EXECUTIVE SUMMARY
Board of County Commissioners Workshop to request policy guidance regarding proposed
amendments to section 6.06.02 "SIDEWALKS and BIKE LANE Requirements" and
section 10.02.03 "Submittal Requirements for Site Development Plans.." to allow for
flexibility to accept a "payment in lieu of construction" option, accept equivalent
alternative designs internal to the project" add the definition and requirement for
Greenways and add a provision to reduce the financial impacts on smaD improvement
projects.
_ OBJECTIVE:
A request to obtain policy guidance related to proposed amendments to sections 6.06.02 and
10.02.03 of the Collier County LDC to allow for greater flexibility for the payment in lieu.
accept alternative designs internal to the project, add the reference to Greenways and reduce
impacts on small improvement projects, and to request approval of a special cycle to amend the
LDC to resolve the noted issues.
CONSIDERATIONS:
Sections 6.06.02 and 10.02.03 ( Attachment A) of the current LDC. in a small number of
circumstances, do not provide sufficient flexibility for the "payment in lieu" option, where staff
may deem the application of the current code to not be in the best interest of the general public.
Under certain circumstances as defined by FDOT guidelines stating that sidewalks may not be
required due to factors such as where the cost would be excessively disproportionate to the
proposed improvement. or where public use or the project location is in a developed area with no
existing sidewalks and no provisions for future pathways in the Comprehensive Pathways Plan
and/or 5 year work program. or where staff deems that the construction of the sidewalks would
create an overall safety issue, staff is requesting the ability to consider the payment in lieu of
construction option. In those cases where staff deems the application of the code, where the
costs to construct the required sidewalks is excessively disproportionate to the corresponding
cost of the project, staff is proposing an amendment to the LDC to allow for an alternative
program to impose a cap of25% of project cost to be accepted as payment in lieu of construction
or in some cases 25% of the required sidewalk will be constructed.
The current IDC in sections 6.06.01 and 10.02.03 does not allow for an alternative design. more
specifically in multifamily developments where an alternative design equivalent in function may
be more suitable to the proposed use of the development.
Greenways are referred to in the current pathway work program and Comprehensive Pathway
plan adopted by the County but are not referenced in the LDC. The proposed modification to
sections 6.06.02 and 10.01.03 would add Greenways in the appropriate locations.

The proposed LDC amendments (Attachment B) are requested to be heard at a special LDC
cycle by the Collier County Planning Commission on February 3 and 17, 2005 and by the Board
of County Commissioners on March 15, 2005 and March 29.2005.
FISCAL IMPACT:
The proposed IDC amendment is estimated to accept payment in lieu of construction for
approximately $200,000.00 annually to be used for countywide sidewalk system improvements
or appropriate adjacent roadway Capital Improvement Projects, and will provide the opportunity
for permit applicants a viable alternative to reduce the overall financial impact of meeting
mandates of the code.
GROWm MANAGEMENT IMPACf:
This proposed IDC amendment is consistent with the Growth Management Plan.
STAFF RECOMMENDATION:
That the Board of County Commissioners provide guidance regarding the proposed IDC
amendment to allow for flexibility in the application of sidewalks bike lanes and greenways and
direct staff to prepare the LDC amendments for a special LDC Amendment cycle to be heard
March 15 and March 29, 2005.

CURRENT LDC SECTIONS 6.06.02 AND 10.02.03:

6.06.02 SIDEWALKS and BIKE LANE Requirements
A The developer must construct SIDEWALKS and BIKE LANES, where
applicable, as described below, unless otherwise exempted from the
SUBDIVISION regulations of this LOC. SIDEWALKS and BIKE
LANES, where applicable, must be constructed contiguous to public
and private roadways, which are ADJACENT to and internal to the
site, in conformance with the following criteria:
1. BIKE LANES must be provided on both sides of COLLECTOR
and ARTERIAL STREETS.
2. SIDEWALKS six (6) feet in width must be provided on both sides
of COLLECTOR and ARTERIAL STREETS.
3. SIDEWALKS five (5) feet in width must be provided on both sides
of local STREETS.
4. For multi-family site DEVELOPMENT and site improvement
projects, districts RT, RMF-6, RMF-12, and RMF-16 and all multifamily
residential components of PUO districts; SIDEWALKS, five
feet in width, must be provided on both sides of local STREETS
with a dedicated public RIGHT -Of-WAY or roadway EASEMENT.
Where there is no public RIGHT -Of-WAY or roadway EASEMENT,
SIDEWALKS must connect on-site residential BUILDING(s) to a
SIDEWALK within a public roadway or, if no SIDEWALK exists, to
the RIGHT-Of-WAY line in accordance with Code standards
contained herein. Should a two-clirectional shared use path be
utilized, the minimum paved width must be ten feet.
5. All SIDEWALKS and BIKE LANES along public and private
roadways must be constructed in accordance with design
specifications identified in section 4.03.05 and section 5.05.08 of
this LOC.
6. All bicycle lanes must have signage and be marked in accordance
with the latest edition of the U.S.D.O.T.F.H.W.A. Manual on
Uniform Traffic Control Devices.
B. DEVELOPMENTS providing interconnections to existing and future
DEVELOPMENTS pursuant to the DENSITY rating system section of
the GMP must include sufficient RIGHT-Of-WAY to accommodate the
roadway, SIDEWALKS and BIKE LANES, where required. BIKE
LANES and SIDEWALKS must be constructed concurrently with the
roadway interconnection.
C. Where planned RIGHT-Of-WAY improvements by the County
Transportation Division scheduled in the capital improvements
program (CIP) would cause the removal of any SIDEWALKS or BIKE

LANES, the developer, in lieu of construction of the required
SIDEWALKS and BIKE LANES, must provide funds for the cost of
SIDEWALK and BIKE LANE construction as defined by the SchedulElt
of DEVELOPMENT of Review and BUilDING Permit Fees into a
PATHWAY fund approved by the County Manger or designee, for
future construction of required SIDEWALKS and BIKE LANES, by the
County. The time frame for this funding option is two years from the
date of issuance of the first BUilDING permit to the date that the road
construction is required to be bid.
D. SIDEWALK Construction/Materials. All SIDEWALKS shall be
constructed of Portland cement concrete, or paver brick in
conformance with the standard RIGHT-OF-WAY cross sections
contained in appendix B in locations illustrated on an approved site
DEVELOPMENT PLAN.
1. Concrete SIDEWALKS shall be four-inch-thick, Portland cement
concrete with a 28-day compressive strength of 3,000 psi. Expansion
joints shall be one-half-inch preformed bituminous conforming to the
latest edition of ASTM. Contraction joints shall be saw-cut joints with
longitudinal spacing equal to the width of the walk. The saw cut depth
shall equal or exceed one-forth the concrete thickness. All
workmanship materials, methods of placement, curing, forms,
foundation, finishing, etc. shall be in conformance to the latest edition
of FOOT Standard Specifications for Road and Bridge Construction,
section 522. Paver brick, SIDEWALKS, or paver brick accents in
SIDEWALKS must be installed over a four inch thick, compacted
limerock base.
2. All BIKE LANES shall be designed, constructed, and signed in
accordance with the most current "Florida Bicycle Facilities Design
Standards and Guidelines" requirements
