EXECUTIVE SUMMARY
Recommendation to approve and authorize the Chairman to sign an amendment to the State
of Florida, Department of Children and Families (DCF) Challenge Grant. The amendment
is being requested by DCF in order to comply with Section 504 of the Rehabilitation Act of
1973, and the Americans with Disabilities Act of 1990, (Support to the Deaf and Hard of
Hearing).
OBJECTIVE: For the Board of County Commissioners (BCC) to approve and authorize the
Chairman to sign an amendment to the State of Florida, Department of Children and Families
(DCF) Challenge Grant. The amendment is being requested by DCF in order to comply with
Section 504 of the Rehabilitation Act of 1973, 29 U.S.c. 794 and the Americans with
Disabilities Act of 1990,43 U.S.c. 12131 (Support to the Deaf and Hard ofHearlng).
CONSIDERATIONS: On May 27, 2003, the Board of County Commissioners (BCC) gave
approval for the County to become the Lead agency and to apply, on behalf of the County's
social service agencies, for annual homeless assistance. On July 28, 2009, the BCC provided
after the fact approval (Item 16D2) for the 2010 Challenge Grant application. In September 2009
the Department of Housing and Human Services received notification that Collier County had
received a total Challenge Grant award in the amount of$96,000. This Challenge Grant funding
now provides assistance to Collier County citizens experiencing homelessness through five non-
profit entities: St. Matthew's House, The Shelter for Abused Women and Children, National
Alliance on Mental Illness, The Collier County Hunger and Homeless Coalition, and Youth
Haven, Inc. DCF must now amend their grant agreement with Collier County to comply with
federal mandates regarding Section 504 of the Rehabilitation Act of 1973 and the Americans
with Disabilities Act of 1990. Collier County already complies with these federal mandates for
all federal grants, and these provisions would not require any changes within the County. Grant
sub recipients will be notified of the amendment requirements and Zero Dollar Change Orders
will be processed for all sub grants to ensure compliance.
FISCAL IMPACT: Acceptance of this Challenge Grant amendment will allow Collier County
to maintain $96,000 in Challenge Grant funding. No general funds are associated with the
Challenge Grant or this amendment.
GROWTH MANAGEMENT IMPACT: The Challenge Grant and this amendment are
consistent with the Growth Management Plan.
LEGAL CONSIDERATIONS: This Challenge Grant amendment has been reviewed by the
County Attorney's Office and is legally sufficient for Board action. - CMG

This amendment, entered into between the State of Florida, Department of Children and
Families, hereinafter referred to as "Department", and Collier County Board of County
Commissioners, hereinafter referred to as the "Grantee", amends Grant # HFZ03 to:
. Add a new federal requirement.
Page 5, Challenge Grant Agreement, paragraph 26.(1) thru (7) is hereby added as
follows:
26. Support to the Deaf or Hard-of-Hearing
(1) The provider and its partners, subcontractors, and agents shall comply with
section 504 of the Rehabilitation Act of 1973, 29 U.S.C. 794, as implemented by 45
C.F.R. Part 84 (hereinafter referred to as Section 504) and the Americans with
Disabilities Act of 1990, 42 U.S.C. 12131, as implemented by 28 C.F.R. Part 35
(hereinafter referred to as AOA).
(2) The provider shall, if the provider or any of its partners, subcontractors, or agents
employs 15 or more employees, designate a Single-Point-of-Contact (one per firm) to
ensure effective communication with deef or hard-of-hearing customers or
companions in accordance with Section 504 and the ADA. The name and contact
information for the provider's Single-Point-of-Contact shall be furnished to the
department's Grant or Contract Manager within 14 calendar days of the effective date
of this requirement.
(3) The provider shall, within 30 days of the effective date of this requirement,
contractually require that its partners, subcontractors and agents comply with section
504 and the ADA. A Single-Point-of-Contact shall be required for each partner,
subcontractor or agent that employs 15 or more employees. This Slngle-Point-of-
Contact will ensure effective communication with deaf or hard-of-hearing customers
or companions in accordance with Section 504 and the ADA and coordinate activities
and reports with the provider's Single-Point-of-Contact.
(4) The Single-Point-of-Contact shall ensure that employees are aware of the
requirements, roles & responsibilities, and contact points associated compliance with
Section 504 and the ADA. Further, employees of providers, its partners,
subcontractors, and agents with 15 or more employees shall attest in writing that they
are familiar with the requirements of Section 504 and the ADA. This attestation shall
be maintained In the employee's personnel file.
(5) The provider's Single-Point-of-Contact will ensure that conspicuous Notices which
provide information about the avaitabllity of appropriate auxiliary aids and services at
no-cost to the deaf or hard-of-hearing customers or companions are posted near
where people enter or are admitted within the agent locations. Such Notices must be
posted immediately, but not later than March 12, 2010, with respect to current
providers (partners, subcontractors, and agents). The approved Notice can be

(6) The provider and its partners, subcontractors, and agents shall document the
customer's or companion's preferred method of communication and any requested
auxlUaryaids/services provided In the customer's record. Documentation, with
supporting justification, must also be made If any request was not honored. The
provider shall submit Compliance Reports monthly, not later than the 15111 day of each
month, to the department's Grant or Contract Manager. The provider shall distribute
Customer Feedback forms to customers .or companions, and provide assistance in
completing the forms as requested by the customer or companion.
(7) If customers or companions are referred to other agencies, the provider must
ensure that the receiving agency Is notified of the customer's or companion's
preferred method of communication and any auxiliary aids/service needs.
This amendment shall begin on Februarv 25. 2010, or the date on which the
amendment has been signed by both parties, whichever is later.
All provisions in the contract and any attachments thereto in conflict with this
amendment shall be and are hereby changed to conform with this amendment. All
provisions not in conflict with this amendment are still in effect and are to be
performed at the level specified In the contract.
This amendment and all of its attachments are hereby made a part of this contract.
IN WITNESS THEREOF, the parties hereto have caused this ~-page amendment to
