Development Code (LDe) and Right-of-Way Ordinance in regards to storage containers, Planned Unit
Development (PUD) Annual Monitoring Reports, specific standards for the location of accessory
buildings and structure provisions to include Pe.rsonal Storage Containers (PODS), number of dogs
allowed in residential districts, and exceptions to a Right-of-Way (ROW) permit meeting specific
criteria. (Commissioner Hiller's request)

17 a majority vote of the Board is required to add this document to the agenda since it was submitted

Fly Event in Lakeland Florida is scheduled for March 27 through April 1, 2012.

Recommendation to approve a Revenue Commitment CODtract with Naples News Media
Group to receive diseeunted pricing on advertising.
OBJECTIVE: To realize cost savings to the County associated with the placement of
advertising with the Naples News Media Group.
CONSQ)ERATIONS: The County places advertising of different types in various local
publications, including the Naples Daily News. and other community publications under the
Naples News Media Group. By signing a revenue commitment contract, based on the County's
previous twelve month display advertising volume of $60,000, the County will be. billed at the
discounted rates indicated in the contract as follows: All Naples Daily News advertisements
receive a 19 percent discount, excluding legal and recruitment advertising, and anY community
publicationad'\'ertisements receive a 45 percent discount, excluding legal and recruitment
advertising. Contract pricing shall be applicable to all County departments and shall
automatically be applied as each order for advertising is placed.

The proposed agreement presents no financial risk to the County. If the County does not reach
the anticipated $60,000 annual revenue volume during the first 12 months cumulatively, the
Naples News Media Group may adjust the discount rate downward for the following year to the
appropriate level per .the 2011 Rate Card (see attachment); but will provide 30 days written
notice, and the County can either choose to terminate the contract or accept the new rates. There
is no retroactive financial impact.
FISCAL IMPACT: The fiscal impact will depend on the actual number and distribution of
advertising that is placed with the Naples Daily News or other related community publications,
contingent upon the available budget in the user departments.
GROWTH MANAGEMENT IMPACT: There is no Growth Management Impact resulting
from this action.
LEGAL CONSIDERATJONS: This item has been reviewed by the County attorney, is legally
sufficient, and requires majority support. -J AK
RECOMMENDATI9N: That the Board of County Commissioners waive formal competiton
and approve a revenue commitment agreement as per attached, and that the Chairman be
authorized to execute the agreement following final review by the County Attorney.

Terms:
1. Advertisers signing a revenue commitment contract ("Contract") will be billed at the rates indicated in the Contract.
2. Rates may be adjusted during the term of this Contract upon thirty (30) days written notice to Advertiser. Advertiser
will have ten (10) days from receipt of such written notice to terminate the agreement. If no such termination notice is
received by Publisher within that ten (10) day period, the new rates shall become effective twenty (20) days later.
3. Atthe request of Advertiser and upon mutual agreement of the parties, this Contract may be amended to a higher
revenue level, effective the first of the following month. at any time during the original term of the contract and enjoy
the resulting lower rates through current term of the Contract. Previously run ads will not be re-rated at the lower rate.
4. Advertiser agrees to pay a finance charge of 1.5% per month, 18% annually, on any balance more than sixty (60)
days overdue.
5. The Publisher reserves the right to reject or cancel any advertisementst anytime.
6. Advertising space cancelled after deadline will be billed at the rate outlined in the Contract.
7. Advertisers are allowed UP TO THREE sets of changes before additional charges may apply at the rate of $50.00
per hour..
8. Advertisements are accepted to run on a Run of Paper ("ROP) basis. Should advertiser request a guaranteed
position, Publisher shall charge an additional 50% of the cost of the ad.
9. Advertiser or Advertiser's agent Is solely responsible for the content of all advertisements and shail indemnify,
defend and hold harmless Publisher from .any claim or lawsuit arising out of advertisements.
10. The intellectual property rights to all advertising material, which shall include the creative effort, illustrations, labor,
composition or other materials furnished by the Publisher, shall be the property of Publisher. Advertiser shall not
authorize photographic or other reproduction in whole or in part, of any advertisement for use in any other medium
without the express written consent of Publisher.
11. Advertiser agrees to pay all costs incurred by Publisher for collecting any amounts not paid per the terms of this
Contract, including reasonable attorney's fees and penalties.
12. In no event shall Publisher be liable to advertiser for any incidental, consequential, indirect or special damages
of any nature whatsoever, including, without limitation, lost business profits arising out of the publication of the
advertising hereunder. delays or failures in publication, or damages to any documents or other property of advertiser,
whether in contract or in tort or under any warranty theory, in negligence or otherwise, even if Publisher has been
previously advised of the possibility of such damages. In no event shall the Publisher be liable to Advertiser for
any damages, direct or otherwise, in excess of the total amount paid by advertiser to Publisher during the term for
publication of advertisements hereunder.
13. Collier County, Florida shall be the place of venue for any action to enforce this contract or collect the monies due
there under.

Revenue Commitment Contract
The following changes to the above referenced Contract Terms have been mutually agreed to by Naples News
Media Group ("Publisher") and the Collier County Board of County Commissioners ("County"):
The additions to the existing language in the Contract are shown herein by underlinina: deletions from the Contract are

Terms:
Delete item 1:

Replace item 1 with:
1. Bv sianina a revenue commitment contract ("Contract"), the County will be billed at the rates indicated in the
Contract as follows: All Naples Dailv News ads receive a 19% discount excludina leaal and recruitment advertisina
and any community publication ads receive a 45% discount excludina leaal and recruitment advertisina. "Advertiser"
shall be defined as the individual County departmental staff that is placina advertisements. Advertisements shall be
placed upon issuance of a Purchase Order or throuah the use of a Collier County Purchasina Card (Visa). Contract
pricina shall be applicable to all County departments and shall automaticallv be applied as each order for advertisina
is placed. In the event the County does not meet the $60.000 annual revenue commitment. the Publisher's sole
remedy is to adiust the rate aoina forward to the appropriate level per the 2011 Rate Card, herein attached and
incorporated bv reference.

delivered. and accepted, upon receipt and approval of invoices submitted on the date of services er within six (6)
months after completion of contract. Anv untimelv submission of invoices beyond the specified deadline period is
subiect to non-payment under the leaal doctrine of "laches" as untimelv submitted. Time shall be deemed of the
essence with respect to the timelv submission of invoices under this aareement.
9. The County Advertiser or .^.dvertiser'c agent is solely responsible for the content of all advertisements and shall
indemnify, defend and hold harmless Publisher from any claim or lawsuit arising out of advertisements. subiect to the
limitations of Section 768.28, Florida Statutes.
All other terms and conditions of the Contract shall remain in force.
