EXECUTIVE SUMMARY
Recommendation to transfer $245,566 within Fund 181, Court Facilities Fees,
from three completed and closed projects into two new, Court approved projects
for improvements to the Courthouse.
OBJECTIVE: To transfer the balances from three completed and closed projects into two new,
Court approved projects for improvements to the Courthouse. The two new projects are: 1.
HVAC repairs, replacements, and additions to the Courthouse mechanical system in order to
improve the system efficiencies, customer comfort, and system stability; and 2. Replacement of
the outdated and inaccurate signage throughout the Courthouse to esthetically match the
signage in the adjacent Annex along with accurately reflecting the current occupancy and
agencies within the Courthouse building (requested by the Courts).
CONSIDERATIONS: Fund 181, Court Facilities Fees, is supported by revenues generated by
court activities as provided in both Florida Law (F.S. 318.18(13)) and Collier County Ordinance
No. 2009-41. Funds collected pursuant to these sections must be used to support state court
facilities, and expended as provided by the Board of County Commissioners in consultation with
the Chief Judge of the Twentieth Judicial Circuit.
In a March 5, 2010 ietter to Chief Judge G. Keith Cary (Attachment A), the County Manager
requested that the remaining, unused balances from prior completed Projects 50057, 50062,
and 50059 be utilized for the new HVAC Improvement Project and the Signage Updating
Project. Chief Judge Cary approved the request in a letter dated March 18. 2010 (Attachment
B).
FISCAL IMPACT: These projects are funded by re-allocating the remaining balances from
three (3) previously budgeted, completed projects. There is no new funding required. The
source of funds is the Court Facilities Fee, Fund 181.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with
this Executive Summary.
LEGAL CONSIDERATIONS: This item has been reviewed and approved by the County
Attorney's Office and is legally sufficient for Board action.-CMG
RECOMMENDATION: That the Board of County Commissioners authorizes two Budget
Amendments in the amounts of $179,566.08 and $66,000.00 respectively to fund the HVAC
repairs. replacements, and additions and the repiacement of the outdated and inaccurate
signage in the Courthouse, as described within this Summary.

Why are funds needed?
These funds are needed to install new sign age throughout the Courthouse to update the space
utilization as a result of the relocation of the Clerk of Courts relocations to the new Courthouse
Annex. The new signage will not only provide a cohesiveness and unified look to the adjoined
facilities, but will also provide for a much needed revamp of the outdated signage, as well as
updating all improperly labeled current signage. This project is in concert with requests from the
Court Administration.
Where are funds available?
Project 50059 was completed very efficiently and economically by using in-house crafts personnel,
and this resulted in a substantial remaining balance in the project budget. Project 50059 will be
closed out, and a portion of that balance will be used to fund this project (Project 50078.1.1), and
the remainder used to fund Project 50077.].1 by another Budget Amendment.

Dear Judge Cary:
As you may know, Florida law (F.S. 318.18(13)) provides that local governments may impose a
$30 surcharge for any infraction or violation to fund "state court facilities." In compliance with
the statute, Collier County enacted Ordinance No. 2009-41 which provides:
Additionally, Collier County enacted Ordinance No. 2009-41 that provides that (a) every
person who pays a fine or civil penalty for any violation of a non-criminal traffic
infraction pursuant to Chapter 318, Florida Statutes, and every person who pleads guilty
or nolo contendere or is convicted, regardless of adjudication, of those offenses
enumerated in F.S. 318.17, shall be assessed a surcharge of $30. This surcharge is in
addition to any penalties imposed for non-criminal traffic infractions pursuant to Chapter
318, Florida Statues, or imposed for criminal violations listed in F.S. 318.17. The
ordinance further stipulates that (b) the Court shall order payments of this surcharge in all
matters subject to this section. The court shall not waive this surcharge and (c) the funds
collected pursuant to this section shall be used to fund state court facilities. Funds
collected pursuant to this section shall be expended as provided by the Board of County
Commissioners in consultation with the Chief Judge.
The County has completed or is in the process of completing the following projects under budget
with thc following remaining balances:
50057 & 50062 - Courthouse Carpet Replacement (Court and Hearing Rooms and
Magistrate Areas). Remaining Balance = $71,195.98
50059 - Courthouse Wood Furniture Restoration (wood benches, seating, and paneling).
Remaining Balance = $133,672.75

The County in accordance with F.S. 318.17 is requesting to utilize the above-mentioned project
balances for the fonowing projects:
1) Repairs, replacement, and additions to the HV AC systems and controls in the County
Courthouse facility. These upgrades will improve both the system efficiencies (saving on
the electric bills) as wen as improving customer comfort and system stability. These
changes are the result of an HV AC air and water balance survey and report produced by
one of the County's professional engineering contractors.
2) Install new signage throughout the Courthouse to match the new Courthouse Annex. The
new signage win not only provide a cohesiveness and unified look to the adjoined
facilities, but will also provide for a much needed revamp of the outdated signage, as wen
as updating all improperly labeled current signage. This is in concert with Court
Administration.
