Agenda 01/26/2010 Item #16A2Agenda Item No. 16A2 January 26, 2010 Page 1 of 6 EXECUTIVE SUMMARY Recommendation to approve final acceptance of the water utility facility for Germain BMW Dealership OBJECTIVE: The Board of County Commissioners, Ex- Officio the Governing Board of the Collier County Water -Sewer District, to accept final and unconditional conveyance of the water facility. 1) The Developer of Germain BMW Dealership has constructed the water facility within dedicated easements to serve this development. See attached location map. 2) Preliminary acceptance of this water utility facility was approved by the Engineering and Environmental Services Department staff on June 26, 2007. At that time, the value of this utility facility (assets) was $5,505.51 (see attachment[s]). Final Acceptance is in accordance with Ordinance 2004 -31, as amended. 3) Staff has recorded all preliminary acceptance documents in the public records of Collier County, which have been reviewed and approved by the County Attorney's office as to form and legal sufficiency. 4) The water facility has been operated and maintained by the Collier County Water - Sewer District during, not less than, the required one (1) year warranty period. 5) A final inspection to discover defects in materials and workmanship has been conducted by the Engineering and Environmental Services Department staff and this facility has been found to be satisfactory and acceptable. 6) The water utility infrastructure connected beyond the master meter is owned and maintained by the owner. 7) The PUD Monitoring staff has reviewed this request in relation to possible issues raised by the applicable Property Owners Association (POA). Staff is unaware of any issues that would serve to negate the recommendation to release the applicable security. FISCAL IMPACT: Approval of this Executive Summary will have no specific financial impact. However, approval of this Executive Summary will result in the Collier County Water -Sewer District receiving unconditional title to the utility facility, which at the time of preliminary acceptance, had a total (undepreciated) value of $5,505.51. GROWTH MANAGEMENT IMPACT: Approval of this Executive Summary will have no growth management impact. Agenda Item No. 16A2 January 26, 2010 Page 2 of 6 LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney's Office and is legally sufficient. - JBW RECOMMENDATION: That the Board of County Commissioners, Ex- Officio the Governing Board of the Collier County Water -Sewer District, accept final and unconditional conveyance of the water facility for Germain BMW Dealership, and authorize the County Manager, or his designee, to release any Utilities Performance Security (UPS) to the Project Engineer or the Developer's designated agent.
