Agenda 06/22/2010 Item #16A 7 Agenda Item No 16A7 June 22, 2010 Page 1 of 13 EXECUTIVE SUMMARY Recommendation to approve an Easement Agreement and to convey a Construction, Operation, and Maintenance Easement to Florida Power and Light Corporation (FPL) for the purpose of building three phase power delivery facilities to the pump station as part of the Gateway Triangle Storm water Improvements construction / Phase 2, Collier County Capital Project #51803. . OBJECTIVE: To obtain Board of County Commissioners approval of an Easement Agreement and conveyance of a Construction, Operation and Maintenance Easement to Florida Power and Light Corporation to enablc the Gateway Triangle Stormwater Improvements construction phase 2. CONSIDERATIONS: The Gateway Triangle is an area bordered by US 41 to the west and south, Davis Boulevard to the north and Airport Road to the east connecting both to Davis Boulevard and US 41 in a triangular shape. It is a low-lying area that is almost fully developed and includes a mix of residential, commercial and light industrial use properties. The Stormwater Improvement project is intended to correct the serious drainage problems within this portion of East Naples. This project will provide an increased discharge rate (to reduce flooding) by use of a pump station, as well as additional water quality improvements by draining a large portion of the area to a detention pond for treatment. The construction contract award was approved at the BCC meeting of December 15, 2009, to Stevens & Layton Inc. Currently there are no FPL facilities (power poles or underground conduits) to convey necessary three phase power to the proposed pump station. County Stormwater staff and FPL personnel have examined the site, developed a power delivery design, and a!,'Teed upon a location for the facilities. This location is at the west edge of a parcel purchased by the County to place the detention pond for this project. County staff has drawn up a legal description and sketch for this location to establish an easement, and recommends placing the new powcr conduction facilities in the easement described to facilitate the project's construction process. FPL has agreed to provide the materials to the county's contractor, who will install thcm as part of the Gateway Triangle phase 2 construction. Stormwater staff is currently managing construction of this projcct. FISCAL IMPACT: No Fiscal Impact associated with this Executive Summary. GROWTH MANAGEMENT IMPACT: There is no Growth Management Impact associated with this Executive Summary. LEGAL CONSIDERATIONS: This itcm has been reviewed and approved by the County Attorney's Office and is legally sufficient for Board action. RNZ.
