Recommendation to declare a vacancy on the Black Affairs Advisory Board
OBJECTIVE: To declare a vacancy on the Black Affairs Advisory Board and direct statf to
issue a press release soliciting resumes in an effort to fill the vacant position.
CONSIDERATIONS: Ordinance No. 2001-55, Section 8, reads as follows; "It is the intent
and strong desire of the Commission that there be full attendance of advisory Board members at
all meetings of the Boards, recognizing, however, that it may be necessary for Board members to
be absent from a meeting due to unusual or emergency circumstances. Nevertheless, full
attendance at Board meetings is encouraged and necessary for the proper operation of the Boards
and in furtherance thereo f the fo llowing requirements are established: A. Any Board member
who is absent for more than one-half of the Board's meetings in a given fiscal year shall be
deemed to have tendered his or her resignation for such Board. The Commission shall, as soon
as practicable after such resignation, declare the position to be vacant and shall promptly fill
same pursuant to the provisions of Section Six herein. The Board member shall not serve at any
meetings after his or her position is declared vacant by the Commission. B. In the event that any
Board member is absent from two consecutive Board meetings without a satisfactory excuse
acceptable to the Board chairman, the Board chairman shall state such fact at the next regularly
scheduled Board meeting and shall thereafter notify, in writing, the Executive Manager to the
Commission of the Board member's failure to attend without satisfactory excuse. The
Commission shall review the Board Chairman's notification at a Commission meeting and shall .
declare the Board member's position to be vacant if the Commission concurs that the Board
member was absent from two consecutive Board meetings without a satisfactory excuse and
shall promptly fill same pursuant to the provisions of Section Six herein. The Board member
shall not serve at any meetings after his or her position is declared vacant. C. A member of a
Board shall be deemed absent from a meeting when he or she is not present during at least 75%
of the meetings.
Swruner Wheeless was appointed on December 16, 2008 to the Black Affairs Advisory Board.
Since Ms. Wheeless' appointment, she has had 7 consecutive unexcused absences as a member
of the committee. See attendance records attached.
Attached is a memorandum from staff advising that the committee is requesting that the Board of
County Commissioners declare a vacancy on the committee and direct staff to advertise to fill
the vacancy.
FISCAL IMPACT: NONE
GROWTH MANAGEMENT IMPACT: NONE
RECOMMENDATION: That the Board of County Commissioners consider the
recommendation to declare Summer Wheeless' seat vacant on the Black Affairs Advisory Board
and direct staff to issue a press release soliciting new members. It is also recommended that the
Board of County Commissioners direct the County Attorney to prepare a resolution declaring the
position vacant.

Please be advised that the Black Affairs Advisory Board has recommended the removal of Summer
Wheeless from the advisory board due to lack of attendance. This motion was voted on and approved by
all members in attendance. Please see attached meeting minutes of November 23, 2009, section II.
This action will result in one (1) vacancy on the board.
Additionally, the Black Affairs Advisory Board has received Ms. Mary Linda Sanders resignation
letter/emall dated April 14,2010. This action will result in one (1) additional vacancy on the board for a
total of two (2) vacancies. Please include vacancies In the next advertisement for advisory board
members.

This 9 member board was created on May 14, 1991, by Ord No. 91-38 & 91-77, to identify and
evaluate problems unique to the Black Community, review and recommend ways to ensure open
communication between minorities and Collier County Government and provide periodic reports
