EXECUTIVE SUMMARY
This is a recommendation to approve for recording the final plat of Lakoya Replat of Lot 86.
OBJECTIVE:
To approve for recording the final plat of Lakoya Replat of Lot 86, a subdivision of lands located
in Section 21, Township 50 South, Range 26 East, Collier County, Florida, following the
alternative procedure for approval of subdivision plats pursuant to Resolution 99 -199.
CONSIDERATIONS:
Land Development Services Department has completed the review of the final plat of Lakova
Replat of Lot 86. These documents are in compliance with the County Land Development Code
and Florida State Statute No. 177. All fees have been paid. There are no required subdivision
improvements associated with this final plat.
Land Development Services Department recommends that the final plat of Lakoya Replat of Lot
86 be approved for recording.
FISCAL IMPACT:
The Countv will realize revenues as follows
Fund: Growth Management Fund 131
Agency: County Manager
Cost Center: 138327 -- Land Development Services
Revenue generated by this project: Total: $1,105.00, plat review fee
LEGAL CONSIDERATIONS:
The Count), Attorney's Office has reviewed and approved the plat and associated legal
documents for legal sufficiency. This item requires a majority vote. This item is ready for Board
consideration and approval. STN'
GROWTH MANAGEMENT IMPACT:
The developer must receive a Certificate of Adequate Public Facilities prior to the issuance of
the construction plan final approval letter.
RECOMMENDATION:
To approve the final plat of Lakoya Replat of Lot 86 for recording.

This letter Is to summarize our meeting on October 16, 2003, 91:01ch the development standards forihe
conservation parcels were discussed. At our meeting, Patrick Whits, with the CountyAttorWS Office
was also present, Itwas determined after the revlew of the idly Resort POD,1tiat the specific provisions
within the Development Table II-A referenced In Section 3.07 are applicable to the development of
residential lots along the Conservabor✓Open Space District Therefore, the rear yard setback for
residential lots along a conservetiori area are as tafed in Table it - -A of the Lely Resort POD. it was
determined that conflicting provisions within the Cosier Courtly Land Development Code do not apply due
to the specific language in Section 2.03(x) of the POD. Section 203(s) provides that the LDC and other
applicable ordinances shell apply to the eident the LDC and applicable ordinances or codes do not
conflict with or restrict development rights, development conditions and development mitigation contained
in the POD.
