EXECUTIVE SUMMARY
Recommendation to approve and ratify staffs Zero - Dollar Time Extension to
Contract #04 -3576, Construction Manager at Risk Annex & Parking Garage, with
Kraft Construction Co., Inc., in order to process the Contractor's final invoice for
work completed on the Courthouse Annex (Project 52533) and close out the
Contract; and authorize the County Manager or his designee to sign the
necessary documents.
OBJECTIVE: To close out Contract #04 -3576, Construction Manager at Risk Annex & Parking
Garage.
CONSIDERATIONS: Contract #04 -3576, Construction Manager at Risk Services for the
Courthouse Annex and the #2 Parking Garage, with Kraft Construction Co., Inc., was issued for
the site work and construction of the Parking Garage #2, the Courthouse Annex, the
Modifications of the Judge's Parking Lot, the Re- Roofing of the Courthouse, and the
Modifications to the Chiller Plant required by the additional cooling load of the Annex. All
portions of the Contract have been completed and are now out of warranty. The Contract
expired on 5/21/2010, which also marked the end of the 1 -year warranty period. During the
warranty period and subsequent to the end of the warranty, latent defects in some of the
materials were discovered and Kraft Construction diligently corrected all defects on all of the
individual sub - projects. Some of these defects took longer than expected to correct, but all are
now complete and the Contract can be finalized and closed. This change order will allow the
processing of the contractor's final invoice for the outstanding amounts from items previously
authorized prior to 5/21/2010.
FISCAL IMPACT: There is no fiscal impact from this item. Upon approval, the contractor's
final invoice for all work and costs covered by previously authorized change orders will be
processed and the Contract closed out
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with
this Executive Summary.
LEGAL CONSIDERATIONS: The County Attorney is providing an "after the fact" review of
staff's prior extension of the referenced contract. The Board is authorized to determine the
validity of equitable claims such as quantum meruit and determine that the relief sought
equitably reflects the fair value of the work performed and furnished to the County, for which the
County has benefited, and approve and ratify the extension of the contract and authorize any
remaining payment owed to the vendor This item is legally sufficient and requires majority
vote. — CMG
RECOMMENDATION: That the Board approves and ratifies the Zero - Dollar Time Extension to
Contract #04 -3576, Construction Manager at Risk Annex & Parking Garage, and authorizes the
County Manager or his designee to execute the related documents.
