Executive Summary
Recommendation to approve a Mediated Settlement Agreement and a Stipulated Final
Judgment to be drafted incorporating the same terms and conditions as the Mediated
Settlement Agreement in the amount of $80,400 for acquisition of Parcels 838A and 838B and
for all counter-claims of Respondent in the lawsuit styled Collier County v. Nancy L. Johllsoll
Perry, et aL, Case No. 03-2373-CA (Golden Gate Parkway Project #60027). (Fiscal Impact:
$16,400).
OBJECTIVE: That the Board approve a Mediated Settlement Agreement and a Stipulated final
Judgment to be drafted incorporating the same terms and conditions as the Mediated Settlement
Agreement as full and final compensation to be paid for the acquisition of Parcels 838A and 838B
and to resolve all counter-claims of trespass and inverse condemnation asserted in Respondent's
Amended Answer in the lawsuit styled Collier County v. Nancy L. Johnson Penry, et aI., Case No.
03-2373-CA, Golden Gate Parkway Project No. 60027.

CONSIDERATIONS: The County acquired two ten foot drainage easements from the Respondent
Nancy L. Johnson, individually and as Trustee, by entry of an Order of Taking on September 12,
2003 and subsequently depositing the amount of $64,000 into the Court Registry. Florida
Department of Transportation also acquired road right of way from Respondent for the construction
ofan access roadway related to its 1-75 interchange project. FOOT's acquisition occurred about six
months before the County's acquisition which required the County to reduce the size of its drainage
easement for Parcel 838A. At the Order of Taking, the County's appraiser testified as to the larger
taking for Parcel 838A and over-valued the taking for parcel 838A by approximately $22,000. The
Respondent filed a counter-claim in 2008 against the County for trespass and inverse condemnation
relating to mowing and ongoing parking on the remnant parcel on the Remainder Tract by the
County and others. Respondent has photographs that show that County vendors and employees
continued to park on the remnant parcel of the Remainder Tract, even after the County Attorney's
office and Transportation Management asked that these activities cease.
The issues in this case were valuation of extensive landscaping in the takings, ponding on the
southwest comer of the remnant parcel on the Remainder Tract, and inverse condemnation and
trespass claims. O'-"l1er valued full compensation and its counterclaims at $98,200. At mediation
on June 9, 201], a settlement was reached where the County will pay the Respondent $80,400 in
full settlement of all claims of Respondent including, hut not limited to full compensation, trespass,
inverse condemnation, attorney's fees for monetary and non-monetary benefits, and statutory
interest. The settlement is also conditioned upon the following:
(a) Subject to final review and approval by thc County's engineer, the County will
construct a cure on the remainder property of Parcel 838A, which provides for the installation of
signage and delineators in substantial conformance with the cure drawing. The County also agrees
to accept into the County's storm water management system the existing storm water run-off
flowing from the existing use of the remainder Tract of Parcels 838A and 838B and any additional
stonn water created by the County's cure on the remainder of Parcel 838A. Said cure will be
completed within a reasonable period of time not to exceed six months from the date of entry of the
Stipulated Final Judgment;

(b) The County agrees not to file a map pursuant to Section 95.361, F.S., to acquire title
to the remnant area south of the access roadway constructed by Florida Department of
Transportation.

Staff recommends this settlement as to full compensation because it is reasonable and the County is
not expected to achieve better results at trial. Negotiations for the payment of expert witness fees
and costs will continue until either a settlement is reached and an Agreed Order is brought before
the Board for ratification or an award is made by the court after a hearing is held.
FISCAL IMPACT: Funds in the amount of$16,400 will come from hnpact Fees.
GROWTH MANAGEMENT IMPACT: Consistent with Collier County Growth Management
Plan.
LEGAL CONSIDERATIONS: This item is legally sufficient for Board action. This item
requires a majority vote. (HF AC)
RECOMMENDATION: That the Board of County Commissioners approve the Mediated
Settlement Agreement; approve the Stipulated Final Judgment which incorporates the terms and
conditions of the Mediated Settlement Agreement to be presented to the Court for entry; and
approve the expenditure and disbursement of funds as stated.

MEDIATED SETTLEMENT AGREEMENT
At the Mediation Conference held on June 9, 2011, the parties reached the following
Scttl ement Agreement:
1. Petitioner will pay to Rcspondent, Nancy L. Johnson Perry, individually and as
Successor Trustee, the sum of $80,400 in full settlement of any and all claims of any nature trom
Pctitioner, including, but not limitcd to full compensation, trespass, inverse condemnation,
statutory interest and all claims related to real estate, but excluding supplemental attorney's fees
related to recovery of expcrts' costs, and excluding experts' fees and costs. Said sum will be
subject to claims of apportionment, if any. Petitioner is entitled to a credit in the amount of
$64,000.00, said amount having bcen previously depositcd [n the Rcgistry of the Court in this
case by Petitioner. Upon the satisfaction of the terms and conditions of this Settlement
Agreement and the entry of the Stipulated Final Judgment in this matter, Pctitioner will pay
Respondent the sum of $16,400, rcpresenting the difference between the total settlement SlUn
refcreneed above and Petitioner's previous dcposit referenced above. The above sum includes
attorney's fees related to monetary and non-monetary bencfits, if any, and attorney's litigation
costs incurrcd by Respondent in this case.
2 The Court will retain jurisdiction to detcrmine reasonable expert fees and costs of
Respondent.
3. This Settlement Agreement is subject to and conditioned upon final approval by
the Board of County Commissioncrs of Collier County.

4. Counsel for Petitioner and Rcspondcnt will jointly submit to the Court a mutually
approved Stipulated Final Judgment containing the terms and conditions of this Settlement
Agreement within tcn days following the final approval of tbis Settlement Agreement by the
Collier County Board of County Commissioners.
5. Witb payment of the sums set forth above, Respondent, Nancy L. Johnson Perry,
individually and as Successor Trustce, for herself, her executors, heirs and assigns does hereby
fully, finally and forevcr re\case and discharge Petitioner and its agents, representatives,
attorneys and assigns of any and all claims, demands, actions, causes of action, suits, damages,
losses and expenses, of any and every nature whatsoever, arising out of or in any way related to
the allegations contained in Respondent's Counter-Claim and Third Party Complaint and further
will indemnify, defend and hold harmless the Petitioner from any and all claims, demands,
actions, causes of action, suits, damages, losses and expenses, of any and every nature
whatsoever, arising out of or in any way related to the allegations contained in Respondent's
Counter-Claim and Third Party Complaint. Petitioner will use its best efforts to insure that
Petitioner and its agents will not enter onto the remainder properties of Parcels 838A and 838B
in the tilturc, cxcept as provided herein.
6. Subject to tinal reVlew and approval by Petitioner's engineer, Petitioner will
construct a cure on the remainder property of Parcel 838A, which provides for the installation of

Exhibit A. Petitioner also agrees to accept into Petitioner's storm water management system the
