EXECUTIVE SUMMARY
Recommendation that the Collier County Community Redevelopment Agency approves the
submittal of a Mixed-Used Planned Unit Development (MPUD) application to rezone CRA-owned
land; approve the Chair to sign application documents; and authorize the Executive Director to
complete and submit the application package and pay the application fee. (Fiscal Impact: $15,275)
OBJECTIVE: To receive approval 10 submit a Mixed-Used Planned Unit Development (MPUD)

the Executive Director to eomplete and submit the application package and pay the application fee.
BACKGROUND: The CRA identified several parcels of property important to the proactive
redevelopment of the Bayshore Gateway Triangle CRA. These pareels are identified in the CRA
Redevelopment Plan as potential sites for a catalyst redevelopment projects. In August 2006 the CRA
purchased 17 acres more or less of vacanlland in the Bayshore area.
On September 25, 2007, the CRA Board authorized the advertisement of an RFP to sell CRA-owned
land and for the Executive Director 10 return Wilh recommendations (Exhibit A). On June 9, 2009, the
CRA Board approved a Professional Services Agreement with Pizzuti Solutions, LLC to complete Phase
I planning and professional pre-development services for a mixed-use development on CRA-owned
land, specifically the 17 acres on Bayshore Drive (Exhibit B).
CONSIDERATIONS: Pizzuti Solutions, LLC has completed Task 2 of Phase I of the Agreement that
includes submitting a rezoning application 10 aecommodale a mixed-use project. The Pizzuti team met
with CDES staff twice and decided that rather than apply for a CRA Overlay Mixed Use Project (MUP),
they would submit a MPUD application (sample applieation attached as Exhibit C).
FISCAL IMPACT: The application fee for a MPUD is $15,275, and there are adequate funds available
in Fund 187's operating budget to cover this expense. Completion of a catalyst project on vacant land
will increase property values and increase the CRA's annual TIP.
GROWTH MANAGEMENT IMPACT: Policy 4.7 of the Future Land Use Element of the Growth
Management Plan states that redevelopment plans may be developed for specifie areas within the
County, including the Bayshore Gateway Triangle CRA.
LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney's Offiee and is
legally sufficient for Board action. (HF AC)

EXECUTIVE SUMMARY

OBJECTIVE: Recommendation for the Collier County Community Redevelopment Ageney (CRA)
to approve a Request for Proposals (RFP) scope of work to sell CRA owned land; approve lhe
Exeeulive Direelor to advertise the RFP through the County Purchasing Department and return with
reeommendalions.
BACKGROUND: Florida Stalule 163.358 - "Exercise powers in carrying out community
redevelopment and relaled aelivilies" - gives the CRA power to approve the aequisition of property.
Florida Statute ]63.380 - "Disposal of property in eommunity redevelopment area" delineates the
proeedures that lhe CRA musl follow in lhe sale, lease or lransfer of real property to any private
person.
CONSIDERATIONS: The Community Redevelopment Ageney identified several pareels of property
important to the proaclive redevelopmenl oflhe Bayshore Gateway Triangle sector ofthe Collier
County CRA. These parcels are identified in the CRA Master Redevelopment Plan as potential siles
for a eatalyst redevelopment projeets. In August 2006 lhe CRA purehased 17 acres more or less of
vaeanlland in the Bayshore area of the CRA 10 advertise in a request for proposals (RFP), Exhibit A,
for a development team to design and eonstruet a mixed use eatalyst projeet. Private seclor responses
10 the RFP will provide the CRA with an opportunity to review and select a development team to meet
the objeetives stated in the CRA Master Redevelopmenl Plan and CRA RFP scope of work.
FISCAL IMPACT: Sale ofCRA owned real property will generate revenue lhat may be applied to
the CRA's existing debl or applied as eash to another project. Complelion of a eatalyst project on
vaeant land will increase property values and increase the CRA's annual T1F.
GROWTH MANAGEMENT IMPACT: Poliey 4.7 of the Future Land Use Element oflhe Growth
Management Plan states lhat redevelopment plans may be developed for speeifie areas within the
County, including the Bayshore Gateway Triangle CRA.
LEGAL CONSIDERATIONS: Bond counsel together with the eounty attorney's o11ice will review
and prepared all neeessary doeumentation to complete the sale or lease of the property as authorized in
Chapter 163, Florida Statutes.

EXECUTIVE SUMMARY
Recommend approval of the award ofRFP #09-5184 and Professional Services Agreement
between Collier County Community Redevelopment Agency and Pizzuti Solutions, LLC
for Phase I planning/professional pre-development services for a mixed use development on
CRA-owned land in an estimated annual amount of $527,252, and approve all necessary
budget amendments. (Fiscal Impact: $527,252).
OBJECTIVE: To award RFP #09-5184 and a Professional Services Agreement to Pizzuti
Solutions LLC for the purpose of providing the Bayshore Gateway Triangle CRA with Phase I
planning/professional pre-development services for a mixed use development on CRA-owned
land in accordance with the Bayshore Mixed Use Development (BMUD) overlay.
CONSIDERATIONS: The Bayshore Gateway Triangle CRA was created 10 remove slum and
blight from within the CRA boundaries. As contemplated by Part Ill, Chapter 163 Florida
Statutes, a Community Redevelopment Plan was adopted by the Board of County
Commissioners (BCe) on June 13, 2000, and it cited locations throughout the CRA as potential
catalyst projeet sites. In 2006, the CRA purchased approximalely 17 aeres in the Bayshore Drive
area and added an additional 0.63 acres in 2008 to become a mixed use catalyst project.
RFP #09-5 I 84 for Master Developer services was posted on January 8, 2009. Two hundred fifty-
six notices of the RFP were sent out and one proposal was received by the due date of February
26, 2009. The selection committee chose Pizzuti Solutions LLC, by consensus, to perform Phase
1 planning/professional services as the catalyst site's Master Developer.
As a eondition of the Agreement, at the conclusion of Phase I, if the CRA and Pizzuti Solutions
LLC determine that it makes economical and eommercial sense to move to Phase II
Development (permitting, leasing, financing, construction and property management), 50% of
the fees paid for Phase I will be reimbursed to the CRA after the Phase II Development
Agreement is fully exeeuted.
FISCAL IMPACT: This Professional Services Agreement totals $527,252. In order to open a
purehase order for this contract, a budget amendment in the amount of $100,000 will be
necessary which moves available budget from the capital appropriation unit to lhe operating
appropriation unit. Because this contract will span multiple /iseal years, CRA approval of lhis
contract will enable the unspent eontract value from FY 200910 roll inlo FY 20 I O.
GROWTH MANAGEMENT IMPACT: None.
LEGAL CONSIDERATIONS: This item is not quasi-judicial, ex parte communi eat ion is not
required, requires majority vote, and is legally sufTIcient for Board action. CMG
RECOMMENDATION: That the Board approve the award of RFP #09-5184 to Pizzuti
Solutions LLC, authorize the eRA Chairman to sign lhe standard form contract, after approval
by County Attorney, and approve all neeessary budget amendments.

After completing the Master Plan, the necessary
zoning approvals to position the property with the

The MPUD Rezone, while requiring more e enslve 109 tion, is valid for five years with
extension provisions. After much discussion, it was determined that the MPUD Rezone provided the
flexibility necessary in today's economic environment.
Pursuant to an anticipated end-<lf-February Rezoning Application, on February 10, 2010, the Pizzuti
team met at the Collier County Offices for a scheduled pre-application meeting. The plans were
presented pursuant to an anticipated MPUD Rezone Application. Slaff provided comments as well as
requirements for the Rezoning application.
The Rezoning Application and supporting documents have been prepared and are anticipated to
be submitted to the CRA offices by the end of February for their review and support of the rezoning
application.
