EXECUTIVE SUMMARY
Recommendation to authorize payments to Ground Zero Landscaping Services
Inc. for services rendered pursuant to Contract 05-3689 in the total amount of
$86,288.65.
OBJECTIVE: To pay the contractor for services performed in good faith under the
referenced agreement.
CONSIDERATIONS: On March 8, 2005, the Board of County Commissioners awarded
ITB 05-3689 to Ground Zero Landscaping Services Inc, The scope of the agreement
was to provide grounds maintenance services on an annual basis to the Bayshore
Gateway MSTU, The contractor commenced work in March, 2005 and has performed in
a satisfactory manner throughout the entire engagement.
The bid invitation specified that the initial contract period would be for one year with
three optional one year renewals for a total possible contract life of four years, At the
time of contract commencement, the Purchasing Department erroneously recorded the
initial contract period as spanning two years rather than one, As a result, the first
renewal of the contract was not requested or implemented until March 2007. In fact, the
first renewal of the contract should have been effective in March, 2006, In addition to the
initial two year contract period, the contract was renewed three times, resulting in a
contract that spanned four years and eleven months rather than four years,
Staff discovered the error late in 2009 and issued a new invitation to bid, Six bids were
received. As with the prior bid award, Ground Zero was the lowest, qualified and
responsive bidder, The new contract was awarded by the Board to Ground Zero on
February 9, 2010, item 16,G,3 (or eleven months after the final renewal period
commenced),
In order to remedy the aforementioned error, staff is asking the Board to ratify and
authorize all payments to Ground Zero under the referenced contract for the period
beginning March 8, 2009 and ending February 8, 2010, The total cost of services
rendered during the referenced eleven month period is $86,288,65, Pursuant to Section
XVII of the purchasing policy, the Purchasing Director has investigated this matter and
finds that it is in the best interests of the County to issue these payments,
FISCAL IMPACT: Funds for the pending payments are available within the operating
budget of the MSTU,
GROWTH MANAGEMENT IMPACT: There is no impact on the Growth Management
Plan,
LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney's
Office and is in compliance with the Purchasing Policy Article XVII. This item is legally
sufficient for Board action. - CMG
RECOMMENDATION: That the Board of County Commissioners ratifies and authorizes
payments to Ground Zero Landscaping Services Inc" for services rendered between
March 8, 2009 and February 8, 2010,
