EXECUTIVE SUMMARY This is a recommendation to approve for recording the final plat of Vita Tuscana, approval of the standard form Construction and Maintenance Agreement and approval of the amount of the performance security. OBJECTIVE: To approve for recording the final plat of Vita Tuscana, a subdivision oflands located in Section 21, Township 48 South, Range 26 East, Collier County, Florida, following the altemative procedure for approval of subdivision plats pursuant to Resolution 99-199. CONSIDERA TIONS: Land Development Services Department has completed the review of the construction drawings, specifications, and final plat of Vita Tuscana. These documents are in compliance with the County Land Development Code and Florida State Statute No. 177. All fees have been paid. Security in the amount of 10% of the total cost of the required improvements, and 100% of the cost of any remaining improvements, together with a Constmction and Maintenance Agreement for Subdivision Improvements, shall be provided and accepted by the Director of Land Development Services and the County Attorney's office prior to the recording of the final plat. This would he in conformance with the County Land Development Code -- Section 10.02.04. Land Development Services Department recommends that the final plat of Vita Tuscana be approved for recording. FISCAL IMPACT: The project cost is $2,018,580.80 (estimated) to be bome by the developer. A copy of the Engineer's Opinion of Probable Cost (OPC) is attached. The cost hreakdown is as follows: a) Water & Sewer $ 656,516.25 b) Drainage, Paving, Grading $1.362.064.55 The Security amount, equal to 110% of the project cost, is $1,220,438.88 The County will realize revenues as follows: Fund: Gro\\th Management Fund 13 I Agency: County Manager Cost Center: 138317 -- Land Development Services Revenue generated by this project: Total: $61,876.42 Fees are based on a construction estimate 01'$2,018,580.80 and were paid in December. 10 I 0 and March 10 I I. This item requires a majority vote. This item is ready for Board consideration and approval. STW GROWTH MANAGEMENT IMPACT: The developer must receive a Certificate of Adequate Public Facilities prior to the issuance of the construction plan final approval letter. RECOMMENDA nON: That the Board of County Commissioners endorse staff's recommendation to approve the final plat of Vita Tuscana for recording with the following stipulations: 1. Approve the amount of $2,220,438.88 as performance security for the required improvements; or such lesser amount based on work completed, and as is approved by the Land Development Services Department. 2. Approve the standard form Construction and Maintcnance Agreement and direct the County Manager or his designee: a. To withhold Certificates of Occupancy until the required improvements have received preliminary acceptance. b. To delay recording of the plat until suitable security and an appropriate Construction and Maintenance Agreement is approved and accepted by the Director of Land Development Services and the County Attomcy's office.
