EXECUTIVE SUMMARY
Recommendation to approve conveyance of an Easement to Florida Power &
Light Company for providing interconnection services for the construction of the
landfill gas-to-energy facility at the Collier County Landfill, at no cost to the
County.
OBJECTIVE: To approve conveyance of an easement for the provIsion of
interconnection services for the construction of the landfill gas-to-energy facility at the
Collier County Landfill.
CONSIDERATION: The Board, at their December 16, 2008 meeting, approved Agenda
Item 10L authorizing the Landfill Gas Sales Agreement and Ground Lease between
Co"ier County and Waste Management Inc. of Florida. The permitting process for the
construction is nearing completion and construction is scheduled to begin in April. An
Easement to Florida Power & Light Company (FP&L) for the installation of the
interconnection facilities, including, but not limited to. conduit, poles, monitoring pad and
box, is required.
The easement area measures a total of approximately 2.162 square feet, and is shown
and described on Exhibit "A" to the Easement. The County will not be compensated
because the Easement is a requirement for FP&L to provide the facilities necessary for
the interconnection of the landfill gas-to-energy facility to the energy grid.
A location map is attached for reference.
FISCAL IMPACT: There is no fiscal impact as a result of this easement to the County.
All costs relating to the construction of the landfill gas-to-energy facility, including
recording costs of the easement, will be paid by Waste Management Inc. of Florida.
GROWTH MANAGEMENT IMPACT: There is no impact to the Growth Management
Plan.
LEGAL CONSIDERATIONS: The Easement document has been reviewed and
approved for form and legal sufficiency by the County Attorney's Office. This is a regular
item requiring a majority vote. - JBW
RECOMMENDATION: That the Board of Collier County Commissioners:
1. Approves the attached Easement.
2. Authorizes the Chairrnan to execute the Easement.
3. Directs the County Manager or his designee to proceed to record the
Easement in the Public Records of Collier County, Florida.

The undersigned, in consideration of the payment of $1.00 and other good and valuable
consideration, the adequacy and receipt of which is hereby acknowiedged, grant and give to
Florida Power & Light Company, its licenseesj agents, successors, and assigns, an easement
forever for the construction, operation and maintenance of overhead and underground eiectric
utiiity faciiities (including wires, poles, guys, cables, conduits and appurtenant equipment) to be
installed from time to time; with the right to reconstruct, improve, add to, enlarge, change the
voltage, as well as, the size of and remove such facilities or eny of them within an easement of
2,162 square feet more or less, described as follows:
An FP&L Company easement more particularly described on Exhibit "A"
attached hereto and made a part hereof. Said legal description and sketch
prepared by Bradley E. Stockham of Marco Surveying & Mapping.
Together with the right to permit any other person, firm or corporation to attach wires to any
facilities hereunder and lay cabie and conduit wrthin the easement and to operate the same for
communications purposes; the right of ingress and egress to said premises at all times; the right
to clear the land and keep it cleared of all trees, undergrowth and other obstructions within the
easement area; to trim and cut and keep trimmed and cut all dead, weak, leaning or dangerous
trees or limbs outside of the easement area which might interfere with or fall upon the lines or
systems of communications or power transmission or distribution; and further grants, to the
fullest extent the undersigned has the power to grant, if at all, the rights hereinabove granted on
the land heretofore described, over, along, under and across the roads, streets or highways
adjoining or through said property.
