08/06/2018 Item 3D EXECUTIVE SUMMARY Confirmation of the Collier County Board of County Commissioners' and the Collier County School Board's Appointed Citizen Members for the 2018 Value Adjustment Board. OBJECTIVE: To further confirm the appointments and membership of the VAB Citizen Members as appointed by the BCC and the School Board of Collier County, Florida. CONSIDERATIONS: As a matter of legal documentation, both the Board of County Commissioners' appointment and the School District's appointment have been verified that they meet the requirements to serve on the Value Adjustment Board per Florida Statute 194.015 Florida Administrative Code (FAC) 12D-9.004. The 2018 Florida Statutes Title XIV Chapter 194 View Entire TAXATION AND ADMINISTRATIVE AND JUDICIAL REVIEW OF PROPERTY Chapter FINANCE TAXES 194.015 Value adjustment board.—There is hereby created a value adjustment board for each county, which shall consist of two members of the governing body of the county as elected from the membership of the board of said governing body, one of whom shall be elected chairperson, and one member of the school board as elected from the membership of the school board, and two citizen members, one of whom shall be appointed by the governing body of the county and must own homestead property within the county and one of whom must be appointed by the school board and must own a business occupying commercial space located within the school district. A citizen member may not be a member or an employee of any taxing authority, and may not be a person who represents property owners in any administrative or judicial review of property taxes. The members of the board may be temporarily replaced by other members of the respective boards on appointment by their respective chairpersons. Any three members shall constitute a quorum of the board, except that each quorum must include at least one member of said governing board, at least one member of the school board, and at least one citizen member and no meeting of the board shall take place unless a quorum is present. Members of the board may receive such per diem compensation as is allowed by law for state employees if both bodies elect to allow such compensation. The clerk of the governing body of the county shall be the clerk of the value adjustment board. The board shall appoint private counsel who has practiced law for over 5 years and who shall receive such compensation as may be established by the board. The private counsel may not represent the property appraiser, the tax collector, any taxing authority, or any property owner in any administrative or judicial review of property taxes. No meeting of the board shall take place unless counsel to the board is present. Two-fifths of the expenses of the board shall be borne by the district school board and three-fifths by the district county commission. (1)Every county shall have a value adjustment board which consists of: (a)Two members of the governing body of the county, elected by the governing body from among its members, one of whom shall be elected as the chair of the value adjustment board; (b)One member of the school board of the county,elected by the school board from among its members;and, (c)Two citizen members: 1. One who owns homestead property in the county appointed by the county's governing body, 2. One who owns a business that occupies commercial space located within the school district appointed by the school board of the county. This person must, during the entire course of service, own a commercial enterprise, occupation, profession, or trade conducted from a commercial space located within the school district and need not be the sole owner. 3.Citizen members must not be: a.A member or employee of any taxing authority in this state, b. A person who represents property owners, property appraisers, tax collectors, or taxing authorities in any administrative or judicial review of property taxes. 4.Citizen members shall be appointed in a manner to avoid conflicts of interest or the appearance of conflicts of interest. (2)(a) Each elected member of the value adjustment board shall serve on the board until he or she is replaced by a successor elected by his or her respective governing body or school board or is no longer a member of the governing body or school board of the county. (b) When an elected member of the value adjustment board ceases being a member of the governing body or school board whom he or she represents,that governing body or school board must elect a replacement. (c) When the citizen member of the value adjustment board appointed by the governing body of the county is no longer an owner of homestead property within the county,the governing body must appoint a replacement. (d) When the citizen member appointed by the school board is no longer an owner of a business occupying commercial space located within the school district,the school board must appoint a replacement. (3)(a) At the same time that it selects a primary member of the value adjustment board, the governing body or school board may select an alternate to serve in place of the primary member as needed.The method for selecting alternates is the same as that for selecting the primary members. (b) At any time during the value adjustment board process the chair of the county governing body or the chair of the school board may appoint a temporary replacement for its elected member of the value adjustment board or for a citizen member it has appointed to serve on the value adjustment board. (4)(a)To have a quorum of the value adjustment board,the members of the board who are present must include at least: 1.One member of the governing body of the county, 2. One member of the school board;and, 3. One of the two citizen members. (b)The quorum requirements of Section 194.015,F.S.,may not be waived by anyone,including the petitioner. (5)The value adjustment board cannot hold its organizational meeting until all members of the board are appointed, even if the number and type of members appointed are sufficient to constitute a quorum. Kelly Lichter, Stephanie LucareUi, Roy Terry Opening of Meeting Call to Order Mr. Roy M. Terry, Board Chair, called the meeting to order at 4:30 p.m. Roll Call The roll was called by Jennifer Kupiec. Statement of Meeting Guidelines Mr. Terry noted that after the recognition portion of the meeting, the board would recess for an attorney-client meeting and would resume upon its conclusion. He then reviewed the meeting guidelines and board meeting norms. Superintendent Opening Remarks Superintendent Dr. Kamela Patton shared opening remarks and welcomed members of the Immokalee High School JROTC for the Presentation of Colors. Pledge to the Flag/Moment of Silence The Pledge of Allegiance was led by Immokalee Middle School student Larry Butler followed by a brief moment of silence. A performance by the Immokalee Middle School Chorus concluded the presentation. Academic Highlights Al Principal for a Day Mr. Greg Turchetta, Executive Director of Communications and Community Engagement, shared an academic highlight featuring the district's recent Principal for a Day program. A2 3rd Annual CCPS 5K Mr. Greg Turchetta shared an academic highlight featuring the district's 3rd Annual CCPS 5K WalkRun. A3 MathCounts Competition Mr. Greg Turchetta shared an academic highlight featuring the recent middle school MathCounts Competition. Recognitions A4 Immokalee High School BETA National Champions The board recognized the Immokalee High School BETA Club for its National Championship win in the Campaign Skit category at the 37th National BETA Club Convention. In addition, the board recognized BETA Club member and National Champion, Chrissy Perez, for her first place win in the Secretarial Race Campaign Skit category. She felt the minutes were missing information and requested that more detail be included under the School Board Comments section on the November 21, 2017 - Regular School Board Meeting Minutes. She specifically requested that her comment regarding a bar complaint against Mr. Fishbane be included, as well as her reference to Sunshine Law violations. Mrs. Dono|dsagreed with Mrs. Lichter and asked that her response regarding possible Sunshine Law violations be included. Mr. Fishbane provided his opinion regarding the minutes of the meeting. Mrs. Dona|ds made a motion to table this item until the next meeting so that the requested changes from Mrs. Lichter and herself may be made. The motion was seconded by Mrs. Lichter and further discussion ensued. He shared that he recently presented at both Lorenzo Walker Technical High School and Lorenzo Walker Technical College. He also shared sentiments from the visit by Congressman Francis Rooney and U.S. Secretary of Education, Betsy DeVos. Mr. Carter thanked Mr. Vincent Keeys for his comments and wished everyone a happy holiday, Mrs. Lichter shared a concern regarding a Facebook post made by an employee, wondering if it violated School Board Policy 7540. She added that her concern was whether the district is putting itself at risk for free speech lawsuits based on how it disciplines each case. Board discussion ensued. Mr. Fishbane shared case law on the matter. Further discussion ensued. Mrs. Dnna|dssuggested bringing the policy back in February for review. The board agreed. Mrs. Lichter also wished everyone a happy holiday. Mrs. Dona|Us brought up a request for future agenda items. She informed the board that she received a letter from the City of Marco Island with a formal request to fund a capital project for Marco Island Academy. Mrs. Uona|ds was disappointed to hear that they already received an answer to the letter before it was ever discussed on the board level and asked if the topic could be brought to an agenda in anticipation of the capital plan in May. Dr. Patton responded to Mrs. Dona|ds' noting that the letter had just been received by the district and there was no response to the letter as was mentioned. Dr. Patton agreed to send a copy of the letter to each board member, adding that she and Mr. Terry will look at when the topic could be added to an agenda. Mrs. Dvna|dsa|so brought up a concern regarding the negotiations of non-bargaining employee raises, asking whether it might be considered a conflict of interest as the bargaining individuals are involved in the bargaining of these raises, which are essentially their raises. She added that some districts use bargaining consultants to eliminate that conflict of interest. Some discussion ensued on the topic. Staff agreed to look into what other districts are doing and report back to the board. Mrs. Dona|dsa|so shared comments regarding Dr. Martin Luther King Jr. Day and the ZOl9'ZOZ0 Academic Calendar survey which is open through December 22. Lastly, she wished everyone a happy holiday. Mrs. Lucarelli thanked Mrs. Dona|Us for recognizing the efforts that go into the Academic Calendar and reminded everyone to go online and take the survey.
