EXECUTIVE SUMMARY
Recommendation to approve and authorize the Chairman to execute a Partial
Release )of Conservation Easement to the South Florida Water Management
District in :connection with the Vanderbilt Beach Restroom & Concession Project
OBJECTIVE: To approve and authorize the Chairman to execute a partial release of
conservation easement to the South Florida Water Management District in connection
with the Vanderbilt Beach Restroom & Concession Project.
CQNSIDERATIONS: On September -27, 2011, the BCC approved Variance". Petition
(CCSLPV PL20100001812) requesting a variance from the Coastal Construction
Setback Line (CCSL) and preserve to allow for the construction of a new restroom and
concession facility complete with ADA ramp access, and concrete piling foundation,
seaward of the Coastal Construction Setback Line (CCSL) to, replace the existing
restroom structure, all of which are located on or near the existing Vanderbilt. Beach
Restroom with a street address of 100 Vanderbilt Beach Road, located in Section 32,
Township 48 South, Range 25 East, Collier County, Florida.
Included also into the scope of this project is a requirement to secure 0.02 Acre parcel
of existing preserve land from the South Florida Water Management District. To
facilitate this,process the design consultant of record (Coastal Engineering Consultants,
n Inc.) prepared the required "Partial Release of Conservation Easement" for conceptual
review and approval by the governing regulatory agency (SFWMD) and the BCC for
final execution. The purpose of this requirement is to accommodate provisions to
provide offske road access conditions for a future tractor storage area on the west side
of the existing Vanderbilt Beach Parking Garage. For the past three years staff has
been allocating an, annual budgetary expenditure in the amount of $6,000.00 per year
for property lease fees to accommodate current tractor storage parking conditions. The
future tractor storage area will eliminate the current offsite parking arrangements and
provide direct onsite parking conditions; in addition this will also provide an annual
savings, to the county in the amount of $6,900.00 in current property lease fees.
Therefore, a request for a Partial Release of a Conservation :Easement from the South
Florida Water Management District is required to support the future development of this
project. Whereas, staff, the design consultant of record (Coastal Engineering
Consultants, Inc.), and the County Attorney's Office has reviewed the attached Partial
Release of Conservation Easement and hereby recommend that the Chairman approve
and execute.the required documents.
FISCAL IMPACT: This project is currently budgeted in Beach Park Facilities Category
"A" Tourist Development Tax Fund 183 Project Number 90046.
GROWTH MANAGEMENT IMPACT: This project is consistent with the Growth
Management Plan Objective 1.3, Policy 1.3.2, to ensure that access to waterways
remains available to the general public.

PARTIAL RELEASE OF CONSERVATION EASEMENT
This Partial Release of Conservation Easement ( "Partial Release ") is made this _ day
of , 20_ by and between the SOUTH FLORIDA WATER
MANAGEMENT DISTRICT ( "District') having an address of 3301 Gun Club Road, West
Palm Beach, Florida 33406 and a mailing address of Post Office Box 24680, West Palm Beach,
Florida 33416 -4680 and COLLIER COUNTY, a political subdivision of the State of Florida
( "Owner ") having an address c/o Parks and Recreation, 15000 Livingston Road, Naples, Fl.
34109.
WITNESSETH:
WHEREAS, COLLIER COUNTY granted in favor of the District that certain Deed of
Conservation Easement dated JULY 26, 2005 and recorded in Official Record Book 3857 at
Page 1013 of the Public Records of COLLIER County, Florida (hereinafter referred to as the
"Conservation Easement") encumbering the real property described on Exhibit "A" attached
hereto and made a part hereof (hereinafter referred to as the "Original Premises "); and
WHEREAS, the District has been requested to release a portion of the Conservation
Easement with respect to only that portion of the Original Premises described on Exhibit `B"
attached hereto and made a part hereof (hereinafter referred to as the "Release Parcel "); and
WHEREAS, the District is amenable to amending the conservation easement to release a
portion of the Conservation Easement only with respect to the Release Parcel.
NOW, THEREFORE, for good and valuable consideration, the adequacy and receipt of
which is hereby acknowledged, the District hereby releases, discharges, and terminates the
Conservation Easement over and upon the Release Parcel, without impairing the operation and
effect of the Conservation Easement as to the remainder of the Original Premises which are not
contained within the Release Parcel, (the original Premises less and except the Release Parcel is
hereinafter referred to as the "Remainder Premises "). The Conservation Easement shall remain
in full force and effect with respect to the Remainder Premises and shall remain unaffected by
this Partial Release of Conservation Easement. All references in the Conservation Easement to
"Property" shall hereafter mean and refer to the Remainder Premises.
IN WITNESS WHEREOF, the South Florida Water Management District has caused
this Partial Release of Conservation Easement to be executed in its name and its official seal
affixed hereto by , Chairperson, and attested by its District
