Recommendation to eu hortse the Clark of Courts to release securities which were
posted as development guerenlses through Land Developmental Services.
OBJECTIVE:
To release securities which were posted as development guarantees.
CONSIDERATIONS:
Land Development Services routinely accepts securities ndministtatively as guarantees for
developer commitments. The work associated with thaw secuMles has been Inspected andtor
the developers have fulfillod their cummibrwnts with respect to these padiwlar securities. The
subject securities were provided for work associated with Early Work Authorizations,
excavatiom or utility Improvements (which will remain privets).
Historically all of these bond types have bean routinely handled administratively. Only
subdivision bonds (associated with Construction Maintenance Agreements), or utllly bonds
associated with uNides to be conveyed to Collier County, have previously required Board of
County Commissions (Board) action. All bonds (both cash and paper) have been sent lathe
Clerk of Courts for safe keeping. A recent interpretation, by the Clerk of Courts, is chat all bonds
should go to the Board for approval to release. County staff will now bring all perspective
releases to the Board for approval.
FISCAL IMPACT:
Thee is no fiscal impact b Collier County government, however, the development
community will experience a delay In receiving their funds associated with processing of the
Ham through the Agenda Central system.
GROWTH MANAGEMENT IMPACT:
There is no growth management impact
LEGAL CONSIDERATIONS:
The County Attorney's Office has reviewed and approved this executive summary for legal
sufficiency. This item mquiss a majority vote. This item is ready for Board consideration and
approval. STW
RECOMMENDATION:
That the Board of County Commissioners authorize the Clerk of Couria to release the
attached securities b the County Manager or his designee and authorize the Clerk's Finance
Department to release the cash bonds back to the developer pursuant to a Memorandum to
be executed by the County Manager or his designee.
