EXECUTIVE SUMMARY
Recommendation to approve a Utility and Access Easement from Collier County to
.the Collier County Water -Sewer District to improve current access and to install a
water line for fire protection for Master Pumping Station 312 for a total cost not to
exceed $27, Project Number 72549.
OBJECTIVE: That the Board of County Commissioners of Collier County, Florida (Board) approve
and accept the attached Utility and Access Easement from Collier County to the Collier County
Water- Sewer District. The public purpose, is to facilitate improvements for access to Master
Pumping Station 312 (MPS 312) to minimize inconvenience to neighboring property owners,
thereby increasing the safety value related to the access route planned to serve the master
pumping station, and to provide for the installation of a water line to serve a required fire hydrant for
MPS 312.
CONSIDERATIONS: The Collier County Water -Sewer District (CCWSD) is undertaking the
replacement of MPS 312 located in the southwest comer of the Embassy Woods PUD (Glen Eagle)
which is situated immediately north of the canal running along the north side of Davis Boulevard
(see attached Location Map). Presently the only access to MPS 312 runs through the Glen Eagle
community, which has caused substantial' inconvenience to that community during maintenance
activity. Therefore,. CCWSD requires a perpetual easement along the north side of the canal in
order to access MPS 312 directly from the public right -of -way. The easement is also required to
accommodate a water line to serve a fire hydrant required at the MPS 312 site.
Approval of this Utility and Access Easement will further the process of providing for planning of
improvements to master pumping stations; plans which include good neighbor access
improvements.
This project is consistent with the 2008 Wastewater Master Plan update adopted by the Board on
June 24, 2008, as Agenda Item 16G in Table 8-1, Page 7of 7, Line 151.
The attached Utility and Access Easement has been reviewed and approved by the Public Utilities"
Division, the Growth Management Division, and the County Attorney's Office.
A location map of the proposed utility and access easement area is attached for ease of reference.
FISCAL IMPACT: The total cost will not exceed $27 for the recording of the Utility and Access
Easement. Funding is.available in Project Number 72549 as stated in the 2008 Water Master Plan
Update Dated June 24, 2008, Table 8-1, page 6 of 7, line 119. The Board of County Commissioners
approved the FY11 budget on September 23, 2010. The source of funds is Wastewater User Fees,
Fund 414.
GROWTH MANAGEMENT IMPACT: This project is consistent with, and furthers the goals,
objectives and policies of the Collier County Growth Management Plan.
LEGAL CONSIDERATIONS: This item is legally sufficient for Board action. This item requires a

RECOMMENDATION:
1. That the Board of County Commissioners approve and authorize the Chairman to execute the
Easement.
2. That the Board of County Commissioners of Collier County, Florida, as the Governing Body of
Collier County and as Ex- Officio the Governing Board of the Collier County Water -Sewer District
accept the Utility and Access Easement and direct the County Manager or his designee to proceed
to acquire the Easement and to follow all appropriate closing procedures, and to record the
Easement in the Public Records of Collier County, Florida.

UTILITY AND ACCESS EASEMENT
THIS UTILITY AND ACCESS EASEMENT (hereinafter referred to as the "Easement ") is
made and entered into on this day of , 2011 by and between
COLLIER COUNTY, A POLITICAL SUBDIVISION OF THE STATE OF FLORIDA, whose
mailing address is 3299 Tamiami Trail East, Suite 303, Naples, Florida, as Grantor, and the
BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, AS THE
GOVERNING BODY OF COLLIER COUNTY AND AS EX- OFFICIO THE GOVERNING
BOARD OF THE COLLIER COUNTY WATER -SEWER DISTRICT, whose mailing address is
3335 Tamiami Trail East, Suite 101, Naples, Florida 34112 -5356, as Grantee.
(Whenever used herein the terms "Grantor" and "Grantee" include all the parties to this
instrument and their respective heirs, legal representatives, successors or assigns."
WITNESSETH: Grantor, for and in consideration of TEN DOLLARS ($10.00) and other
valuable consideration paid by the Grantee, the receipt and sufficiency of which is hereby
acknowledged, hereby conveys, grants, bargains and sells unto the Grantee, its successors and
assigns, a perpetual, non - exclusive easement for utility facilities and access purposes, including
vehicles, on, over, upon, across and through the following described lands located in Collier
County, Florida, to wit:
Being Tract "H ", as shown on the Plat of Lago Villaggio, as recorded at Plat Book 38, Pages 11
through 14, inclusive, in the Public Records of Collier County, Florida.
Subject to easements, restrictions, and reservations of record.
THIS IS NOT HOMESTEAD PROPERTY.
TO HAVE AND TO HOLD the same unto the Grantee together with the right to enter
upon said lands for the purpose of excavating and placing or removing materials, including, but
not limited to, water lines and pipes, and other equipment, utilities or improvements appurtenant
thereto for the purpose of constructing, maintaining, replacing, rehabilitating and operating utility
facilities thereon. And for the purpose of constructing and maintaining access facilities and for
access to Grantee's utility facilities and installation thereon and lying easterly and northeasterly
thereof. This easement includes the right to remove and use any and all excavated material and
to construct and maintain such facilities as Grantee deems necessary to provide access for
construction and maintenance of the aforesaid utility facilities, subject to the right of the Grantor
to construct and maintain a drainage ditch in substantial conformance with the Plan and
Drainage Cross Sections attached hereto as Exhibit "A ". The easement granted herein shall
constitute easements running with the land and shall burden the lands described above.
Grantor reserves and excepts unto itself and its successors and assigns, all rights accruing from
its ownership of the real property described above against which this easement is being
granted, including the right to engage in or permit or invite others to engage in all uses of the
same real property that are not inconsistent with the purpose of the easement being granted
herein or hinder the use of the easement being granted herein.
The Grantee shall maintain the easement described herein in a good state of repair at the sole
cost and expense of Grantee, its successors and assigns.
IN WITNESS WHEREOF, the Grantor has caused these presents to be executed the date
