EXECUTIVE SUMMARY
Recommendation to approve a Utility Easement from Collier County to the Collier County
Water -Sewer District for Reclaimed Water pipeline and associated infrastructure
including electrical panel, meter assembly, electrical conduit, telemetry tower and for
access on, over and across a portion of Vineyards Park property located off Vanderbilt
Beach Road along Vineyards Boulevard in Naples, Florida at an estimated cost not to
exceed $40, Project Number 70062.
OBJECTIVE: That the Board of County Commissioners of Collier County, Florida (Board)
approve and accept the attached Utility Easement from Collier County to the Collier County
Water -Sewer District ( CCWSD). The public purpose is to provide necessary legal rights for
access, maintenance, and asset management of CCWSD reclaimed water infrastructure; and any
construction and maintenance of a reclaimed water valve and meter site servicing Vineyards
Park located off Vanderbilt Beach Road along Vineyards Boulevard in Naples, Florida.
CONSIDERATIONS: Approval of this Easement will further the process of providing legal
rights to the CCWSD for access and maintenance, asset management inventory, and all future
maintenance and upgrades related to reclaimed water infrastructure. The project involves the
identification and maintenance responsibility of the reclaimed water infrastructure including, but
not limited to electrical panels, meter assemblies, piping, electrical conduit, telemetry towers,
and any future upgrades to the reclaimed water infrastructure that will provide best value
technology and improved performance and service for reclaimed water delivery.
This pro is consistent with the 2008 Wastewater Master Plan update adopted by the Board on
June 24 , 2008, under Agenda Item 10G. This project is referenced in the Wastewater Master
Plan, Table 8 -1, Page 7 of 7, Line 151. Project Number 74033 cited on Line 151 has been
replaced by Project Number 70062.
The attached Utility Easement has been reviewed and approved by the Parks and Recreation
Department/Public Services Division, Public Utilities Planning and Project Management
Department/Public Utilities Division, and the County Attorney's Office.
A location map of the proposed Utility Easement area is attached for ease of reference.
FISCAL IMPACT: The total cost will not exceed $40 for the recording of the document.
Funds in the amount of $40 are available in the FY 12 budget for this action in Project 70062.
The FY 12 capital budget was approved by the Board on September 22, 2011. Source of funds is
Wastewater User Fees, Fund 414.
GROWTH MANAGEMENT IMPACT: This project is consistent with, and furthers the goals,
objectives and policies of, the Collier County Growth Management Plan.

RECOMMENDATION:
1. That the Board of County Commissioners approve and authorize the Chairman to
execute the Utility Easement.
2. That the Board of County Commissioners of Collier County, Florida, as the
Governing Body of Collier County and as Ex- Officio the Governing Board of the Collier County
Water -Sewer District accept the Utility Easement and direct the County Manager or his designee
to proceed to acquire the Utility Easement and to follow all appropriate closing procedures, and
to record the Utility Easement in the Public Records of Collier County, Florida.

THIS EASEMENT, made and entered into this day of 2011, by 11 COLLIER COUNTY, a Political Subdivision of the State of Florida, whose mailing address is
3335 Tamiami Trail East, Suite 101, Naples, Florida, 34112 -5356, (hereinafter referred to as
"Grantor"), to the BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY,
FLORIDA, AS THE GOVERNING BODY OF COLLIER COUNTY AND AS EX- OFFICIO THE
GOVERNING BOARD OF THE COLLIER COUNTY WATER -SEWER DISTRICT, its
successors and assigns, whose mailing address is 3335 Tamiami Trail East, Suite 101, Naples,
Florida 34112, (hereinafter referred to as "Grantee ").
(Wherever used herein the terms "Grantor" and "Grantee" include all the parties to this instrument

Grantor, for and in consideration of TEN DOLLARS ($10.00) and other valuable
consideration paid by the Grantee, the receipt and sufficiency of which is hereby acknowledged,
hereby conveys, grants, bargains and sells unto the Grantee, its successors and assigns, a
perpetual, non - exclusive easement for reclaimed water utility facilities and access purposes,
over, under, upon, and across the following described lands located in Collier County, Florida,
to wit:
See attached Exhibit "A" which is
incorporated herein by reference.
Subject to easements, restrictions, and reservations of record.
THIS IS NOT HOMESTEAD PROPERTY.
TO HAVE AND TO HOLD the same unto the Grantee together with the right to enter
upon said land, excavate, and place or remove materials, including, but not limited to reclaimed
water lines and pipes, electrical panels, telemetry towers, and other equipment or
improvements appurtenant thereto or thereunder for the purpose of constructing, operating,
and maintaining reclaimed water utility facilities thereon. The easement granted herein shall
constitute easements running with the land and shall burden the lands described herein above.
IN WITNESS WHEREOF, the Grantor has caused these presents to be executed the
date and year first above written.

described as follows;
Commencing at the Northwest corner of said Tract S-4;
