EXECUTIVE SUMMARY
To review and approve proposed language to be added to County Manager's
Agency Policy (CMA) 5311, Code of Ethics, regarding employees who serve on
non-profit boards that receive direct or indirect funding from Collier County.
OBJECTIVE: To outline the process for an employee wishing to serve on the Board of
Directors of any not-for-profit organization receiving direct or indirect funding from the Board of
County Commissioners,
CONSIDERATIONS: At its regular meeting of February 9, 2010, the Board discussed agenda
item, (12A), in regards to an agreement that would allow the Office of the County Attorney to
provide defense in the lawsuit between the Deborah Dahlmanns and the Physician Led Access
Network (PLAN), Prior to approval of this item, Board members discussed the issue of County
employees participating as members of Boards of Directors for not-for-profit groups when the
not-for-profit organization receives funding from the County, either directly or indirectly. During
the discussion period, the Board directed the County Attorney and County Manager to consider
a policy change to prevent this situation from occurring,
In reviewing existing County Manager Agency policies and procedures, the County Ethics CMA
is the most appropriate place to include the revisions, The following wording is an addition to
the existing policy, and is being submitted for review:
M Employees must obtain authorization from the County Manager prior to serving
on the Board of Directors of any not-for-profit organization that receives direct or
indirect funding from the Board of County Commissioners, including grant funding, Any
employee responsible for or who participates in providing, authorizing, or allocating
said fUnding as part of his/her duties as a Collier County employee may serve only upon
approval by the Board of County Commissioners,
Including this language will provide direction to staff and allow them to seek appropriate
approvals prior to serving on the Board of Directors of any not-for-profit organization,
LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney's Office and
is legally sufficient for Board action, - CMG
FISCAL IMPACT: There is no fiscal impact associated with this Executive Summary,
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with
this Executive Summary,
RECOMMENDATION: That the Board approves the process for an employee wishing to serve
on the Board of Directors of any not-for-profit organization receiving direct or indirect funding
from the Board of County Commissioners,
