EXECUTIVE SUMMARY
TO DISCUSS REVISED UTILITIES ORDINANCE 2008-32, SECTION 4,
RESOLUTION 2009-224 REGARDING ADDING METERS ON BUILDING
FIRE LINES AND THE AFFECT THIS WILL HAVE ON THE INDUSTRY.
OBJECTIVE: To discuss the revised Utilities Ordinance 2008-32, Section 4, and
Resolution 2009-224 and the atTect the requirements will have on the industry
pertaining to the requirement of adding meters on building fire lanes. Some of the
costs included are the requirement of enlarged sprinkler lines into the buildings, fire
pumps, and maintenance of the associated back-flow assemblies.
CONSIDERA TIONS: To discuss the revised Utilities Ordinance and consider a
full review and discussion of the costs.

On behalf of the Development Services Advisory Committee ("DSAC"), I am writing to request that a
period of time for discussion is reserved for DSAC on the next Board Agenda to present information
relevant to the amended Utilities Ordinance (Section 4, Ordinance 2008-32 and Resolution 2009-224).
A portion of the revised Ordinance requires adding meters on building fire lines. Paul Mattausch,
Director of the Collier County Water Department, gave a presentation at DSAC's March 3,2010 meeting.
A discussion ensued during which a member found the calculations considered were only the cost of the
meter itself and none of the costs that will be incurred by the land owners. These costs included, among
others, enlarged sprinkler lines into the buildings, fire pumps, and maintenance of the associated back-
flow assemblies.
This suggested change will affect the Industry. DSAC is requesting that a full review and discussion of
the costs is vetted through a public meeting. Until the process is completed, DSAC recommends the
Board consider contacting the County Manager to request an administrative stay regarding the
implementation of the provisions of the Utilities Ordinance conceming the metering offrre lines,

Text from Minutes of DSAC Meeting of April 7, 2010:
A. Fire Lines M.eters/revised Utilities Ordinance - Melissa Ahern, Public Speaker,
representing CBIA ("Collier Building Industry Association")
. CBrA requested DSAC send arecommendation to the Board of County
Commissioners to table the section of the revised Utilities Ordinance
referencing Fire Line Meters until the subject has been vetted by DSAC
. The revisions to the Ordinance were submitted to the BCe as a "Consent
Agenda" before it was reviewed by Industry - there was no public forum
o Tbere are costs issues to be clarified - no cost analysis was completed,
the only cost cited was the cost of the meters
o The County Manager could enact an Administrative Stay
o The BCC has the option to reconsider/amend the Ordinance
A Committee memher stated the revised Ordinance, presented at the March meeting
by Paul :Mattausch, Director of the County's Water Department, did not make sense
and the presentation was an after-tile-fact informational review, It was noted the
Committee's questions were not satisfactorily answered.
[From the March meetine:
A question was asked if the operatiolls cost to monitor meters exceeded the
amount of revenue captured.
The Answer was tiNo, but iris cost effective to track unbilled water usage."
It was pointed out Mr. Mattausch stated the revisions were required by The Florida
Administrative Code. A member stated The Florida Administrative Code requires
the use of one of five different retention methods for Public Utility systems. The cost
to the Industry will be very expensive and the metering does not accomplish the
County's stated objectives. .
The Ordinance affects the Industry and should have been presented to DSAC first for
review.
A suggestion was made to send a letter to the BCC, copying the County Manger,
requesting the Utilities Ordinance be placed on a future agenda to allow DSAC to
make a presentation of its position at that time.
David Dunnavant moved to recommend DSA C send a letter, signed by the DSA C
Chairman, to each member of the Board of County Commissioners, with a copy to
the County Manager, requesting to place the issue ofdle Utilities Ordinance on the
next BCC Agenda. DSACwill review the impact of the Ordinance onthelndustry
and will present its position concerning the Ordinance at the next BeC meeting.
Second by David Hurst. Carried unanimous(v, 14-0.
