Agenda 07/10/2018 Item #16E 307/10/2018 EXECUTIVE SUMMARY Recommendation to approve the purchase of Group Life insurance, Accidental Death insurance, Long Term Disability insurance, Short Term Disability Claims and Family Medical Leave Act Administration Services (Agreement #18-7409) from Reliance Standard/Matrix Absence Management, Inc., for a three-year period effective January 1, 2019, in the estimated annual amount of $670,994. OBJECTIVE: To provide a competitive, best value Group Life and Disability insurance program as part of the County’s comprehensive group insurance package and administer the County’s self -insured Short- Term Disability, Family Medical Leave (FMLA) and Medical Leave of Absence (MLOA) programs. CONSIDERATIONS: The Collier County Board of Commissioners through the Risk Management Division administers a Group Insurance Program for its eligible employees and participating constitutional officer employees. As part of this program, the County provides two times salary life and accidental death insurance and a 40% short and long-term disability benefit. Employees can purchase additional short and long-term disability coverage up to a maximum benefit of 66 2/3% of salary (a 26 2/3% buy-up benefit). The short-term disability benefit is self-funded. All other benefits are fully insured. Employees may also purchase additional voluntary life and accidental death coverage on themselves and their dependents. Due to the nature of disability claims, the life insurance, long term disability insurance and short-term disability administration programs must be integrated and purchased from the carrier chosen. The County currently administers the requirements of the Family Medical Leave Act (FMLA) in-house. The FMLA is a federal law that guarantees certain employees up to 12 workweeks of unpaid leave in any 12-month period for various specified purposes with the right for the employee to return to the same or an equivalent position after returning from FMLA leave. FMLA also requires that employers covered by the law maintain the health benefits of eligible workers just as if they were working. The law requires consistent and close administration with the County’s sick leave bank and disability programs. The law also imposes significant financial penalties if the requirements of the Act are not followed. As Federal and State leave requirements have become more complex, the Risk Management Division, Human Resources and Willis Towers Watson, the County’s benefits brokerage and actuarial firm, believe there is considerable risk in continuing to administer the requirements of these laws internally. Therefore, in conjunction with the marketing of the group insurance programs noted above, terms were obtained from the disability insurers to administer FMLA ensuring compliance with state and federal regulations; reducing the risk of violations of law; securing protected health information; and ensuring that leave requests are valid. The current Group Life and Disability program is underwritten by Aetna and expires on December 31, 2018. In anticipation of this expiration, Willis Towers Watson marketed the program and received proposals from nine carriers including the incumbent, Aetna. After reviewing the terms and pricing of each proposal received, the list was narrowed to three carriers that provided the most competitive financial terms. Aetna was eliminated from the group due to a pricing increase of 50%, making them uncompetitive. All three carriers guaranteed rates for three years. The table below shows the price terms quoted. Although there was a marginal $3,738 annual difference in cost between Reliance Standard Life Insurance Company and the lowest carrier (The Standard), staff unanimously recommended Reliance Standard Life due to their proven service record and experience with the carrier. The absence and disability management services quoted by Reliance Standard Life Insurance Company will be administered and managed by its sister company Matrix Absence Management, Inc., as set forth in the attached Agreement. The program will commence effective January 1, 2019. FISCAL IMPACT: The total estimated annual cost of the Group Life, Disability insurance program, FMLA and MLOA Administration is $670,994 based upon current reportable payroll. The estimated additional annual cost to the Board is $118,986, which represents a rate increase due to experience of $67,535 and costs for FMLA and MLOA services of $51,451. There are sufficient funds available in Fund 517, Group Health and Life, for this purchase. GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this item. LEGAL CONSIDERATIONS: This item is approved as to form and legality, and requires majority vote for Board approval. -SRT RECOMMENDATION: To approve the purchase of Group Life insurance, Long Term Disability insurance, Short Term Disability Administration Services, and Accidental Death Insurance and FMLA and MLOA Administration from Reliance Standard/Matrix Absence Management, Inc., as outlined in the executive summary, and authorize the Chairman to execute the attached agreement. Additional Considerations Please address the following in your proposal and questionnaire.  Employees are required to use all PTO prior to the onset of STD. This is an issue with their current STD carrier. Customized Leave Packets and Next Steps We see our services as an extension of your human resources department. Our goal is to relieve your staff of the burden of the administrative tasks related to employee leaves. One way we accomplish this goal is to customize the leave packet to meet the unique employee benefit goals and objectives of Collier County Government. Our standard procedure is to be in contact with the employer, the employee and the provider, during the first business day of a reported absence.  At event reporting, the employee provides a summary of the incident  The employees customized leave packet is sent within 24 hours.  A client checklist which outlines the employee’s roles and responsibilities is included in the packet, along with a medical certification form and expected time line.  Each packet is customized to include any other forms, documents, and letters required by Collier County Government. Triage Immediately upon completion of the intake interview, all claims are subject to our automated duration review process. Using industry guidelines and standards based on diagnostic information and expected duration; claims are reviewed and assigned to resources based on complexity. In addition, we can use Collier County Government- specific criteria to determine which additional cases go to your dedicated in-house nurse case manager. Clinical Case Management – Medical Director Model An automated duration review system completes initial screening of cases. Our processes allow us to identify patterns of utilization, which are outside the prescribed certification times. No leave will be approved without a certification that supports the time off. All intermittent leaves are reviewed every 60 days to analyze day of the week and other patterns that could go undetected. Your dedicated claim examiner will personally intervene to encourage your employees to schedule appointments outside of working hours and make a timely return-to-work. Our claim technology has the ability to identify potential abuse of FMLA leave. We also will report quantitative and qualitative impact of the program to you on at least an annual basis. We would typically require additional information to ensure no disruption to your employees Takeover Existing FMLA Claims We can at your option take over and seamlessly continue the management of employees currently on leave. We have the ability to take over historical data and usually recommend at least 24 months of data. STD Appeal Matrix will agree to assist the client with denied claims on appeal. This will include one written recommendation to the client based on the information available within the timeframes specified within the ASO agreement. Banking Services Matrix establishes a unique bank account on behalf of the client that does not commingle funds with any other bank accounts. Arrangements for reimbursement of claim monies must be in place whereby Matrix is reimbursed for the claims monies paid out on the client’s behalf. These arrangements are established at the inception of the program, based on the client’s preferred method of reimbursement (ACH Credit or ACH Debit) and frequency of reimbursement (usually Monthly) to adequately fund claim liabilities. Matrix requires a pre-funding amount to cover the maximum expected claim payments issued during your selected reimbursement period. Payroll Services Matrix will ensure the withholding of Federal income taxes, Social Security taxes, and Medicare taxes for disability payments if Matrix is issuing checks on ASO business. The taxes and W2s are handled under Matrix’s FEIN. ACH Credit/ACH Debit With ACH Credit the client funds, or reimburses, the bank account for the amount of claims paid out under the ASO/STD plan through a wire transfer or other Electronic Funds Transfer of the required funds. With ACH Debit, the client grants Matrix permission to fund, or reimburse, the bank account for the amount of claims paid out under the ASO/STD plan by having Matrix draw from a specific designated client-owned account. Benefit Deduction Services A client-selected service which allows employee benefit deductions to be taken from disability benefit checks, with the exception of 401(k) or other pre-tax withholding. Additional LOA Tracking In addition to FMLA administration, we have the ability to track and manage Jury, Bereavement, Military, Personal, and Medical Leaves.
