EXECUTIVE SUMMARY
Request Board to approve and ratify staff's zero - dollar time extension to Contract #06-
3980 "Fixed Term Professional Engineering Services" with Cardno /TBE and related Work
Order #4500115973, dated February 16, 2010 in order to process the Consultant's final
invoice for work completed for the upgrading of the existing span wire traffic signal at
Airport- Pulling Road and Pine Ridge Road to a steel mast arm assembly.
OBJECTIVE: To close out Contract 406 -3980 and related Work Order # 4500115973 to
process the consultant's final invoice.
CONSIDERATIONS: The project consists of replacing the existing span wire traffic signal
installation to a steel mast arm assembly at the intersection of Airport - Pulling Road and Pine
Ridge Road. The original Work Order issued on February 16, 2010 stated that the consultant,
Cardno/TBE, provide design services for the project and provide review and inspection services
during construction. Since the referenced intersection is the busiest intersection in Collier County
the construction of the project was delayed until late spring of 2011 to avoid seasonal traffic
interruption. The Work Order for this project was inadvertently allowed to expire on May 25,
2011 and, therefore, Change Order No. 3 is now required. Change Order No. 3 is a zero dollar
change order as it only includes a request for a time extension to pay the vendor the amounts
owed for work previously completed under the work order. This change order will allow the
processing of the vendors' final invoice for the outstanding amount for services previously
rendered.
FISCAL IMPACT: There is no fiscal impact associated with this item.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated
with this Executive Summary.
LEGAL CONSIDERATIONS: The County Attorney is providing an "after the fact" review of
staff's prior extension of the referenced contract and associated work order. The Board is
authorized to detennine the validity of equitable claims such as quantum meruit and determine
that the relief sought equitably reflects the fair value of the work performed and furnished to the
county for which the county has already benefited and approve and ratify the extension of the
contract and associated work through Change Order No. 3, and authorize any remaining payment
owed to the vendor. This item is legally sufficient and requires majority vote for approval. -

RECOMMENDATION: That the Board approves the zero - dollar time extension to Contract #
06 -3980 "Fixed Term Professional Engineering Services" with Cardno /TBE and the associated
Work Order 44500115973, authorize the Chairman to execute Change Order No. 3, and
authorize payment of any remaining sum owed to the vendor.
