HEX Final Decision 2018-15 HEX NO. 2018 - 15 HEARING EXAMINER DECISION PETITION NO. VA-PL20170002719 — Joseph Paiva requests a variance from the minimum rear yard setback in Ordinance No. 14-10, as amended, the Temple Citrus Grove RPUD, to reduce the minimum rear yard setback on an open space lot from 3 feet to .1 feet for an existing pool screen enclosure and pool, located at Lot 176, Temple Citrus Grove subdivision, also described as 13636 Mandarin Circle, in Section 12, Township 49 South, Range 25 East, Collier County, Florida. DATE OF HEARING: July 26, 2018 STAFF RECOMMENDATION: Approval. FINDINGS: Based on the applicant's written petition, testimony at the hearing of the applicant and the recommendation of staff, the Hearing Examiner finds that each of the criteria set forth in Section 9.04.03 of the Land Development Code has been met and the petition should be approved. ANALYSIS: No objections have been received and no members of the public attended this meeting objecting to this application. The reduction in setback for this rear accessory use does not impact the existing rear fifteen-foot buffer between this Planned Unit Development (PUD) and the abutting PUD, Manchester Square. Manchester Square also has a buffer on their side of the PUD boundary of ten-feet with similarly allowed accessory uses. DECISION: The Hearing Examiner hereby approves Petition No. VA-PL20170002719 filed by Ashley Coburn and David Corban on behalf of Joseph Paiva, for a variance from the minimum rear yard setback in Ordinance No. 14-10, as amended, the Temple Citrus Grove RPUD, to reduce the minimum rear yard setback on an open space lot from 3 feet to .1 feet for an existing pool screen enclosure and pool, as shown in the Survey Sketch attached as Exhibit "A", on property located at 13636 Mandarin Circle, Naples, Florida, and further described herein, subject to the condition(s) set forth below.
