Recommendation to approve a Settlement Agreement and Release with CH2MHILL ( "CH2 ") to
settle all outstanding claims related to consulting services rendered ender Contract No. 01 -3195, in
connection with the construction of road and utility improvements to Vanderbilt Beach Road, and
for expert services provided in the defense of the County in KER Enterprises, Inc. d/b /a Armadillo
Underground v. APAC- Southeast, Inc. v. Collier County, Case No. 08- 3496 -CA ("APAC ") and to.
authorize payment.
OBJECTIVE: Recommendation that the Board approve a Settlement Agreement and Release
with CH2 to settle all outstanding claims pertaining to consulting services provided by CH2
under Contract No. 01 -3195 (the "Vanderbilt Beach Road Project's and for expert services
provided in the defense of the County in the litigation and successful mediation of the APAC
case.
CONSIDERATIONS: On May 8, 2001, the County entered into Contract No. 01 -3195 with
CH2 to provide professional Design and Permitting services on the Vanderbilt Beach Road
(Airport- Pulling Road to Collier Blvd.) road - widening project (the "Projecn. The prompt
completion of the Project was impeded by numerous unforeseeable underground conditions as
well as performance issues with the general contractor (APAC- Southeast) and its subcontractor,
Armadillo Underground. As a result, the Project did not reach final completion until March 17,
2008.
During the course of the Project, CH2 submitted multiple change orders to: (1) modify the
original design to meet new County access management standards, (2) address traffic safety
issues due to development changes along the corridor, (3) update "As- Built" conditions based
upon the rapid growth and development that occurred after the original design, (4) assist with
SFWMD certification of the Project for two permits based on "current" criteria, and (5) provide
the contractor means and methods with respect to underground utility construction to assist in
expediting construction and reducing costs. The last two change orders CH2 submitted for
reimbursement (identified as numbers 6 and 7), which have not been reimbursed, total $345,099.
In part, the County disputes CH2's request for reimbursement under those change orders.
Following the completion of the Project, Armadillo Underground sued APAC- Southeast for
being terminated from the Project and, in turn, APAC- Southeast sued the County as a third -party
defendant. After the Board approved a settlement agreement in the APAC case on June 14, 2011
(Agenda Item 1 IA), CH2 submitted an invoice seeking reimbursement for services it provided as
an expert throughout the litigation and during the mediation resulting in settlement, in the
amount of $146,661. Staff has reviewed the invoice and the corresponding hours and rates,
which is consistent with the approved general engineering services contract, and concurs that it
accurately reflects the time and resources spent by CH2 participating in this complex litigation.
There was no written retainer agreement for these services, however.
Although the parties dispute whether there was appropriate documentation and approval for these
services, there is no dispute that CH2 performed significant services which benefitted the

County. In the interest of avoiding litigation, with its attendant costs and uncertainties, staff is
recommending that the Board approve a Settlement Agreement and Release with CH2, to settle
all outstanding claims pertaining to the consulting services it provided under Contract No. 01-
3195 and those expert services provided in assisting the County's defense during the APAC
litigation and successful mediation, for the reduced, compromised amount of $146,661, as set
forth in the attached Settlement Agreement.
FISCAL IMPACT: Funds in the amount of $ 1.46,661.00 are available in gas taxes.
LEGAL CONSIDERATIONS: CH2 is presenting combined claims totaling $491,760, which
includes invoices for engineering services performed on the Project and expert witness services
provided to support the County in the APAC litigation. CH2 is agreeable to release all claims
against the County arising out of the Project and the APAC litigation for the compromised sum
of $146,661. It is the opinion of the County Attorney that if this matter was in litigation (which it
seems likely headed for), that this settlement amount would be fair and reasonable. Accordingly,
rather than insisting that CH2 bring suit against the County, the County Attorney believes it
prudent to dispose of this matter now, thereby maintaining an amicable working relationship
with a valued service provider. This item has been reviewed and approved by the County
Attorney, is legally sufficient for Board action, and requires majority vote for approval. -JAK
GROWTH MANAGEMENT IMPACT: None.
RECOMMENDATION: That the Board approve a Settlement Agreement and Release with
n CH2, LLC, in the amount of $146,661.00, as a compromise of disputed claims comprising
engineering consulting services under Contract No. 01 -3195 and expert witness services
provided in the APAC litigation totaling $491,760. Approval of this item and authorization for
the Board's Chairman to sign the Settlement Agreement and Release will extinguish all claims
asserted by CH2 arising from the Project and the APAC litigation.

SETTLEMENT AGREEMENT AND RELEASE BETWEEN
COLLIER COUNTY AND CH2M111ILL, LLC
THIS SETTLEMENT AGREEMENT AND RELEASE (hereinafter referred to as the
"Agreement ") is entered into and made as of September , 2011, by and between Collier
County (hereinafter referred to as "the County "), a political subdivision of the State of Florida,
and CH2MHILL, LLC (hereinafter referred to as "CH2 ").
WITNESSETH:
WHEREAS, on May 8, 2001, the County entered into Contract No. 01 -3195 with CH2
to provide professional Design and Permitting services on the Vanderbilt Beach Road (Airport-
Pulling Road to Collier Blvd.) road - widening project (the "Project "). The prompt completion of
the Project was impeded by numerous unforeseeable underground conditions as well as
performance issues with the general contractor (APAC- Southeast) and its subcontractor,
Armadillo Underground. As a result, the Project did not reach final completion until March 17,

WHEREAS, in the interest of avoiding litigation, with its attendant costs and
uncertainties, the parties to wish settle all outstanding claims pertaining to the consulting services
it provided under Contract No. 01 -3195 and those expert services provided in assisting the
County's defense during the APAC litigation and successful mediation, by County paying the
reduced, compromised amount of $146,661, in exchange for it being released with respect to any
claim that CH2 has made, or could make, arising from the matters set forth above.
NOW, THEREFORE, in consideration of the foregoing Recitals, and other good and
valuable consideration, the receipt and sufficiency of which is hereby mutually acknowledged,
the Parties agree as follows:
1. County shall pay CH2, within 30 days from the date first set forth above, the sum
n of $146,661.
2. In consideration of this sum, CH2, on behalf of itself, its officers, employees,
shareholders, directors, agents, representatives, members, affiliates and subsidiaries, and the
successors and assigns of each of them, hereby releases County from any claims and causes of
action which were or which could have been asserted related to Contract No.: 01 -3195 and any
services performed with respect to Case No. 08- 3496 -CA, pending in the 201h Judicial Circuit of
Florida, that CH2 may have had, may now have, or hereafter may have, concerning or arising out
of any facts, allegations or circumstances, from the beginning of time to the date of this
Agreement.
3. Each party represents to the other party, as a material condition for their entering
into this Agreement, that except for those matters set forth in the recitals, neither party is aware
of any claim or potential cause of action it may presently have against the other.
4. Each party acknowledges and agrees that this Agreement is the product of mutual
negotiation and no doubtful or ambiguous language or provision in this Agreement is to be
construed against any party based upon a claim that the party drafted the ambiguous provision or
language or that the party was intended to be benefited by the ambiguous provision or language.

5. This Agreement is the entire understanding between the parties with respect to the
matters set forth herein, superseding any and all prior discussions, written or oral. This
Agreement may be amended only by a written instrument specifically referring to this
Agreement and executed with the same formalities as this Agreement. This Agreement shall be
governed by the laws of the State of Florida. The parties agree that any dispute which arises
concerning the either the enforcement or the terms of this Agreement shall be brought to any
State Court having competent jurisdiction located within Collier County.

Consulting Engineering Services Agreement
Additional Design Services
Project No. 63051
The CONSULTANT has been requested and retained to provide additional engineering services
associated with final completion of project construction and certification of the project from
South Florida Water Management District. These additional services are based on various
design revisions requested by the County Transportation Division to address the needs of the
project throughout construction and following in order to certify the project.
Typically, these services are compensated for as a component of Post Design Services and not
specifically itemized in this fashion; however in this particular case the funding for Post Design
Services was not periodically increased while under construction to compensate the requested
work.
Requests for these services were made to the CONSULTANT by staff within various
Departments of Collier County including but not limited to: Collier County Transportation
Department, Collier County Construction Management Department, Collier County Planning
Department, Collier County Traffic Department, Collier County Right -of -Way Department,
Collier County Utility Department and Collier County Attorney. These requests were conveyed
by a variety of methods including E -Mail, Meeting Minutes, and Verbal communication.
While these services were performed without immediate reimbursement, the services were
necessary to support construction activity and expedite the project. The direction to perform
these activities came from various sources within Transportation. The designer continued to
provide services, respond to the needs requests and pro - actively responded to the change
requests in an effort to respond to public inquiries, avoid project delays and expedite
construction.
Prior to construction completion (during the project close -out phase), it was determined that
the existing design contract had been closed out and the remaining monies reallocated. That
determination prompted the need to request additional funding by different means to
compensate the Design Engineer for the Additional Services provided.
The following CONSULTANT Services are an addition to the original contract:

1. Traffic Safety and Access Management: The following changes were necessary to modify
the original design to meet new County access management standards based on converting
existing facilities to six -lane urban roadways. The changes also addressed traffic safety
issues due to development changes along the corridor.
a. Signal at Vanderbilt Beach Road /Airport - Pulling Road Intersection - $22,149
This work was requested /directed by Collier County Traffic Operations Department.
Bob Tipton requested that the proposed Strain Pole Signal System be modified to
provide a 5 pole Mast Arm Design. E -Mail, Meeting Minute and Verbal
correspondence included the following personnel:

signals at Vanderbilt Beach Road /Airport- Pulling Road Intersection from
strain pole system to mast arms.
ii. Coordinated utility locates with the new pole locations to ensure no
construction conflicts occurred with utilities and pole foundations 100—N
iii. Revised Signalization Plan Sheet, Sign Details and Signal Layout Worksheets,
Mast Arm Detail and tabulation sheets, and applicable quantities
iv. Efforts included Project Management, traffic engineering design and plans
modifications and utility coordination (223.5 total hours charged)
b. Median Opening at Tiburon Drive /Naples Walk - $7,623
This work was requested /directed by Collier County Traffic Operations Department.
Bob Tipton requested that the intersection be modified to remove the Signal and
revise intersection to provide dual directional lefts. Correspondence included
Executive Summary to Board of County Commissioners for approval. E -Mail,
Meeting Minute and Verbal correspondence included the following personnel:

opening and replace the median opening with a restrictive directional
opening to meet current traffic conditions and access management criteria
iv. Included with the effort was an evaluation of the sight distance criteria and
preparation of a technical memo regarding the location of the existing
Tiburon Drive median sign and required relocation.
v. Revised Roadway plan & profile sheets, cross section sheets, and Signing &
Marking plan sheets
vi. Effort included Project Management, roadway design and plan
modifications, traffic engineering design and plan modifications (79 total
hours charged)
c. The Groves Road Median Opening Modifications - $5,961
This work was requested /directed by Collier County Traffic Operations Department.
Bob Tipton requested that the intersection be modified to the below mentioned

modifications, traffic engineering design and plan modifications (65.5 total
hours charged)
d. Vineyards Boulevard Sign Relocation — Site Distance Analysis - $2,980

Construction Management Department. Gene Calvert and Kevin Dugan requested
that CH2M HILL prepare exhibits and documentation to support the requirement
for Vineyards to relocate their existing sign that is within existing ROW. E -Mail,

regarding the viability of leaving the entrance sign in place
iii. The significant size of this feature made relocation difficult and expensive
iv. A sight distance analysis was performed and determined that relocation was
necessary. In addition, utility reconfiguration would be costly
v. Consultant prepared the analysis technical memorandum and coordinated

vi. Effort included Project Management, site visits, sight distance analysis,
preparation of technical memorandum, preparation of conceptual utility

e. Collier Blvd Intersection Striping Modifications - $4,474
This work was requested /directed by Collier County Traffic Operations Department.

2. Match to "As- Built" conditions of surrounding projects: The project plans are developed
on information available during the design process. Due to continued growth and
development, many site conditions on surrounding County and /or developer projects
change after the design period ends which requires design modifications during
construction. This is required in order to make the projects compatible and avoid future
throw -away construction by incorporating the changes at a later date. These changes
generally require additional coordination, design survey, design analysis and revisions to
the construction plan documents. Additional Services provided by the Engineer included the
following:
a. Livingston Road Connection Modifications - $15,712
This work was requested /directed by Collier County Construction Management
Department. Eddie Martin requested that CH2M HILL coordinate with APAC and
their surveyor (Bob Amon) and make necessary modifications to plans for the tie -in.

Drainage and Utilities Plans were required
iv. Efforts included Project Management, office meetings, field meetings and
site visits, survey, utility coordination and redesign and plan modifications

4. Expedite Construction Activities and Schedule: The construction of 5.5.miles of 6 -lane
improvements to Vanderbilt Beach Road required a significant amount of coordination and
oversight from the Design Engineer. In addition to meetings with County, FDOT and
Permitting Agency staff, the Designer spent a good deal of time coordinating design and
construction elements with the Vanderbilt Beach Road, Collier Boulevard and FDOT 1 -75
Contractors including making minor modifications to design to reflect changing conditions
along the corridor. This coordination helped reduce construction costs and expedite the
construction schedules by resolving issues in a timely manner.
a. Basin 1 -A Stormwater Conveyance Modifications - $8,686

6. Bobbin Hollow Equestrian Center Driveway, Drainage and Ring Road Modifications: The
Owner of the Bobbin Hollow Equestrian Center contacted the County and requested that
their driveway connection be modified to help alleviate stormwater run -off onto their
property and flatten the slope of their driveway. The County requested that CH2M HILL
provide a revised design to accommodate the request. CH2M HILL performed site survey
and modified plans that revised the driveway connection, raised the riding track ring road,

cross drain and provided a trench drain across the driveway to intercept storm water run-
off.

PART 1. DESCRIPTION - SCOPE OF WORK
The CONSULTANT has been requested and retained to provide additional engineering services
during construction associated with Collier County Project No. 63051 Vanderbilt Beach Road
(VBR)(Airport Pulling Road to Collier Boulevard). Collier County staff was directed by the Board
of County Commissioners (BOCC) during a VBR Project presentation to the BOCC to assist the
Vanderbilt Beach Road Contractor whenever possible to help expedite project completion.
These additional services are primarily related to Utility Design and are based on various design
changes and scope of work additions requested by the Collier County Transportation
Engineering and Construction Management Division (TECM) staff in coordination with their
project Construction Engineering and Inspection Consultant (AIM Engineering).
Change Order No. 7 provides for the CONSULTANT'S services to be modified to add the
following Scope of Services to Collier County Project No. 63051- Services During Construction.
The following CONSULTANT Services are an addition to the original contract:
1. Methods and Means Documents for Contractor: The following tasks were necessary to
assist the Contractor during construction by providing verbal and written direction,
sketches and plans with regards to construction methods and means associated with

underground utility construction. Although it is not the responsibility of the Engineer nor is
it typical for the ENGINEER to provide construction methods and means, the Contractor
requested assistance with various construction related activities to help effectively and
efficiently construct utilities, schedule and perform connections (tie -ins), and leave existing
utilities in place and operational while the new utilities were constructed. Requests were
made by Contractor during field and weekly office meetings. The County agreed to have the
ENGINEER assist the Contractor in an effort to expedite construction. These changes
resulted in project cost savings and /or schedule savings. The Tasks performed included:
The tasks performed by ENGINEER to assist CONTRACTOR included:
a. 36" WM Tie -in (162 +42 RT) to Price Bros. Pipe at Vanderbilt Beach Road /Airport-
Pulling Road Intersection
L Contractor stated that the 36" WM Connection to the existing Price Bros.
Pipe could not be constructed as shown in the Design Plans. CH2M HILL
provided sketches (methods and means) to show Contractor how to install
connection.
ii. Contractor requested alternative designs for proposed connections.
CH2M HILL provided two (2) other options to Contractor for review.
iii. Contractor decided to build per plan with Price Bros. Representative on -site. n
County agreed to pay Contractor (Change Order No. 1) to have a Price Bros
Representative on site to oversee the tie -in connection since Armadillo was
not qualified /experienced to manage the installation.
iv. CH2M HILL prepared Construction Sequence Diagrams and alternative
construction plans for the connection including Isometric views of
connection
b. Proposed Utilities within the VBR /Collier Intersection
L Contractor requested assistance with construction sequencing of the
proposed utilities within the VBR /Collier Intersection Area.
ii. CH2M HILL prepared Construction Sequence Diagrams for Utility
construction within the Intersection.
2. Expedite Construction Activities and Schedule: The following tasks were performed to
help expedite construction of the proposed Vanderbilt Beach Road underground utilities.
Based on the Contractors schedule and preferred methods and means, CH2M HILL along
with Collier County staff, CEI (AIM) and the Contractor (APAC and Armadillo) identified

n opportunities to expedite construction of new utilities and advance the overall project
schedule. A variety of alternatives were identified and constructed. These changes resulted
in project cost savings and /or schedule savings. The Tasks performed included:
a. Relocate Fire Hydrant from Station 162 +80 LT to 162 +85 RT
L Contractor requested that proposed location of Fire Hydrant at Station
162 +80 LT be relocated to 162 +85 RT to avoid having to install a 16" Steel
Casing under VBR near the intersection of Airport Pulling Road.
ii. CH2M HILL coordinated the relocation with the Fire Marshall and obtained
approval. .
iii. CEI .prepared Work Directive (WD -7) and estimated reduction of contract
costs. This modification reduced the construction cost of the project by
approximately $17,050 and also reduced the Construction schedule.
iv. CH2M HILL prepared new construction plans for the relocation
b. Basin 1A Drainage System Modifications
i. A Value Engineering Recommendation to modify Basin 1 -A Storm water
conveyance was made to expedite Milestone 1 Improvements
ii. The design utilized the existing 48" storm sewer and connection to the
Airport Pulling Canal Box under the roadway as opposed to removing the
pipe and placing a new storm sewer behind the curb and gutter.
iii. This modification reduced construction cost (Credit in APAC C.O. 7) and the
construction schedule
iv. CH2M HILL prepared new construction plans for the relocation
c. Remove 24" FM (Sta. 162 +80 to 167 +45) and Relocate 24" FM (Sta. 167 +45 to
173 +00)
L Directional Bore of new 24" FM from concurrent County Project changed
location of proposed tie -in from south side of VBR to Median.
ii. New Tie -In location resulted in the elimination of proposed 24" FM from
Sta. 162 +80 to 167 +45 (Directional Bore was extended approximately 450 ft)
iii. Proposed 24" FM location was changed from median and south side of VBR
to north side
iv. Coordination with FPL and relocation of 4" TECO Gas Line was required
v. This modification reduced construction cost and the construction schedule
vi. CH2M HILL prepared new construction plans for the removal and relocation

d. Relocate proposed 36" WM (Sta. 162 +42 to 189 +40)
L Contractor requested proposed location of 36" WM be moved a few feet
(1.5 to 3.0) north (further away from FPL poles) to provide additional room
to construct. FPL was responsible to hold poles during construction.
ii. 36" WM was moved to a location that maximized distance from FPL poles
while providing required separation from existing 20" FM
iii. This modification reduced construction cost and the construction schedule
iv. CH2M HILL prepared new construction plans for the relocation
e. Reconfigure Utilities: Bermuda Isle to Village Walk (Sta. 221 +00 to 247 +00)
i. Effort was made to expedite North Side Roadway Construction by moving all
proposed utilities to South side.
ii. Proposed 24" FM was relocated from Median and North Side to South Side
(224 +20 to 247 +00)
iii. Redesign eliminated 16" FM Relocation (221 +80 to 231 +60)
iv. Proposed 24" WM was moved to provide separation to relocated 24" FM
(224 +20 to 247 +00)
v. This modification reduced construction cost and the construction schedule
vi. CH2M HILL prepared new construction plans for the reconfigurations
f. Bobbin Hollow (BH- Series) Drainage System Redesign
L Installation of the BH- Series drainage system on the north side of VBR was
required prior to roadway construction
ii. Completion of the north side roadway improvements were required
immediately so traffic could be shifted and delays to the FDOT Construction
project on 1 -75 could be avoided.
iii. The BH- Series Drainage system was relocated to median to expedite
completion of Milestone 3 which expedited VBR Construction and avoided
delays to the FDOT project.
iv. This modification reduced construction cost and the construction schedule
v. CH2M HILL prepared new construction plans for the reconfigurations
g. Reconfigure Utilities: Village Walk to 1 -75 (247 +00 to 267 +50).
i. Contractor requested assistance to expedite construction in the area of the
Village Walk Intersection which required modifications to the four proposed
utilities
ii. Modifications also allowed the extended use of existing signal strain poles
until the new Signalization was constructed.

iii. New design relocated 20" RCW from offset 68.0 to 70.0

L Drainage and utility construction on VBR under 1 -75 was delaying the FDOT
1 -75 improvement project. It was determined that revisions to the drainage
and utilities configuration would expedite construction and allow traffic to
be phased to the south side of VBR faster allowing FDOT to proceed.
ii. The utilities and casings in VBR under the 1 -75 structure were redesigned
and raised (approximately 3 -4 ft) which made construction easier, faster and
less costly. These revision expedited both FDOT and VBR Construction
iii. This modification reduced construction cost and the construction schedule
iv. CH2M HILL prepared new construction plans for the reconfigurations
j. Eliminate Relocation of 30" WM (Sta. 269 +69 to 271 +60)
i. Reconfiguration of the Drainage System in this area to expedite construction
eliminated the need to relocate the existing 30" WM.
ii. Eliminate Relocation of 30" WM (Sta. 269 +69 to 271 +60)
iii. Eliminated two (2) Tie -ins to existing 30" PCCP
iv. Added 2 Drainage Flumes (CFI -3, CFI -4)
v. Eliminated Drainage Structures S -230 and S -225

k. Reconfigure Utilities: Oakes Blvd to Vineyards Blvd (Sta.273 +00 to 284 +80) ^
L Contractor requested that the invert elevations of three (3) proposed
utilities be raised to minimize cut and reduce rock excavation which would
expedite construction. This was feasible based on contractor methods and
means of construction and cover to be provided after construction.
ii. Raised 24" WM Invert Elevation from 6.0 to 7.0
iii. Raised 24" FM Invert Elevation from 6.0 to 7.0
iv. Raised 16" FM Invert Elevation from 6.0 to 8.0
v. This modification reduced construction cost and the construction schedule
vi. CH2M HILL prepared new construction plans for the reconfigurations
I. D -2C Canal Relocation Around Pond 2D: Minimize 30" WM Relocation
L CH2M HILL was asked to redesign the west end of the D -2C Canal around Pond 2D
to reduce the transition and minimize the length of existing 30" WM relocation.
ii. The shortening of the transition expedited the canal relocation, 30" WM relocation
and also minimized the utility shut -down time required
iii. This modification reduced construction cost and the construction schedule
iv. CH2M HILL prepared new construction plans for the reconfigurations
m. New DIP in proposed 20" RCW to avoid existing FPL (B.E.) (Sta. 329 +54 + / -)
L The existing FPL B.E. Line that services Island Walk was shown on plans "To
Remain"
ii. Contractor was required to coordinate the relocation /deflection of FPL B.E.
line required for 20" RCW installation
iii. Due to schedule constraints, FPL could not perform the
relocation /deflection in a timely manner.
iv. County agreed to allow Contractor to place a new DIP in proposed 20" RCW.

iii. Switched proposed horizontal location of 18" Stormwater Pipe and 24" WM
iv. Removed 18" Stormwater pipe (5 -263 to S -264) Rerouted Stormwater South
v. This modification reduced construction cost and the construction schedule

n o. Reconfigure Proposed Utilities within the VBR /Collier Intersection
i. Contractor requested alternative designs for proposed connections to help
expedite construction based on Contractors methods and Means.
ii. CH2M HILL provided various options to Contractor for review.
iii. Relocated proposed 36" WM to south ROW line (Sta. 423 +00 to 436 +20)
iv. Relocated Pond 5 Outfall to south of Curb line (Sta. 428 +40 to 436 +30)
(Between roadway drainage and 36" WM (Relocated 5 -504, S -504A, S -507)
v. CH2M HILL new construction plans for the relocations.
3. Reconfigure Existing Utilities to Improve Functionality: During construction of the
Vanderbilt Beach Road Project, certain locations were identified where the existing utility
configuration was not compatible with current and future needs. The County requested
that the ENGINEER work with the CONTRACTOR to revise the existing utility configuration
to improve functionality. The Contractor was compensated (Cost and Schedule) for these
requested tasks as a Contract Change Order. These Tasks included:
a. Reconfigure Utilities in VBR /Webber Street Intersection
i. The existing utilities servicing the Collier County North Regional Water
Treatment Plant ( NRWTP) on Vanderbilt Beach Road were in locations that
were not compatible with the proposed utility improvements along VBR and
Webber Street.
ii. The proposed changes would minimize shut down times for the NRWTP and
reduce impacts to the existing facilities
iii. The 30" RWM was relocated from 435 +26 to 435 +90
iv. The 36" WM was relocated from 435 +90 to 436 +20
v. CH2M HILL prepared Construction Sequence Diagrams
vi. CH2M HILL prepared new construction plans for the reconfigurations
b. Logan Boulevard 10" WM Reconfiguration NE Corner
i. The existing 10" WM connected to the Island Walk community was poorly
configured and was in a location that was not compatible with the proposed
utility improvements along VBR
ii. The County directed the Contractor to install a new 10" TAP to the existing
30" PCCP to provide continuous service to Island Walk and expedite the
proposed utility installation.

4. Match to "As- Built" Conditions of Surrounding Projects: The project plans are developed ^
on information available during the design process. Underground utilities are identified by
existing "As- Built" data and /or survey. In certain areas "As -Built "data is inaccurate, not
shown, or not forwarded to the County for incorporation into their data -base. In addition,
due to continued growth and development, many site conditions adjacent to roadway
projects change after the design period ends.
These conditions are typical and often require design modifications and adjustments during
construction. For the tasks below, the Contractor was compensated (Cost and Schedule) as
a unit quantity adjustment or as part of a Contract Change Order. These Tasks included:
a. Lower Proposed 36" WM DIP Invert from Elev 4.0 to 0.6 (Sta. 162 +70 + / -)
i. Available "As- Built" Data was incorrect with regards to 36" WM and 20" FM
crossing depth
ii. Contractor required to construct invert approximately 3.5 ft lower
iii. Existing 20" FM encased in steel sleeve
iv. CH21VI HILL revised construction detail
b. New 36 "x 8" WM "r Connection for Naples Walk (Sta 175 +92 RT)
i. Naples Walk 8" WM connection for "loop system" was not shown on n
available "As- Built" files nor indicated in survey data.
ii. New 36 "x8" "T" required during construction.
iii. CH2M HILL prepared construction detail
c. Temporary Deflection for Naples Walk existing 8" WM (Sta 176 +00 RT)
i. Construction of Proposed 36" WM required the temporary deflection of
existing 8" WM
ii. Keeping existing utilities in service is a requirement of the specifications
however as stated in 4b. above, the connection was unknown.
iii. Existing connection was required to remain in service until connection to
new 36" WM was operational.
iv. CH21V! HILL prepared construction detail
