EXECUTIVE SUMMARY
Recommendation to approve the conveyance of an Underground Easement (Business) to Florida
Power & Light Company for providing electrical service at the Marco Island Airport located at
2005 Mainsail Drive, Naples, Florida at cost not to exceed $35.50
OBJE`CIM: To obtain approval from the Board of County Commissioners (hereinafter referred to as
"Board ") to approve the conveyance of an Underground Easement (Business) to Florida Power & Light
Company (hereinafter referred to as "FPL ") for the installation and maintenance of underground electrical
infrastructure at the Marco Island Airport
CONSIDERATIONS: On May 11, 2010, Agenda Item 16G6, the Board of County Commissioners
(BCC) approved the submittal of a grant application to the'Federal Aviation Administration (FAA) for
construction of a taxiway and ramp expansion at the Marco Island Executive Airport. On August 28,
2010, Agenda Item 16G3, the BCC approved the acceptance of a FAA grant for this project.
In order for FPL to provide electrical service to the .area of the Marco Island Airport identified on the
Location Map,, it will be necessary for the County to execute and record the attached Underground
Easement (Business) required by FPL.
The Easement measures 10 feet in width and comprises a total of 5,777.81 square feet, more or less, as
shown and described on Exhibit "A" of the Underground Easement (Business).
FISCAL IMPACT: The total cost will not exceed $35.50 for the recording of the Underground
Easement (Business). The funds are available in Collier County Airport Authority Fund (495) in the
Marco Island Airport budget.
LEGAL CONSIDERATIONS: The Underground Easement (Business) has been approved for form and
legal sufficiency. This item is legally sufficient for Board action, and requires majority vote for approval.

GROWTH MANAGEMENT IMPACT: There is no impact to the Collier County Growth Management
Plan.
RECOMMENDATION: That the Board approves the attached Underground Easement (Business) and
authorizes the Chairman to execute the easement; and, also directs the County Manager or his designee to
proceed to follow all appropriate closing procedures; and, to record the Underground Easement
(Business) in the Public Records of Collier County, Florida.

The undersigned, in consideration of the payment of $1.00 and other good and valuable
consideration, the adequacy and receipt of which is hereby acknowledged, grant and give to
Florida Power & Light Company, its licensees, agents, successors, and assigns ( "FPL "), a non -
exclusive easement forever for the construction, operation and maintenance of underground
electric utility facilities (including cables, conduits, appurtenant equipment, and appurtenant above
ground equipment) to be installed from time to time; with the right to reconstruct, improve, add to,
enlarge, change the voltage, as well as, the size of and remove such facilities or any of them within
an easement described as follows:
See Exhibit "A" ( "Easement Area ")
Together with the right to permit FPL to attach wires to any facilities hereunder and lay cable and
conduit within the easement and to operate the same for FPL's communications purposes; the
right of ingress and egress to the Easement Area at all times; the right to clear the land and keep it
cleared of all trees, undergrowth and other obstructions within the Easement Area; to trim and cut
and keep trimmed and cut all dead, weak, leaning or dangerous trees or limbs outside of the
easement area which might interfere with or fall upon the lines or systems of communications or
power transmission or distribution; and further grants, to the fullest extent the undersigned has the
power to grant, if at all, the rights hereinabove granted on the Easement Area heretofore
described, over, along, under and across the roads, streets or highways adjoining or through said
Easement Area.
