EXECUTIVE SUMMARY
Recommendation to approve a Second Amendment to Lease Agreement
with Naples Zoo, Inc. to modify the lease boundaries recognizing a land
swap which changes the lease property from 43.52 to 44.1 acres
plus/minus.
OBJECTIVE: Approve a Second Amendment to Lease Agreement with Naples Zoo,
Inc. to revise the boundary of the leased area of the Zoo.
CONSIDERATIONS: Naples Zoo, Inc. has requested to revise the boundary line which
determines the leased area at the County-owned property located on Goodlette Road.
The new leased area for the Zoo will include the 6.40 acre parcel shown on Exhibit A
and less out the 5.80 acre parcel shown on the same Exhibit. The County will now
utilized the 5.80 acre parcel. For reference, the revised leased area for the Zoo is
indicated on Exhibit B.
The Parks and Recreation Department and the Parks and Recreation Advisory Board
are agreeable to the revision.
All other terms and conditions contained in the Lease Agreement shall remain the same.
FISCAL IMPACT: There is no fiscal impact related to this item.
GROWTH MANAGEMENT IMPACT: There is no impact to the Growth Management
Plan.
LEGAL CONSIDERATIONS: The proposed Second Amendment to Lease Agreement
is legally sufficient for Board action. - JBW
RECOMMENDATION: That the Board approves the Second Amendment to Lease
Agreement with Naples Zoo, Inc., and authorize its Chairman to execute same.
