EXECUTIVE SUMMARY
VA-PL2009-1162, Elke Remmlinger-Behnke, as Trustee of the Bernd Schoenherr 1998
Irrevocable Trust, represented by Karen Bishop of PMS, Inc. of Naples, is requesting two
after-the-fact variances for an existing screened pool enclosure that is an accessory
structure to a single-family dwelling. The first request is for a variance of 2.5 feet from the
required rear yard setback of 15 feet as provided for in Section 8.16 of the Kings Lake
Planned Unit Development (Ordinance Number: 82-52) to allow the existing accessory
structure to remain at 12.5 feet from the rear property line. The second request is for a
variance of 2.41 feet from the required side yard setback of 7.5 feet as provided for in
Section 8.16 of the Kings Lake Planned Unit Development (Ordinance Number: 82-52) to
allow the existing accessory structure to remain at 5.09 feet from the side property line.
The subject .26" acre property is located at 2454 King's Lake Boulevard, in the King's
Lake Unit 3, in Plat Book 13, Pages 33 and 34 of the Public Records of Collier County, in
Section 7, Township 50 South, Range 26 East, Collier County, Florida.
OBJECTIVE:
~
To have the Board of Zoning and Appeals (BZA) review staff's findings and recommendations
along with the recommendations of the Collier County Planning Commission (CCPC) regarding
the above referenced petition and render a decision regarding the petition; and ensure the project
is in hannony with all the applicable codes and regulations in order to ensure that the
community's interests are maintained.
CONSIDERATIONS:
In 1983, the .26" acre property was developed with a single-family home. In 1991, a previous
owner had applied for a pool and screen enclosure permit. In 1993, the pool and screen
enclosure were constructed and received a certificate of occupancy from Collier County. In
1994, the present owner purchased the property. In 2005, the screen enclosure was damaged by a
hurricane. In 2007, the owner attempted to replace the damaged screen enclosure in the same
location and was infomled by Collier County permitting staff that the screen enclosure is
encroaching into the required side and rear yard setbacks. Building Department records show
that the owner hired a different contractor from the original contractor who had applied for the
building permit. The new contractor installed the encroaching screen enclosure without
obtaining the required building permits. An anonymous complaint was filed with Code
Enforcement; the case number is 2007060321. (Please see attached Code Case Detail Report and
Building Permit Listing Report at the end of the Staff Report.)
The minimum rear yard setback as provided for in Section 5.4.4.C. of the Kings Lake PUD is 15
feet. The minimum side yard setback as provided for in Section 5.4.4.B. of the Kings Lake PUD
is 7.5 feet. This variance request seeks two (2) after-the-fact variances as follows:

1. A 2.5-foot reduction from a required rear yard setback of 15 feet to allow a 12.5-foot rear
yard setback.
2. A 2.4I-foot reduction from a required side yard setback of 7.5 feet to allow a 5.09-foot
side yard setback.
The site plan entitled "Specific Purpose Survey" dated September 29, 2009, and prepared by
BBLS Surveyors & Mappers Inc., illustrates the location of the screened concrete pool deck
along with the existing 12.50 and 5.09 setbacks. (See the Site Plan in the Staff Report.)
There have been no other variances granted within the King's Lake PUD. As previously stated,
this screen enclosure along with the encroachment has been in existence since 1993. To date, no
known complaints have been received from any neighboring properties.
FISCAL IMPACT:
The Variance request by and of itself will have no fiscal impact on Collier County.
GROWTH MANAGEMENT PLAN (GMP) IMPACT:
The subject property is located in the Urban Mixed Use Residential land use classification on the
County's Future Land Use Map (FLUM). This land use category is designed to accommodate a
variety of residential uses including single-family, multi-family, duplex, mobile home and
mixed-use projects. As previously noted, the subject petition seeks a variance for a single-family
home that is located within a single-family subdivision, which is an authorized use in this land
use designation, therefore, the single-family home use is consistent with the FLUM. The Growth
Management Plan (GMP) does not address individual variance requests; the Plan deals with the
larger issue of the actual use.
COLLIER COUNTY PLANNING COMMISSION (CCPe) RECOMMENDATION:
The CCPC heard petition V A-PL2009-1l62 on November ] 9, 2009, and by a vote of 6 to 3
recommended to forward this petition to the Board of Zoning Appeals (BZA) with a
recommendation of approval.
Three of the Commissioners recommended denial of the variance for the following reasons:

There are no special conditions and circumstances related to the land and structure
involved.
A literal interpretation of the Code will not result in hardship to the property owner.
The property owner could afford to rebuild the screen cage enclosure correctly.
- The variance is not the minimum variance.
- Granting the variance would be granting special privilege to the property owner.

- Granting the variance is not in harmony with the LDC, as it is not a legally permitted
structure.
- One Commissioner stated that they knew this was a setback issue. "1 cannot reward
them for bullying ahead because it punishes the people who do it right."
Two of the Commissioners who recommended approval expressed the following:
- 1 do not see this as a problem.....These things happen. It is not the fault of the
homeowner that it (the screen enclosure) carne down. It is a huge expense to replace
these enclosures...... they are replacing something that is already in existence. This
(screen enclosure) is not a big issue."
- This house and pool have been here since 1993. No neighbors are complaining. The
pool cage is not harming anybody. The pool cage carne down as a result or an act of
God, we should not be penalizing the property owner.
The CCPC also commented on the status of the unlicensed contractor. Staff has researched the
issue, and has found that in 2007 Contractor Licensing investigated the unlicensed contractor
who performed the unpermitted work at the subject site. The unlicensed contractor was
subsequently penalized and was issued 5 citations totaling $ 1,500.
LEGAL CONSIDERATIONS:
This Executive Summary has been reviewed for legal sufficiency and is legally sufficient for
Board action. (STW)

Staff recommends that the Board of Zoning Appeals approve the request for V A-PL2009-1162.

PURPOSEffiESCRIPTION OF PROJECT:
In 1983, the .26clc acre property was developed with a single family home. In 1991, a previous
owner had applied for a pool and screen enclosure pem1it. In 1993, the pool and screen
enclosure were constructed and received a certificate of occupancy from Collier County. In
1994, the present owner purchased the property. In 2005, the screen enclosure was damaged by
a hurricane. In 2007, the owner attempted to replace the damaged screen enclosure in the same
location and was informed by Collier County pennitting staff that the scr~en enclosure is
encroaching into the required side and rear yard setbacks. Building Department Records show
that the owner hired a different contractor from the original contractor who had applied for the
building pennit. The new contractor installed the encroaching screen enclosure without
obtaining the required building pennits. An anonymous complaint was filed with Code
Enforcement; the case number is 2007060321. (Please see attached Code Case Detail Report
and Building Permit Listing Report at the end of this Staff Report.)
The minimum rear yard setback as provided for in Section 5.4.4.C. of the Kings Lake PUD is 15
feet. The minimum side yard setback as provided for in Section 5.4.4.B. of the Kings Lake PUD
is 7.5 feet. This variance request seeks two (2) after-the-fact variances as follows:
1. A 2.5-foot reduction from a required rear yard setback of 15 feet to allow a 12.5-foot
rear yard setback.
2. A 2.4 I-foot reduction from a required side yard setback of 7.5 feet to allow a 5.09-foot
side yard setback.
The site plan entitled "Specific Purpose Survey" dated September 29, 2009, and prepared by
BBLS Surveyors & Mappers Inc., illustrates the location of the screened concrete pool deck
along with the existing] 2.50 and 5.09 setbacks. (See the Site Plan on the previous page.)
There have been no other variances granted within the King's Lake PUD. As previously stated,
this screen enclosure along with the encroachment has been in existence since 1993. To date, no
known complaints have been received from any neighboring properties.

AERIAL
GROWTH MANAGEMENT PLAN (GMP) CONSISTENCY:
The subject property is located in the Urban Mixed Use Residential land use classification on the
County's Future Land Use Map (FLUM). This land use category is designed to accommodate a
variety of residential uses including single family, multi-family, duplex, mobile home and
mixed-use projects. As previously noted, the subject petition seeks a variance for a single family
home that is located within a single-family subdivision, which is an authorized use in this land
usc designation, therefore, the single family home use is consistent with the FLUM. The Orov,,1h
Management Plan (OMP) does not address individual variance requests; the Plan deals with the
larger issue of the actual use.
ANALYSIS:
-
Section 9.04.01 of the Land Development Code gives the Board of Zoning Appeals (BZA) the
authority to grant Variances. The Planning Commission is advisory to the BZA and utilizes the
provisions of Section 9.04.03 A. through H. (in bold font below), as general guidelines to assist

in making their recommendation of approval or denial. Staff has analyzed this petition relative
to these provisions and offers the following responses:
a. Are there special conditions and circumstances existing, which are peculiar to the
location, size and characteristics of the land, structure or building involved?
Yes. The subject property is slightly pie shaped with the narrowest piece located to the
rear of the property where the existing screened pool enclosure is located.
b.
Are there special conditions and circumstances, which do not result from the action
of the applicant such as pre-existing conditions relative to the property, which are th"
subject of the Variance request?

Yes. The current homeowner purchased the home in ]994, The original home has a
swimming pool and screen enclosure which was reviewed and permitted in ] 991. The
certificate of occupancy was granted in 1993 by Collier County. When a hurricane blew
the screen enclosure over in 2005, the homeowner had expectations that it could be
replaced in the same location,
c. Will a literal interpretation of the provisions of this zoning code work unnecessary
and undue hardship on the applicant or create practical difficulties for the applicant?
Yes. A portion of the screen enclosure would have to be removed if a literal interpretation
of the zoning code were applied.
d. Will the Variance, if granted, be the minimum Variance tbat will make possible the
reasonable use of the land, building or structure and which promote standards of
hcalth, safety and welfare?
No. The Variance proposed would not be the minimum Variance to allow reasonable use
of the existing screen enclosure. The screen enclosure has existed on the site for at least 12
years without complaint or issue. Approval of this Variance would not have a negative
impact on standards of health. safety and welfare.

e. Will granting the Variance confer on the applicant any special privilege that is denied
by these zoning regulations to other lands, buildings, or structures in the same zoning
district?
Yes. A Variance by definition confers some dimensional relief from the zoning regulations
specific to a site. Howcver. no similar Variances have been granted in this immediate
nei gh borhood.
f. Will granting the Variance be in harmony with the general intent and purpose of this
Land Development Code, and not be injurious to the neighborhood, or otherwise
detrimental to the public welfare?
Yes. As previously stated, the encroachment by the existing screen enclosure has been in
existence from 1993 until a hurricane blew the screen enclosure over in 2005, There have

been no complaints from the neighbors regarding the 14 year location of the screen
enclosure.
g. Are there natural conditions or physically induced conditions that ameliorate the
goals and objectives of the regulation such as natural preserves, lakes, golf c.ou."ses,
etc.?
Yes. There is lake located to the rear of the property. The existing location of the screen
enclosure within 2.5 feet of the rear setback and 2.41 feet of the side setback does not
obscure the lake view of the other neighboring properties. In addition, there is a dense
landscape buffer between the screen enclosure and nearest neighbor, mitigating for the
encroachment.
h. Will granting the Variance be consistent with the Growth Management Plan?
Approval of this variance will not affect or change the requirements of the Growth
Management Plan.
ENVIRONMENTAL ADVISORY COUNCIL (EAC) RECOMMENDATION:
The EAC does not normally hear Variance petitions. Since the subject variance doesn't impact
any preserve area, the EAC did not hear this petition.

standards. incuding setbacks. The agplicont purchased 0 single family home with 0 pool and enclosure in
1994. The subject site of this varignce ~etition. located or 2454 Kings lake Blvd [folio Number
530036800051. aiso known as Kings Lake Unit 3 Block R. Lot 26. was develQlled with 0 single-fQmily
home in 1983. A pool and screen enclosure was permitted and constructed in '991 by the previous owner.
The screen enclosure wos d,amaged by a Hvrricone in 2005 and when the j;)resent owner tried to get it
!!tl2laced in 2008. Collier County informed them that the existing pool deck and screen enclosure was
encroaching over the allowed setback line. The minimum side yard setback allowed for the Kings Lake
~~- PUD is 7.5 feet which the existing lonoi encroaches by o.QProximately 2.5 feet. The minimum rear yord.
;;etbock is 15 feet which the existing lanai encroaches by agproximotely 5 fe.et. This variance request
seeks to legitimize the legally constructed non-conformities and permit 1y.to minor encroachments as follows:

as pre-existing conditions relative to the property which is the subject of the variance request.

ggproved in 1991. The current owner was unaware of these conditions and assumed that c-permit to
~ICJce the scr~en would be legal based on historical facts. These are soedel conditions for which the
current (llQperty owner should not be penalized.
3. Will a literal interpretation of the provisions of this zoning code work unnecessary and undue
hardship on the applicant or create practical difficulties on the applicant.
DeniQI of this variance request would create an unnecessary hardshjp on the current own~r becaus~
they would be reguired to undertake a costly removal of the area of encroachment which would.
substantially reduce the area of the pool and deck which was 0 part of their originolj2urchase resultina in
o loss of valve to their home. The necessity for strict application of the reor setobck moreover is
ameliorated iry large part by the fact thl;]f this RIQperty enjoys a relationship to a lake in the rear and thus
does not adversely impact another residence by 0 diminished rear yar~. By this account 0 litero\
inter.,pretion will indeed work unnecesspry and undue hardship on the oPJilicant.
4. Will the variance, if granted, be the minimum variance that will make possible the reasonable use of
the land, building or structure and which promote standards of health, safety or welfare.

provide documentation to the planning services department indicating that property
owners within 150 feet of the subject site have been advised of the extent and
nature of the variance or parking exemption requested within 30 days of receipt of a
letter indicating that the application is sufficient."
Applicant must submit a Property Owner Advisory Letter certifying that the property
owners within 150 feet of the subject site were notified. Letter must have property
owners list attached.
Property owners list must be submitted after initial staff review and comment on the
application and before the Public Hearing is scheduled with the Collier County
Planning Commission.

A RESOLUTION OF THE BOARD OF ZONING APPEALS OF
COLLIER COUNTY RELATING TO PETITION NUMBER VA-
PL2009-1162, FOR TWO AFTER-THE-FACT VARIANCES:
FROM THE REQUIRED 15-FOOT REAR SETBACK AND
FROM THE 7,5-FOOT SIDE YARD SETBACK FOR A
SCREEN ENCLOSURE OVER AN EXISTING POOL AND
PATIO AT 2454 KING'S LAKE BLVD., WITHIN THE KINGS
LAKE SUBDIVISION POO IN SECTION 7, TOWNSHIP 50
SOUTH, RANGE 26 EAST, COLLIER COUNTY, FLORIDA
WHEREAS, the Legislature of the State of Florida in Chapter 125, Florida Statutes, has
conferred on all counties in Florida the power to establish, coordinate and enforce zoning and such
business regulations as are necessary for the protection of the public; and
WHEREAS, the County pursuant thereto has adopted a Land Development Code (LDC)
(Ordinance No. 2004-41, as amended) which establishes regulations for the zoning of particular
geographic divisions of tho County, among which is the granting of variances; and
WHEREAS, the Board of Zoning Appeals, being the duly elected constituted Board of the
area hereby affected, has held a public hearing after notice as in said regulations made and provided,
and has considered the advisability of a variance from the required IS-foot rear setback to a 12.5-foot
setback for a screen enclosure resulting in a rear setback variance of 2.5 feet for an existing pool and
patio and a variance from the required 7.5-foot side yard setback to a 5.09 foot setback resulting in a
side yard setback variance of 2.4 I feet, in the Kings Lake Subdivision PUD (Ordinance No. 82-52) at
2454 King's Lake Blvd., also referred to as Lot 26, Block R, Kings Lake Unit No.3, Scction 7,
Township 50 South, Range 26 East, Collier County, Florida, and has found as a matter of fact that
satisfactory provision and arrangement have been madc concerning all applicable matters required by
said regulations and in accordancc with Section 9.04.00 of the Zoning Regulations of said Land
Development Code for the unincorporated area of Collier County; and
WHEREAS, all interested parties have been given opportunity to be heard by this Board in
public meeting assembled, and the Board having considered all matters presented.
