EXECUTIVE SUMMARY
Recommendation to approve a declaration setting aside county-owned lands for
the future expansion of County Barn Road roadway, sidewalk, drainage and utility
facilities. Project #60101 (Fiscal impact: $18.50)
OBJECTIVE: To establish for the public record that certain lands owned by Collier County shall
hereinafter be designated for specific public uses (roadway, sidewalk, drainage and utility facilities.)
CONSIDERATIONS: In support of the future expansion of County Barn Road, right-of-way is
required along the east side of County Barn Road in order to construct the four-laning improvements to
this section of roadway, including roadway, sidewalk, drainage and utility facilities.
Collier County is the owner of certain lands located along the east side of the existing County Barn
Road. This land presently retains water in a borrow pit that was created as part of the expansion of
Davis Blvd. After construction of Davis Blvd., the State of FIOlida DOT then deeded the borrow pit to
the county for future public use. Other than thc borrow pit, the land is vacant. The attached sketch
and description designated as Project Parcel No. I 19C, shows the area needed for these improvements.
This designated use for roadway, sidewalk, drainage and utility facilities will not adversely affect the
future plans for this property.
This Declaration is to be recorded in the public records as constructive notice to all that the subject
property is designated as described.
FISCAL IMPACT: Fiscal Impact associated with this Executive Summary is $18.50 for recording
fees. The funds will be paid from road impact fees.
GROWTH MANAGEMENT IMPACT: This project is consistent with the Long Range
Transportation Plan and the Collier County Growth Management Plan.
LEGAL CONSIDERATIONS: This item is legally sufficient for Board action. RNZ
RECOMMENDATION: Based on thc abovc considerations, Transportation staff is recommending
that the Board of County Commissioners of Collier County:
1. Approve the attached Declaration of Right-of-Way f()r Road, Sidewalk, Drainage and Utility
Facilities and authorize its Chainnan to executc same on behalf ofthc Board;
2. Authorize the County Manager or his designee to record same in the public records of Collier
County, Florida
3. Authorize the payment of recording fees in the amount of $ 18.50 to the Collier County Clerk of
Court;
4. Approve any and all budget amendments which may be required to carry out the collective will of
the Board.

DRAINAGE AND UTILITY FACILITIES
THIS DECLARATION is made this day of ,2010, by
COLLIER COUNTY, a political subdivision of the State of Florida, having a mailing
address of 3301 East Tamiami Trail, Naples, Florida 34112, hereinafter referred to as
"Declarant."
Declarant is the owner of certain real property situated in Collier County, Florida,
more fully described below, hereinafter referred to as the "Property."
See Exhibit "A" which is attached
hereto and made a part of this Declaration.
Declarant hereby declares that the Property is and shall be used and occupied
for the purpose of constructing and maintaining roadway, sidewalk, drainage and utility
facilities as Project Parcel No. 119C, described in Exhibit "A", attached hereto and made
a part hereof.
This Declaration may be amended or terminated by an affirmative vote of the
Board of County Commissioners.
