EXECUTIVE SUMMARY
Recommendation to approve the conveyance of a Utility Easement to Immokalee Water & Sewer
District for providing water service to the Immokalee Airport USDA Building located at 190
Airpark Boulevard, Immokalee at a cost not to exceed $18.50.
O JEC,ME: To obtain, approval from the Board of County Commissioners (hereinafter referred to as
"Board ") to approve the conveyance of an Utility Easement to the Immokalee Water & Sewer District
(hereinafter referred to as "IWSD ") for the installation and maintenance of underground and above
ground water lines, valves and other infrastructure at the Immokalee Airport USDA Building, together
with all associated conveyance documents, including a Bill of Sale, and any necessary closing statements
or affidavits.
CONSIDERATIONS: On June 24, 2008, Agenda Item 16G5, the Board of County Commissioners
(BCC) approved and authorized the Airport Authority to apply for and sign all related documents to
consummate a USDA Rural Business Enterprise Grant for the construction of a 20,000 square foot
manufacturing facility (USDA Building) at the Immokalee Regional Airport.
On February 24, 2009, Agenda Item 16G2, the BCC approved a budget amendment to recognize USDA
grant revenue and transfer funds from Airport Authority Reserves to this project.
In order for IWSD to provide water service to the Immokalee Airport USDA Building, it will be
necessary for the County to execute and record the attached Utility Easement, together with a Bill of Sale
in substantially the form attached, and other documents required by IWSD.
The Easement measures 10 feet in width and comprises a total of 4,621.64 square feet, more or less, as
shown and described on Exhibit "A" of the Utility Easement.
FISCAL IMPACT: The total cost will not exceed $18.50 for the recording of the Utility Easement: The
funds are available in Immokalee Development Fund 497.
GROWTH MANAGEMENT IMPACT: There is no impact to the Collier County Growth
Management Plan.
LEGAL CONSIDERATIONS: The Utility Easement and Bill of Sale have been approved for form and
legal sufficiency. This item is legally sufficient for Board action, and requires majority vote for approval.

RECOMMENDATION: That the Board approves the attached Utility Easement and Bill of Sale and
authorizes the Chairman to execute any other documents necessary for the conveyance of the utility
facilities to IWSD; and, also directs the County Manager or his designee to proceed to follow all
appropriate closing procedures; ,and, to record the Utility Easement in the Public Records of Collier
County, Florida.

THIS EASEMENT, made and entered into this day of , 2011, by
COLLIER COUNTY, a political subdivision of the State of Florida, whose post office
address is 165 Airpork Boulevard, Immokalee, Florida 34142, hereinafter referred to as
"Grantor", to the IMMOKALEE WATER & SEWER DISTRICT, a special district of the State of
Florida, whose post office address is 1020 Sanitation Road, Immokalee, Florida 34142, its
successors and assigns, hereinafter referred to as "Grantee ".
WITNESSETH:
Grantor, for and in consideration of TEN DOLLARS ($10.00) and other valuable
consideration paid by the Grantee, the receipt and sufficiency of which is hereby
acknowledged, hereby conveys, grants, bargains and sells unto the Grantee, its
successors and assigns, a perpetual, non - exclusive easement, license, and privilege for
utility purposes, on the following described lands located in Collier County, Florida, to
wit:

Subject to easements, restrictions, and reservations of record.
THIS IS NOT HOMESTEAD PROPERTY,
TO HAVE AND TO HOLD the some unto the Grantee together with the right to

THIS BILL OF SALE evidencing the sale and conveyance of the utility facilities described
herein is made this day of August, 2011, by COLLIER COUNTY, a political subdivision of the
State of Florida (hereinafter referred to as "SELLER "), and the IMMOKALEE WATER & SEWER
DISTRICT, a special district of the State of Florida, its successors and assigns (hereinafter referred
to as "BUYER ").
