Add Item 16H2: Proclamation recognizing the heroic actions of Chokoloskee resident Dwain Daniels
when he rescued ninety-year old Margaret Webb who was being attacked by an alligator. The
Proclamation designates September 24, 2011 as "Dwain Daniels Day". Per Ordinance Number 2011-
17 a majority vote of the Board is required to add this document to the agenda since it was submitted
following the publication of the printed agenda. Sponsored by Commissioner Henning.

OBJECTIVE: To approve a budget amendment recogrnzing $284,110.45 in revenue generated as
program income when conveying a property acquired through the Neighborhood Stabilization Prpgram.
CONSIDERATlO~S: On December 1, 2009, agenda item 17B, the Board of eountyCommissioners
adopted Ordinance No. 2009--63 to establish policies and procedures to be used when selling and
conveying real property acquired under the Neighborhood Stabilization Program (NSP). The ordinance
was necessary to ensure C,llier County was in compliance with S 125.35(3), Florida Statutes.
Collier County has used NSP funds to acquire and rehabilitate foreclosed and abandoned properties.
Once rehabilitation is complete. the homes are sold to income-qualified persons or families. Upon sale,
the net proceeds are returned to Collier County as program income to be used for other eligible NSP
activities, including administration. Properties located at 2224 50th Terrace SW, Naples, FL 34116, 5410
26th Avenue SW, Naples, FL 34116, 5300 17th Place SW, Naples, FL 34116, and 3671 18th Avenue NE,
Naples, FL34120 were purchased by the County and sold to income-qualified persons. The following;

.In determining the sale price/limitatit:m, HUD will not consider the costs of boarding up, lawn mowing, or simply maintaining
the property in a static condition. These costs may not be included by the grantee in the determination of the sales price for an
NSP-assisted pro~rty.
The down payment assistance (i.e. subsidy retention) is secured by a second mortgage recorded in the
Public Records ofColJier County and will. be repaid when a home is sold, refinanced, or no longer used as

~ a principal residence. A reduction of the sale price is required to secure first mortgage financing when an
independent third-party appraisal determines the home's market value to be less than the amount invested
by Collier County. The "Net Proceeds" listed above represents the amount of net revenue generated in
compliance with grant regulations and does not represent a profit figure.
This revenue will be used in compliance with federal grant regulations and will fund eligible expenses,
including administration. Furthermore, approval of this item will authorize the reallocation of funds
within the program commitment items to accurately reflect ongoing program expenses.
FISCAL IMPACT: A total of$284,11O.45 will be recognized as revenue for FYI1 in Fund 121.
LEGAL CONSIDERATIONS: No legal issues are raised by this item which is ready for Board action.
This is a regular matter requiring majority vote. - JBW
GROWTH MANAGEMENT IMPACT: The Neighborhood Stabilization Program facilitates the goals,
objectives and policies set forth in the Housing Element of the Growth Management Plan.
RECOMMENDATION: To approve a budget amendment recognizing $284,110.45 in revenue
generated as program income when conveying properties acquired through the Neighborhood
Stabilization Program.
