EXECUTIVE SUMMARY
Recommendation to approve a budget amendment in the amount of $59,000 to keep Teen
Court operational for the current fiscal year.
OBJECTIVE: To move available funds from Juvenile Assessment Center (175) to Teen Court, Fund
(171).
CONSIDERATION: Effective July 1, 2004, Section 939.185 allows Counties to adopt a county
ordinance assessing additional court costs not to exceed $65 when a person pleads guilty or nolo
contendere to, or found guilty of any felony, misdemeanor, or criminal traffic offense under the laws of
the state of Florida. Twenty-five percent (25%) of this fee was split between Teen Court and Juvenile
Assessment Center (JAC). The JAC funds are transferred to the Sheriffs Office to administer an
assessment program in conjunction with the JAC.
The revenues from this $65 additional court costs have declined consistently over the past four years.
Both programs are active and viable within the community. The Teen Court program has no additional
resources or funding. The Sheriffs Office has partnered with the Judiciary Department of Juvenile
Justice and other service contributors in the community to develop a new imitative for providing the
needed services to the community, parents and youth at risk. Due to these partnering efforts, the Sheriff
has indicated that he is willing to let Teen Court receive the entire twenty-five percent (25%) of this fee
until the revenue source retums to more traditional levels. A copy of this letter is included as part of this
- agenda item.
FY 2011 Budget for Teen Court includes the continuation of this action and will be presented to the
Board of County Commissioners for their approval at the Budget Workshops on June 24 and 25.
The Board has full authority to designate the use of this revenue stream within the family of altemative
juvenile programs and Teen Court has the greatest need at this time.
FISCAL IMPACT: The current budget in the Juvenile Assessment Center Fund (175) is $59,000. This
budget amendment will be necessary to move all available dollars for the current year into Teen Court,
Fund (171).
LEGAL CONSIDERATIONS: This item has been reviewed by the County Attomey's Office and it
does not present a legal issue-SRT.
GROWTH MANAGEMENT: none
RECOMMENDATION: That the Board of County Commissioners approve the necessary budget
amendments to keep Teen COUl1 operational for the remainder of the current tiscal year.

Re: Funding for Teen Court
Dear Commissioner Coyle:
A request for a budget amendment will soon come before you for the purpose of continued
funding for the Teen Court Program. Historically, the Board adopted Ordinance 04-42 to allow
for funding of Teen Court, Juvenile Assessment Centers and other alternative programs in
Collier County. This funding was to be derived from court costs applied to cases where a
person had pled guilty, nolo contendere or found guilty of a felony, misdemeanor, or criminal
traffic offense.
Continued funding for these programs is severely compromised as collections are down to
levels lower than previously experienced. Current levels of collection are not capable of
sufficiently funding neither Teen Court nor the Juvenile Assessment Center. In anticipation of
this development, the Collier County Sheriff's Office has partnered with the Judiciary,
Department of Juvenile Justice, and service contributors in our community to develop a new
initiative for a comprehensive approach to providing much needed services to the community,
parents and youth currently at risk.
With these measures in place the Collier County Sheriff's Office will be in a position to
adequately provide funding during the FY-11 Budget for services, currently provided by the
Juvenile Assessment Center, and will enable the Board of County Commissioners to direct the
remaining funds available, supported by Ordinance 04-42, to maintain the Teen Court program.
While the current economic conditions make it necessary to pursue this course, I would like to,
once again, enter sharing of this funding source upon the return to more traditional levels.
I believe these measures are critical for the continuation of both programs. Our failure to
address this funding shortfall within the suggested course will result in the closing of one if not
both programs by the end of this fiscal year.
