appears to be a parking space based on the gravel in the area and it
has clearly been utilized by others for parking in the past.
Special Magistrate Garretson, after reviewing the evidence and hearing the testimony took the
case UNDER ADVISEMENT in order to conduct a site visit.
Discussion occurred noting the one Citation was issued for two violations, parking in an
unauthorized area and parking in an area reserved for vehicles with trailers. Only one violation
may be issued per Citation and clarification was sought on which violation the County was
alleging.

Citation, she visited the Code Enforcement Office to utilize the County’s policy to pay $5.00 if she
produced a valid placard; she was told she was required to request a hearing.
Discussion occurred with Staff noting there must have been a lack of communication and
requested Ms. Pellegrini-Knight to return to the Code Enforcement Office to utilize the $5.00
policy.

They testified:
The violation has been abated by Ms. Silverman but the County is seeking a Finding of
Fact a reoccurring violation occurred through the use of on-site and online advertising
for a home business.
The issue revolves around the prohibition of allowing customers to visit the site for
service.
She may pick up dogs off site and groom them on her premise and return dog offsite but
is not permitted to have customers visit the site.
Ms. Silverman testified:
She obtained permits for a home business for dog grooming and a grooming school and
was under the impression she could advertise the business.
At times customers, such as neighbors do drop a dog off at her residence for service.
Investigator Athey reported the area is not zoned for a business and to conducting an operation
where customers visit the site requires a commercial storefront.

Under questioning by Director Ossorio, Ms. Silverman stated she does not have employees on site,
nor has “drop off” of materials used in the business.
Mr. Ossorio reported under the above circumstances, and customers do not visit the site, she
would not be in violation of the Ordinance moving forward.
Special Magistrate Garretson found the Respondent GUILTY of the alleged violation and
ordered her to pay Operational Costs in the amount of $112.10 incurred in the prosecution of
the case by August 6, 2018.

At one point, a contractor was engaged but the insurance benefits were assigned which
action was rescinded by Mr. Chandok as there was a concern the party was not
reputable.
Another roofer was engaged, however has had health issues but notified Mr. Chandok
he can now initiate the project (which requires permits from the County).

Investigator Athey reported the case is not a Health, Safety and Welfare issue and had no
objection to allotting reasonable time to abate the violation.
