PVAC Minutes 10/04/2004 R October 4, 2004 TRANSCRIPT OF THE MEETING OF THE COLLIER COUNTY PUBLIC VEHICLE ADVISORY COMMITTEE Naples, Florida, October 4, 2004 LET IT BE REMEMBERED, that the Collier County Public Vehic1e Advisory Committee in and for the County of Collier, having conducted business herein, met on this date at 9:30 AM in REGULAR SESSION at the Collier County Community Development Services Building, 2800 N. Discussion: Randy Smith Would like to discuss the following: (a) Workers compensation insurance that companies we approved with 5 Or more employees are supposed to have. The meeting was called to order by Vice Chairman Allen Walburn at 9:30 AM. Election of New Officers will be held next month. Roll Call was taken and a quorum established. II. Additions or Deletions: It was noted Tony Marino was excused from the August meeting. III. Approval of Agenda: Remove (2) from VI. New Business as they withdrew their application. Russ Berghuis moved to approve the Agenda as amended. Second by Randy Smith. Carried unanimously 5-0. IV. Approval of Minutes: August 2, 2004 Tony Marino moved to approve the minutes of August 2, 2004. Second by Russ Berghuis. Carried unanimously 5-0. Janet Powers will get a copy of the complaint report passed out at the August meeting to Randy Smith as he was not in attendance. V. Notices: Russ Berghuis moved to elect new officers at the November meeting. Second by Mike Marino. Carried unanimously 5-0. The new member appointees are: Russell Berghuis, Randy Smith and Tony Marino. There is one opening for an alternate and is being advertised. VI. New Business: New Applications (1) Doino Classic Transportation, Inc., formally Classic Taxi. New Owner: Ronald J. Doino Jr., of Marco Island The transfer of the decals depends upon the nature ofthe sale and subject to renewal in January. An occupational license will be in their name. The "Class" is verified when reviewed. Randy Smith moved to approve the application for Doino Classic Transportation. Second by Allen Walburn. Carried unanimously 5-0. (2) Rogers Limo Service Inc. of Falcons Glen Blvd., Naples. Owner: Roger Ernest Holmes Allen mentioned several things were not checked off on the application concerning Credit References etc. Janet responded they are now submitted. The Insurance Policy limits were questioned. It was thought $300,000 is the limit in the State. Janet stated it is a binder and when they have a small operation, sometimes the applicant doesn't want to expend the monies unless they are approved first. Everything else is in place. Allen Walburn moved Rogers Limo Service be issued an Occupational License if he presents the County with the Insurance that meets the criteria 2 October 4,2004 of the Ordinance. Until the Certificate of Insurance is submitted he is not allowed to operate. Second by Mike Marino. Carried unanimously 5-0. (Michelle Arnold arrived at 9:43 AM) VII. Hearing: None VIII. Old Business: None IX. Complaint Report: John Marsh handed out the complaint report. (Attached) · Approx. 20-22 complaints - 16 closed · Some cases open with monitoring · 125 vehicles checked - ID/VIN #'s and Driver ill's · Have 66 companies and 408 vehicles with 730 drivers. X. Discussion: Randy Smith would like to discuss the following: (a) Workers Compensation Insurance that companies we approved with 5 or more Employees are supposed to have: (Most don't) These are 3 subjects he has been approached with from the trade and would like input fTom the Committee. Companies are to carry Workers Comp for their employees and have been told some don't. He wondered if they need to prove they have Workers Compensation and if it should be included to the applications to be permitted and for renewals. Discussion followed on Independent Contractors and the Committee asked the County Attorney to research the subject since it seems to be a grey area. Randy did state the Sedan, Van and Limo drivers do need Workers Comp if they are an employee. If they are leasing the vehicle it does not apply. He doesn't know about Taxis'. Mr. Zachary - Assistant County Attorney mentioned the Workers Comp changed this year and he will research it for the next meeting. (b) Number of Permitted vehicles in Collier County per population: Randy mentioned capping vehicles per population. It was noted the population changes during the year. Randy explained some of the companies that have been here year after year and then during season to have companies here on a part-time basis, hurts those year-around companIes. Allen mentioned it is called limited-entry. They are then getting into restrain of free trade. They may consider raising the application fees. He wouldn't support limiting. He didn't think the County Commission would support it. Discussion followed on more stringent rules, raising permit fees, or the initial fees being raised. 3 ---.,.----.""'.- October 4, 2004 (c) Changing the Renewal Process: Randy suggested staff go to the facilities for the renewal applications and stickers for a fee from the company. A fee schedule would need to be worked out and adopted by the BCC. This would save the owner time and money to pay a driver going to the County. January is a busy time of the year and would take 2 or 3 days before they could get all their vehicles to the County. He suggested a flat fee. They discussed setting up an appointment so the vehicles are there, paperwork sent in before appt., opportunity of staff seeing all the vehicles, doing inspection and the option of owner still going into the County for their stickers. Michelle Arnold stated they can look into the situation and would have to make sure they have staff available. She would have to look at costs for employee's time and research a fee etc. A base or flat fee was suggested. XI. Announcements: The meetings are scheduled for the 1st Monday of each Month unless there are no applications or Agenda items. Next meeting is scheduled for Monday, November 1, at 9:30 AM.
