EXECUTIVE SUMMARY
VA-PL2009-037, FLO TV Inc., represented by Kimberly J. Madison, Esq., of
Ruden, McClosky, Smith, Schuster and Russell, P.A., is requesting three after-the-
fact Variances to allow a Variance of 55.7 feet from the 75-foot front yard setback
requirement; and Variances of 22.3 feet and 22.6 feet from the 30-foot eastern and
western side yard setback requirements, respectively, of LDC subsection 4.02.01,
Table 2.1, Table of Minimum Yard Requirements for Base Zoning Districts, to permit
19.3-foot, 7.7-foot and 7.4-foot setbacks, respectively, for the guy lines and anchors
of a communications tower in excess of 75 feet in the Estates (E) Zoning District.
The 4.77-acre subject property is located at 5860 Crews Road, in Section 8,
Township 50 South, Range 26 East, in Collier County, Florida (Companion item to
CU-2008-AR-14085).
OBJECTIVE:
To have the Board of Zoning Appeals (BZA) consider the above-referenced Variance
petition and render a decision pursuant to Section 9.04.04 of the Land Development Code
(LDC) in order to ensure that the project is in harmony with all applicable codes and
regulations and that the community's interests are maintained.
CONSIDERA nONS:
As noted in the companion Conditionaj Use application, the applicant is seeking to
legitimize the existence of two guyed communications towers on the subject property.
However, according to LDC 5.05.09.G.17, ground-mounted guyed towers in excess of75
feet in height are required to provide the minimum yard requirements of the base zoning
district between each guy anchor and all property lines. As the subject towers exceed 75
feet in height and the subject property is in the E Zoning District, the required front and
side yard setbacks for the guy anchors are 75 feet and 30 feet, respectively (all of the
towers' rear guy anchors are a sufficient distance from the rear property boundary and,
therefore, unaffected by the required 75-foot rear yard setback).
As shown on the Conceptual Site Plan contained within the Collier County Planning
Commission Staff Report entitled, "Overall Site Plan," prepared by Black and Veatch,
and dated September 28, 2007, as revised through April 9, 2009, the two existing
communications towers and accessory equipment shelters are shown within a chain-link
fence enclosure that is somewhat centrally located on the site. The communications
towers are spaced 50 feet apart and supported by guy lines and anchors that are depicted
adjacent to the southern, eastern and western boundaries of the site. As shown on the
Conceptual Site Plan, four of these anchors are located within the 75-footfront setback
yard, three are within the western side setback yard, and four are within the eastern side
setback yard. Because these guy lines and anchors were specifically installed in these
locations to maximize their strength and the structural soundness of the towers, and

subsequently relocating them may jeopardize the towers integrity, the applicants are
requesting the following three afler-the- fact Variances:
. 55.7 feet from the 75-foot front yard setback requirement to permit a 19.3-foot
setback;
. 22.3 feet from the 30- foot eastern side yard setback requirement to permit a 7.7-
foot setback; and
. 22.6 feet from the 30-foot western side yard setback requirement to permit a 7.4-
foot setback.
FISCAL IMPACT:
Approval of this Variance petition would have no fiscal impact on Collier County.
GROWTH MANAGEMENT PLAN (GMP) IMPACT:
Approval of this Variance would not affect or change the requirements ofthe GMP.
AFFORDABLE HOUSING IMPACT:
Approval of this Variance would have no affordable housing impact.
ENVIRONMENTAL ISSUES:
There are no environmental issues associated with this Variance.
ENVIRONMENTAL ADVISORY COUNCIL (EAC) RECOMMENDATION:
The EAC did not review this petition as they do not normally hear Variance petitions.
COLLIER COUNTY PLANNING COMMISSION (CCPC) RECOMMENDATION:
Petition V A-PL2009-037 was continued from the October 15, 2009 CCPC hearing,
pending further information as noted in the Supplemental Staff Report. The CCPC heard
the petition again on January 7, 2010, and believing that approving the Variance would
not be injurious to the neighborhood or detrimental to the public welfare, voted 6-2 to
forward this petition to the Board of Zoning Appeals (BZA) with a recommendation of
approval, subject to the following conditions:
1. The Variances granted shall be strictly limited to the front and side yard
encroachments of the guy lines and their support anchors, as depicted in the
applicant's submitted survey, dated September 18, 2008, included as Exhibit A.
2. All of the guy line anchors on the site shall be enclosed by a fence.

Two commissioners did not support the petition because the applicant faijed to meet the
conditions of approvaj from the first Conditional Use. They expressed that the applicant
could not be trusted with the conditions ofthe second Conditional Use and Variance.
LEGAL CONSIDERATIONS:
The petitioner is requesting after-the-fact Variances from the front and side yard setback
requirements for communications towers. The granting of such Variances is permitted
under LDC Section 9,04.02. The attached staff report and recommendations of the
Planning Commission are advisory only and are not binding on you. Petitioners have the
burden to prove that the proposed Variance is consistent with all the criteria set forth
below, and you may question the petitioners or staff to assure yourself that the necessary
criteria have been satisfied. Should you consider denying the Variance, to assure that
your decision is not later found to be arbitrary, discriminatory or unreasonable; the denial
must be based upon competent, substantial evidence that the proposal does not meet one
or more of the listed criteria below. In granting any Variance, the BZA may prescribe
appropriate conditions and safeguards in conformity with the zoning code, including, but
not limited to, reasonable time limits within which action for which the Variance is
required shall be begun or completed, or both. Violation of such conditions and
safeguards, when made a part of the terms under which the Variance is granted, would be
deemed a violation of the zoning code, -STW
Criteria for Variances
I. There are special conditions and circumstances existing which are peculiar to the
location, size, and characteristics ofthe land, structure, or building involved.
2. There are special conditions and circumstances which do not result from the action of
the applicant, such as pre-existing conditions relative to the property which is the
subject of the Variance request.
3. A literal interpretation of the provisions of the LDC work unnecessary and undue
hardship on the applicant or create practical difficulties on the applicant.
4. The Variance, if granted, will be the minimum variance that will make possible the
reasonable use of the land, building, or structure and which promote standards of
health, safety, or welfare.
5. Granting the Variance requested will not confer on the petitioner any special privilege
that is denied by these zoning regulations to other lands, buildings, or structures in the
same zoning district.
6. Granting the Variance will be in harmony with the intent and purpose of the LDC, and
not be injurious to the neighborhood, or otherwise detrimental to the public welfare.
7. There are natural conditions or physically induced conditions that ameliorate the goals
and objectives ofthe regulation, such as natural preserves, lakes, golf course, etc.
8. Granting the Variance will be consistent with the GMP.

RECOMMENDATION:
Staff recommends that the Board of Zoning Appeals approve Petition V A-PL2009-037,
subject to the conditions of approval below, which have been incorporated into the
attached resolution:
I. The Variances granted shall be strictly limited to the front and side yard
encroachments of the guy lines and their support anchors, as depicted in the
applicant's submitted survey, dated September 18, 2008, included as Exhibit A.
2. All of the guy line anchors on the site shall be enclosed by a fence.
Staff has received one letter of objection from the community, which is attached to the
Staff Report as Appendix 2.

PURPOSEfDESCRlPTION OF PROJECT:
As noted in the companion application, the applicant is seeking to legitimize the continued
existence of two guyed communications towers on the subject property. According to LDC
5.05.09.0.17, however, ground-mounted guyed towers in excess of75 feet in height are required
to provide the minimum yard requirements of the base zoning district between each guy anchor
and all property lines, Since the subject towers exceed 75 feet in height and the subject property
is in the E Zoning District, the required front and side yard setbacks for the guy anchors are 75
feet and 30 feet, respectively. (All of the towers' rear guy anchors are a sufficient distance from
the rear property boundary and, therefore, unaffected by its required 75-foot setback).
As shown on the Conceptual Site Plan on the preceding page, entitled, "Overall Site Plan,"
prepared by Black and Veatch, and dated September 28,2007, as revised through April 9,2009,
the two communications towers and accessory equipment shelters are shown in a chain-link
fence enclosure somewhat centrally located on the site. The communications towers are spaced
50 feet apart and supported by guy lines and anchors that are depicted adjacent to the southern,
eastern and western boundaries of the site. As shown on the Conceptual Site Plan, two of these
anchors are located within the 75-footfront setback yard, two are within the western side setback
yard, and three are within the eastern side setback yard. Because these guy lines and anchors
were specifically installed in these locations to maximize their strength and the structural
soundness of the towers, according to the applicant, their subsequent relocation could jeopardize
the towers' integrity. Therefore, the following three after-the-fact Variances are being requested:
· 55.7 feet from the 75-foot front yard setback requirement, to pennit a I 9.3-foot setback;
· 22.3 feet from the 30-foot eastern side yard setback requirement, to pennit a 7.7-foot
setback; and
· 22.6 feet from the 30-foot western side yard setback requirement, to permit a 7.4-foot
setback.
Although there are seven guy line anchor encroachments affecting three different setback yards,
staff normally requests Variances for only the ones that encroach the most into each of the
setback yards. (For example, if a setback of7.7 feet is ultimately approved in the eastern setback
yard then, as depicted in the Master Plan, the offending 8.4-foot and 13.7-foot guy anchors in
this yard would automatically be rendered lawful since they encroach even less than 7.7 feet.)
While it is true that this would ultimately grant the applicant the right to relocate the other guy
lines closer to the property boundary, the applicant's justification for the after-the-fact Variances
in the first place was because the anchors could not be moved without jeopardizing the integrity
of the towers. Nevertheless, staff is amenable to stipulating the precise setback of each guy line
anchor, as noted in the conditions of approval.

GROWTH MANAGEMENT PLAN (GMP) CONSISTENCY:
The subject property is designated Urban-Mixed Use District, Urban Residential Subdistrict on
the Future Land Use Map (FLUM) of the GMP, Relevant to this petition, the designation permits
non-residential uses, including utility and communication facilities.
The GMP does not address individual Variance requests but focuses on the larger issue of the
actual use. As previously noted, the subject Variances are sought to allow a reduction of the 75-
foot front yard setback requirement and 30-foot side yard setback requirement for the guy
anchors of two existing communications towers.
Future Land Use Element (FLUE) Policy 5,4 requires new land uses to be compatible with and
oomplementary to the surrounding land uses as set forth in the LDC. It is the responsibility of the
Zoning and Land Development Review staff as part of their review of the petition in its entirety
to perform this oompatibility analysis.
Based upon the above analysis, staff ooncludes that the proposed Conditional Use may be
deemed consistent with the Future Land Use Element.
ANALYSIS:
Section 9.04.01 of the LDC gives the Board of Zoning Appeals (BZA) the authority to grant
Variances. The CCPC is advisory to the BZA and utilizes the provisions of Subsection 9.04.03
A. through H., in bold font below, as general guidelines to assist in making a reoommendation of
approval or denial. Staff has analyzed this petition relative to these provisions, and offers the
following responses:
a. Are there special conditions and circumstances existing, which are peculiar to the
location, size and characteristics of the land, structure or building involved?
Yes. As shown in the aerial photograph in the companion Conditional Use, development
on the subject property is primarily confined to a centralized location occupying just 21
percent of the site. This area is then surrounded by dense natural vegetation which
occupies the remaining 79 percent of the property. The requested Variances from the
required front and side yard setbacks are for guy lines and their anchors only, which have a
negligible impact compared to other types of development. Furthermore, the site is mostly
surrounded by undeveloped land, especially along the boundaries in which the Variances
are being requested.
b. Are there special conditions and circumstances, which do not result from the action of
the applicant such as pre-existing conditions relative to the property, which is the
subject of the Variance request?
The current property owner, Renda Broadcasting, was the property owner at the time that the
new tower was erected and the old one was left standing. However, the conditions on the
site are pre-existing for the applicant, who leases space on the towers from the owner. In
addition, a single communications tower has been in operation on the subject property for

nearly 30 years, and two have been in existence since 1999. Neither of the towers has had
any complaints registered with the County.
c. Will a literal interpretation of the provisions of this zoning code work unnecessary
and undue hardship on the applicant or create practical difficulties for the applicant?
Yes, In their application, the applicants contend that adherence to the required setbacks
would require the removal and relocation of the guy lines and anchors, which would
jeopardize the structural integrity of the towers the support. Therefore, the enforcement of
the required setbacks would create practical difficulties for the applicant. However,
according to the LDC, the towers' bases, guy anchors, outdoor equipment and accessory
structures need to be fenced. As everything on the site except the guy line anchors is
presently fenced, staff has included a condition of approval requiring that they also be
enclosed.
d. Will the Variances, if granted, be the minimum Variances that will make possible the
reasonable use of the land, building or structure and which promote standards of
health, safety and welfare?
Yes. The Variances requested would be the minimum to make possible the reasonable use
of the existing communications towers. Since relocation of these towers' guy lines and
anchors could jeopardize public safety, and because existing vegetation on the site and the
surrounding areas would adequately screen the guy lines and anchors located in the
reduced setback yards, it is staff's opinion that the standards of health safety and welfare
would be promoted if the Variances were approved. However, if the Variances were not
approved, the petitioner would still have reasonable use of the land.
e. WiD granting the Variances confer on the applicant any special privilege that is
denied by these zoning regulations to other lands, buildings, or structures in the same
zoning district?
Yes. A Variance by definition confers some dimensional relief from the zoning regulations
specific to a site, However, as noted in the Conditional Use application, the
communications tower would be located on an essential service site utilized by the FBI.
Therefore, the general public, and not only the applicant, would benefit.
f. Will granting the Variances be in harmony with the general intent and purpose of this
Land Development Code, and not be injurious to the neighborhood, or otherwise
detrimental to the public welfare?
Yes. The proposed Variances would merely legitimize the existence of two
communications towers that have been operating on the site without complaint for at least a
decade. If the requested Variances are granted, the reduced front and side setback yards
would not be detrimental to the neighborhood or the public's welfare due to the fact that
the site itself and the surrounding properties are heavily wooded. Furthermore, the
communications towers would meet all of the other requirements of LDC 5,05.09.G,
Development Standards for Communications Towers. Finally, if approved, the project
would further LDC 5.05.09, Communications Towers, subsection A which, among other

objectives, encourages "the shared use of specified tower sites to minimize the need for
additional tower sites."

Yes, as previously noted, only 21 percent of the site is developed, so the preponderance of
the 4.77 -acre site would remain as natural open space. Furthermore, the site is generally
surrounded by undeveloped land, particularly along the boundaries affected by the
requested Variances. Therefore, the visual aspect of the guy lines and anchors would be
screened by vegetation and their negligible impact well mitigated.
h. Will granting the Variances be consistent with the Growth Management Plan (GMP)?
Approval of this Variance petition would not affect or change the requirements of the
Growth Management Plan. As previously noted, communications towers are an authorized
use in the Urban-Mixed Use District, Urban Residential Subdistrict of the Future Land Use
Map (PLUM) of the GMP.
ENVIRONMENTAL ADVISORY COUNCIL (EACl RECOMMENDATION:
The EAC does not normally hear Variance petitions and did not hear this one.
COUNTY ATTORNEY OFFICE REVIEW:
The County Attorney's Office has reviewed this staff report, revised on July 30, 2009.
RECOMMENDATION:
Staff recommends that the CCPC forward petition V A-PL-2009-037 to the Board of Zoning
Appeals (BZA) with a recommendation of approval, subject to the following condition:
1. The Variances granted shall be strictly limited to the front and side yard
encroachments of the guy lines and their support anchors, as depicted in the
applicant's submitted survey, dated September 18, 2008, included as Exhibit A.
2. All of the guy line anchors on the site shall be enclosed by a fence.

Narrative Statement
The Applicant seeks variance approval from Section 5.05.09(G)(l7) of the Collier County Land
Development Code ("LDC") so as to pennit a reduction of the front and side yard setback requirements as
applied to existing guy line anchors that support an existing wireless tower located at 5860 Crews Road
("Tower"). This Variance Petition is a companion item to Applicant's pending petition for Conditional
Use (CU-2008-AR-14085) to penn it the installation of a shelter and broadcast equipment on the same
Tower. No reduction is needed from the rear setback requirements of the LOC.
1. Are there special conditions and circumstances existing which are peculiar to the location,
size and characteristics of the land, strncture, or building involved.
The subject Tower has existed for nearly 30 years and the guy line anchors were installed in
specific locations to maximize the strength and structural soundness of the Tower. Relocating the guy
anchors will jeopardize the Tower's strength and structural integrity.
2. Are there special conditions and circumstances which do not result from the action of the
applicant such as pre-existing conditions relative to the property which is the subject of the
variance request.
The Applicant was not responsible for the construction of the Tower or the guy anchors, nor was
thc Applicant affiliated with the Tower or the property at the time the Tower was constructed. As such,
the current location of the guy anchors constitutes a pre-existing condition existing prior to the
Applicant's use ofthe Tower.
3. Will a literal interpretation of the provisions of this zoning code work unnecessary and
undue hardship on the applicant or create practical difficulties on the applicant.
Strict adherence to the set back requirements will cause undue hardship to the Applicant due to
the fact that the guy lines support an existing Tower and as such, they cannot be removed without
jeopardizing the structural integrity of the Tower. Additionally, the location ofthe guy anchors was pre-
existing prior to the Applicant's use of the Tower.
4. Will the variance, if granted, be the minimum variance that will make possible the
reasonable use of the land, building or structure and which promote standards of health, safety or
welfare.
The requested variance is the mmlmum variance required to ensure the Tower's continued
strength and structural integrity in promotion of the safety and welfare of the general public.
5. Will granting the variance requested confer on the petitioner any special privilege that is
denied by these zoning regulation to otber lands, buildings, or structures in the same zoning
district.
The Applicant will not receive any special privileges as a result of the variance request.

RESOLUTION NO. 10-
A RESOLUTION OF THE BOARD OF ZONING APPEALS OF
COLLIER COUNTY, FLORIDA RELATING TO PETITION
NUMBER VA-PL-2009-37, FOR A VARIANCE FROM THE
REQUIRED FRONT YARD AND SIDE YARD SETBACKS OF
LAND DEVELOPMENT CODE SUBSECTION 4.02.01, TABLE
2.1 RELATING TO GUY LINES OF A COMMUNICATIONS
TOWER LOCATED IN SECTION 8, TOWNSHIP 50 SOUTH,
RANGE 26 EAST, COLLIER COUNTY, FLORIDA.
WHEREAS, the Legislature of the State of Florida in Chapter 125, Florida Statutes, has
conferred on all counties in Florida the power to establish, coordinate and enforce zoning and
such business regulations as are necessary for the protection of the public; and
WHEREAS, the County pursuant thereto has adopted a Land Development Code (LDC)
(Ordinance No. 2004-41, as amended) which establishes regulations for the zoning of particular
geographic divisions of the County, among which is the granting of variances; and
WHEREAS, the Board of Zoning Appeals, being the duly elected constituted Board of
the area hereby affected, has held a public hearing after notice as in said regulations made and
provided, and has considered the advisability of a variance from the front yard and side yard
setback requirements of Land Development Code Subsection 4.02.0 I, Table 2.1 in the Estates
(E) zoning district for the property located at 5860 Crews Road in Section 8, Township 50 South,
Range 26 East, Collier County, Florida and more particularly described in Exhibit "C" attached
hereto and incorporated herein, and has found as a matter of fact that satisfactory provision and
arrangement have been made concerning all applicable matters required by said regulations and
in accordance with Section 4.02.01, Table 2.1 of said Land Development Code of Collier
County; and
WHEREAS, all interested parties have been given opportunity to be heard by this Board
in a public meeting assembled, and the Board having considered all matters presented.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ZONING APPEALS
OF COLLIER COUNTY, FLORIDA that:

Petition Number V A-PL-2009-37 filed by Kimberly J. Madison, Esquire of Ruden,
McClosky, Smith, Schuster and Russell, P.A., representing FLO TV Inc. with respect to the
subject property, be and the same is hereby approved for a variance from the front and side yard
setback requirements of the Land Development Code, Subsection 4.02.01, Table 2.1, to allow a
variance of 55.7 feet from the 75-foot front yard setback requirements, thus permitting a setback
of 19.3 feet and variances of 22.3 feet and 22.6 feet from the 30-foot side yard setback
requirements, thus permitting setbacks of 7.7 feet and 7.4 feet in the Estates (E) zoning district
wherein said property is located.
BE IT FURTHER RESOLVED that this Resolution relating to Petition Number V A-PL-
2009-37 be recorded in the minutes of this Board.

County for a variance from the requirements of the zoning regulations as they apply to the
following described property:
5860 Crews Road, in Section 8, Township 50 South, Range 26 East,
in Collier County, Florida
It is our intent to ask the County to allow the following on the aforementioned property:
A Variance of 67 feet and 4 inches from the 75-foot front yard setback requirement; and a
Variance of 10 feet and 8 inches from the 30-foot side yard setback requirement of LDC
subsection 4.02.01, Table 2.1, Table of Minimum Yard Requirements for Base Zoning Districts,
to permit 7-foot, 8-inch and 19-foot, 4-inch setbacks, respectively, for the guy lines of a
communications tower in excess of75 feet in the Estates (E) Zoning District. As noted, the 4.77-
acre subject property is located at 5860 Crews Road and is a companion item to a Conditional
Use (CU-2008-AR-14085) to allow an existing communications tower on the property.

Dear Mr. Moss,
I am currently out of state and will be unable to attend the public hearing, Oct. 15,2009,
in reference to petition CU-2008-AR-14085. I am strongly opposed to allowing a tower
built within 500 feet of my property. I own a 5 acre parcel on the south side of Crews
Road. My family and I have owned this property since approximately 1968. With the
extension of Santa Barbara, I finally have a good possibility to sell this property. Who
would want my 5 acres with a huge tower across the street?
In regard to petition: VA - P12009- 37, I ask that the variances be denied. Laws are put in
place to protect the general population from being taken advantage of. When I
remodeled my home on Tarpon Road, the contractor made a 6" mistake. I was required to
take down the east wall for 6" and another home owner was required to do the same for
8'. How can you even think of considering this size variance? I would hope COWlty
property owners would have the same protection Wlder our laws.
Please add this correspondence to the public hearing October 15, 2009 of the Collier
COWlty Planning Commission of Collier COWlty, Florida at 8:30 am. Would you also
forward my letter to the Honorable County Commissioners of Collier County.
