EXECUTIVE SUMMARY
Recommendation for the Community Redevelopment Ageney (CR>\) to modify an existing
Commercial Building Improvement Grant Agreement between the CRA and a Grant Applicant by
approving a time extension and increase the grant award in the amount of $20,000. (4097 Bayshore
Drive, fiscal impact $50,000).
OBJECTIVE: To modify an existing Commercial Building Improvement Grant Agreement between the
CRA and a Grant Applicant by approving a time extension and increase the grant award in the amount of
$20,000. (4097 Bayshore Drive, fiscal impact $50,000).
BACKGROUND: During the permitting process for the October 26, 2010 approved grant agreement
(Exhibit A) for exterior improvements ($30,000), the applicant discovered additional modifications to
the building are needed due to Code requirements. The applicant is requesting that these interior
modifications be added to the grant application. The begin date for the grant award will not change from
the original date of October 26, 2010.
CONSIDERATIONS: The purpose of the grant program is to provide an incentive to revitalize the area
by providing matching grant funds to encourage the private sector to upgrade/rehabilitate commercial
properties. The CRA provides a project cost-match of 50% from Tax Increment Funds capped at $30,000
for exterior improvements and capped at $20,000 for interior improvements (provided the exterior
improvement's costs reach the cap amount). Remaining project dollars are provided by the applicant.
The revised Commercial Building Improvement Grant application (Exhibit B) submitted by Alan and
Susan Crum, owners of the commercial property at 4097 Bayshore Drive, Naples Florida, 34112, was
recommended for approval by the Bayshore/Gateway Trianglc CRA Local Advisory Board. The revised
application and new agreement (Exhibit C) reflect the entire project, including exterior and interior
improvements. The original Agreement is included in the backup to show thc original start date of
October 26, 2010, and a 12-month extension from the original expiration date to October 25, 2012, is
requested as part of the application revision.
LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney's Office and is
legally sufficient for Board consideration and approval. This item requircs a majority vote for approval. -

FISCAL IMPACT: Sufficient funding cxists within Fund (lX7) FYI I budget to satisfy this application.
The project includes $61,474 in exterior modifications, and $43,441 in intcrior improvements, for a total
project cost of $ I 04,915. The request is for up to $30,000 for exterior projects (with a 51 % grantee
match), and for up to $20,000 in interior projects (with a 63% match); for a total fiscal CRA impact of
$50,000.
GROWTH MANAGEMENT IMPACT: None.
RECOMMENDATION: That the CRA Board approves and authorizes the CRA Chairman to modify
the existing Agreement for a Commercial Building Improvement Grant between the Community
Redevelopment Agency and Alan and Susan Crum, owners of property at 4097 Bayshore Drive, Naples,
Florida, 34112, by approving a time extension until October 25, 2012 and increase the grant award in the
amount of $20,000. (Fiscal impact $50,0(0).

WHEREAS, in Collier County Ordinance No. 2002-38, the Board of County
Commissioners delegated authority to the CRA to award and administer CRA grants including
contracts with Grantees for CRA grants; and
WHEREAS, Ordinance No. 08-61 established the Commercial Building Improvement
Grant; and
WHEREAS, Grantee has applied for a Commercial Building Improvement Grant in the
amount of 30, c\oc>. 00 dollars; and
WHEREAS, the CRA has determined that Grantee meets the eligibility requirements and
was approved for a grant award in the amount of 30, 000. 00 dollars on

NOW, THEREFORE, in consideration of the mutual covenants contained herein and
other valuable consideration, the parties agree as follows:
1. Grantee acknowledges to the CRA that Grantee has received a copy of the Collier
COlmty Community Redevelopment Agency Commercial Building Improvement Grant Program
Information and Application (hereinafter referred to as "Grant Program"), that Grantee has read
the Grant Program, and that Grantee has had ample opportunity to discuss the Grant Program
with Grantee's counselor advisor. Grantee further acknowledges to the CRA that Grantee
understands and agrees to abide by all of the terms and conditions of the Grant Program. Grantee
agrees to the terms and conditions ofthe Grant Program.
2. Grantee is the record owner / tenant of property described as

3. Grantee has agreed to make certain improvements to the property pursuant to the
grant application submitted to the CRA dated "I. I . (0 attached hereto as
Exhibit A and incorporated herein by reference.
4. Grantee agrees to complete the construction of the commercial building
improvements within one (1) year of CRA Approval. Grantee also agrees to fund at least 50% of
the costs of the commercial building improvements. Grantee is prohibited from paying

contractors and/or vendors with cash. All payments for approved projects must be in the form of
a check or credit card drawing on funds from Grantee's accounts.
5, The CRA has approved a grant to Grantee in the amount oi~30, .000. 00 to
be administered pursuant to the terms of this Agreement based on an estimated cost of
~(P',+14. 0() . If the actual costs are less than $(oO.ooo.~o construct the improvements, the
grant amount shall be reduced dollar for dollar in CRA funds as determined by ratio of matching
private funds required.
6. Unless prior disclosure is included in the grant application, no Grantee, or any
immediate relative of Grantee, shall serve as a contractor or subcontractor for the constnlCtion of
the improvements and no Grantee, or any immediate relative of Grantee, shall receive
compensation for labor for the construction of the improvements. An immediate relative of
Grantee shall include mother, father, brother, sister, son, daughter, aunt, uncle and cousin or
family member by marriage to include mother.in-law, father-in-law, brother-in-law and sister.in-
law. Grantee has verified that all contractors who have provided bids for the approved work are
actively licensed by Collicr County. Grantee acknowledges that the total grant award shall not
exceed the sum of lowest bids/price quotes for all projects. Grant funds for work performed by
contractors shall only be disbursed upon verification that said contractors are actively licensed by
Collier County.
7. Grantee agrees to obtain all necessary permits and submit any required plans to
the County's Growth Management Division. Upon completion of the work, Grantee shall
submit to the CRA staff a Project Summary Report, two (2) 8 inch by 10 inch photos showing
the improvements, a list of materials and construction techniques used, a list of architects and/or
contractors, and any other information specific to the project or requested by the CRA staff.
The CRA, through its staff, shall confirm that the Commercial Building Improvements were
constructed pursuant to the terms ofthe application approved by the CRA.
8. Within fOlty.five (45) days after confirmation that the improvements were
constructed pursuant to the terms of the approved application, the Grantee shall be issued a check
in the amount of the grant. However, if the Grantee fails to malee the improvements pursuant to
the terms of the approved application, or if the improvements are not completed within one (I)
year of CRA approval, , the grant shall be deemed revoked and Grantee shall not be entitled to
funding.
9. This Agreement shall be governed and construed pursuant to the laws of the State
of Florida.
10. This Agreement contains the entire agreement of the parties and their
representatives and agents, and incorporates all prior understandings, whether oral or written.
No change, modification or amendment, or any representation, promise or condition, or any
waiver, to this Agreement shall be binding unless in writing and signed by a duly authorized
officer of the party to be charged.
I I. This Agreement is personal to Grantee, and may not be assigned or transferred by
Grantee or to Grantee's respective heirs, personal representatives, successors or assigns without
the prior written consent of the CRA.

GRANT AGREEMENT BETWEEN eRA AND GRANTEE FOR
COMMERCIAL BUILDING IMPROVEMENTS FOR BA YSHORE
GA TEW A Y TRIANGLE COMMUNITY REDEVELOPMENT AREA

between the Collier County Community Redevelopment Agency (hereinafter refelTed to as
"CRA") and ALN-j ANI) ';V6~ (hereinafter refelTed to as "Grantee").

WHEREAS, in Collier County Ordinance No. 2002-38, the Board of County
Commissioners delegated authority to the CRA to award and administer CRA grants including
contracts with Grantees for CRA grants; and
WHEREAS, Ordinance No. 08-6 I established the Commercial Building Improvement
Grant; and
WHEREAS, Grantee has applied for a Commercial Building Improvement Grant in the
amount of '7 t'. OCO dollars; and
WHEREAS, the CRA has determined that Grantee mects the eligibility requirements and
was approved for a grant award in the amount of ::;; t, , CC C dollars on
JJ. "-IE. '2.. '6 , ;Zed ("CRA Approval").
NOW, THEREFORE, in consideration of the mutual covenants contained herein and
other valuable consideration, the pmties agree as follows:
1. Grantcc acknowledges to the CRA that Grantee has received a copy of the Collier
County Community Redevelopment Agency Commercial Building Improvement Grant Program
Information and Application (hcreinafter referred to as "Grant Program"), that Grantee has read
the Grant Program, and that Grantee has had ample oppOltunity to discuss the Grant Program
with Grantee's counselor advisor. Grantee further acknowledges to the CRA that Grantee
understands and agrees to abide by all of the terms and conditions of the Grant Program. Grantee
agrees to the telms and conditions of the Grant Program.
2. Grantee is the record owner / tenant of propelty described as

3. Grantee has agreed to make certain improvements to the property pursuant to the
grant application submitted to the CRA dated 1.,1\>\,/ L~.. ~~c: /I attached hereto as
Exhibit A and incorporated herein by reference.
4. Grantee agrees to complete the constlUction of the commercial building
improvements within one (I) year of CRA Approval. Grantee also agrees to fund at least 50% of
the costs of the commercial building improvements. Grantee is prohibited from paying

contractors and/or vendors with cash. All payments for approved projects must be in the form of
a check or credit card drawing on funds from Grantee's accounts.

5. The CRA has approved a grant to Grantee in the amount or '30, N C to
be administered pursuant to the terms of this Agreement based on an estimated cost of
." r 04 I "il,,-. .' . If the actual costs are less than $ i~C. c:V to constmct the improvements, the
grant amount shall be reduced dollar for dollar in CRA funds as determined by ratio of matching
private funds required.
6. Unless prior disclosure is included in the grant application, no Grantee, or any
immediate relative of Grantee, shall serve as a contractor or subcontractor for the constmction of
the improvements and no Grantee, or any immediate relative of Grantee, shall receive
compensation for labor for the construction of the improvements. An immediate relative of
Grantee shall include mother, father, brother, sister, son, daughter, aunt, uncle and cousin or
family member by marriage to include mother-in-law, father. in-law. brother-in-law and sister-in-
law. Grantee has verified that all contractors who have provided bids for the approved work are
actively licensed by Collier County. Grantee acknowledges that the total grant award shall not
exceed the sum of lowest bids/price quotes for all projects. Grant funds for work performed by
contractors shall only be disbursed upon verification that said contractors are actively licensed by
Collier County.
7. Grantee agrees to obtain all necessary permits and submit any required plans to
the County's Growth Management Division. Upon completion of the work, Grantee shall
submit to the CRA staff a Project Summary Repmt, two (2) 8 inch by 10 inch photos showing
the improvements, a list of materials and construction techniques used, a list of architects and/or
contractors, and any other information specific to the project or requested by the CRA staff.
The CRA, through its staff, shall confirm that the Commercial Building Improvements were
constructed pursuant to the tenus of the application approved by thc CRA.
8. Within forty-five (45) days after confinuation that the improvements were
constructed pursuant to the terms of the approved application, the Grantee shall be issued a check
in the amount of the grant. However, if the Grantee fails to make the improvements pursuant to
the temlS of the approved application, or if the improvements arc not completed within one (1)
year of CRA approval, , the grant shall be deemed revoked and Grantee shall not be entitled to
funding.
9. This Agreement shall be governed and construed pursmmt to the laws of the State
of Florida.
10. This Agrecmcnt contains the entire agreement of the parties and their
representatives and agents, and incOllJorates all prior understandings, whether oral or written.
No change, modification or amendment, or any representation, promise or condition, or any
waiver, to this Agreement shall be binding unless in writing and signed by a duly authorized
officer of the party to be charged.
II. This Agreement is personal to Grantee. and may not be assigned or transfened by
Grantee or to Grantee's respective heirs, personal representatives, successors or assigns without
the prior written consent of the eRA.
