EXECUTIVE SUMMARY
Recommendation to accept Code Enforcement Department's proposed process
for settlement agreements for Immokalee mobile home parks.
OBJECTIVE: That the Board of County Commissioners (Board) accept the process for
settlement agreements for Immokalee Mobile Home Parks, as described herein.
CONSIDERATIONS: The process for settlement agreements for Immokalee Mobile
Home Parks, that are consistent with land use designations contained within the Collier
County Growth Management Plan and Zoning map, is as follows:
• The property owner submits a Site Improvement Plan (SIP) application. The
SIP may be a previously. approved SIP that was not implemented and has
subsequently expired, or a new SIP.
• The SIP application is reviewed according to current base zoning district
standards and fee schedule.
• If the property owner of a non - conforming mobile home park cannot meet all
of the development standards of the base zoning district, a property owner
may present a settlement agreement for BCC approval that identifies
deviations from the base zoning district, but at a minimum meets the
standards of the non- conforming mobile home park overlay. An executive
summary, in the form of a settlement agreement for BCC approval, will be
prepared by Code Enforcement Department, on behalf of the property owner.
The executive summary will outline the deviations identified by the Zoning
Department. If a SIP expired within twelve months of the new SIP application
submittal, a request for refund of the SIP fees (with the exception of the fire
review fee), will also be included in the settlement agreement.
• This process shall not be available to those mobile home parks that are
inconsistent with land use designations contained within the Collier County
Growth Management Plan and Zoning map.
The base fees, as outlined in the Collier County Growth Management Division Fee
Schedule fora typical SIP application. are as follows:
• $1,000.00 base application fee
• Engineering Review fees (3% estimated construction cost fee)
• $150.00 fire review fee
FISCAL IMPACT: There is no fiscal impact associated with this executive summary.
GROWTH MANMMENT MIIPACT: There is no growth management impact
associated with this Executive Summary.
