EXECUTIVE SUMMARY
Recommendation to approve and authorize the Chairman to sign the Application and Notice of
Interest - Electronic Lien and Title Process form for the administration of the State Housing
Initiatives Partnership (SHIP) Program Demolition and/or Replacement of Manufactured Housing.
OBJECTIVE: To continue to promote affordable housing strategies for low- to moderate-income
persons through the SHIP Program.
CONSIDERATIONS: The William E. Sadowski Affordable Housing Act provides funding to local
communities to promote and advance affordable housing initiatives. Funds are generated through
documentary stamp tax on real estate transactions. Under the SHIP Program, Collier County and the City
of Naples receive funds from the State of Florida through the Florida Housing Finance Corporation to
undertake eligible activities.
On May 8, 2018, Agenda Item 16D8, the Board of County Commissioners (Board) approved subrecipient
Agreements with LeeCorp Homes Inc. and Prestige Home Centers, Inc. for the demolition and
replacement of site built manufactured housing strategy. The strategy allows the County to use SHIP
Funds for the demolition and/or replacement of manufactured/mobile housing. The County ensures its
interest in the property through a Note & Mortgage on the real property, and by placing a lien on the title
to the manufactured home unit.
According to an Information Advisory from the Florida Department of Highway Safety and Motor
Vehicles (DHSMV), House Bill 1223 requires all individuals and businesses that finance vehicles, vessels,
or manufactured homes to be titled in Florida, must be electronically connected with DHSMV in order to
perfect liens and receive titles. The establishment of that connection requires the execution of Form
HSMV 82150 Application and Notice of Interest - Electronic Lien and Title Process (ELT).
To properly secure the County’s interest in each assisted housing unit, it is necessary for the County to be
recognized as an established ELT entity. Upon completion of assistance, each housing unit assisted will
carry a note, a mortgage on the real property, and a title lien on the manufactured housing unit. Form
HSMV 82150 need only be filed once to protect the County's interest for the demolition and replacement
of site built manufactured housing strategy .
FISCAL IMPACT: The funding source for this grant is Florida Housing Finance Corporation. Funds are
budgeted in the SHIP Grant Fund (791), Project Nos. 33467 and 33525.
LEGAL CONSIDERATIONS: This Item has been approved for form and legality and requires a
majority vote for Board approval. - JAB
GROWTH MANAGEMENT IMPACT: Execution of this form will help facilitate the County’s goal to
expand affordable housing for its citizens and further the goals of the Housing Element of the C ollier
County Growth Management Plan.
RECOMMENDATION: To approve and authorize the Chairman to sign the Application and Notice of
Interest - Electronic Lien and Title Process form for the administration of the Demolition and/or
Replacement of Manufactured Housing.
