EXECUTIVE SUMMARY
Recommendation to approve a Release of Lien to combine release of four (4) separate liens for a
combined amount of $26,619.72 for properties developed by Habitat for Humanity of Collier
County, Inc. that have remained affordable for the required 15-year period set forth in the State
Housing Initiatives Partnership (SHIP) Impact Fee Program.
OBJECTIVE: To support the affordability of housing in Collier County through the SHIP Impact Fee
Program.
CONSIDERATIONS: Under the prior impact fee waiver and deferral program provided by the
individual impact fee ordinances, prior to consolidation, the County deferred or waived the payment of
the impact fees for certain new owner-occupied unit which qualified as “affordable housing.”
On August 3, 1999, Agenda Item 16A15, the Board of County Commissioners (Board) approved the
waiver of Impact Fees for homes to be built by Habitat for Humanity of Collier County Inc. in Naples
Manor.
On February 8, 2000, Agenda Item 16A7, the Board approved the waiver of Impact Fees for one of the
homes to be built by Habitat for Humanity of Collier County Inc, with the same legal description as one
of the homes with a waiver of Impact Fees from August 3, 1999, Item 16A15.
On July 25, 1995, Agenda Item 16A5, the Board approved the waiver of Impact Fees for homes to be
built by Immokalee Habitat for Humanity in Naples Manor.
On June 23, 1998, Agenda Item 16A7, the Board approved the waiver of Impact Fees for one of the
homes to be built by Habitat for Humanity of Collier County Inc with the same legal description as one of
the homes with a waiver of Impact Frees from July 25, 1995, Item 16A5.
The SHIP Program paid the required impact fees in full to the County on behalf of the SHIP applicants
for the aforementioned homes. Repayment was required if the property sold, refinanced, or was no longer
their primary residence during the 15-year period after the issuance of the certificate of occupancy. A
duplication of legal descriptions has two Impact Fee Agreements recorded against each of the properties.
Approval of these items will authorize the Chairman to sign the aforementioned Release of Lien, and the
executed document shall be recorded in the Public Records of Collier County, Florida at the cost of the
County.
The following table provides details regarding Habitat for Humanity of Collier County, Inc. and the
associated liens that have met their 15-year affordable housing obligation. As such, a Release of Lien is
required and the duplicate Impact Fee Agreements on the below properties released in order to clear the
title.
