EXECUTIVE SUMMARY
This item requires that ex parte disclosure be provided by Commission members. Should a hearing
be held on this item, all participants are required to be sworn in. CU-PL2010-1949, Hitching Post,
A Resolution of the Board of Zoning Appeals of Collier County, Florida, providing for the
establishment of a Conditional Use to allow a coin operated amusement arcade within a C-3 Zoning
District pursuant to Subsection 2.03.03.C.1.c.4 of the Collier County Land Development Code for
property located in Section 33, Township 50 South, Range 26 East, Collier County, Florida..
OBJECTIVE:
To have the Board of Zoning Appeals (BZA) consider an application for Conditional Use to
allow a coin operated amusement arcade in the Commercial Intermediate (C-3) Zoning District
to allow a Coin-Operated amusement arcade, as specified in Section 2.03.03.C.1.cA of the
Collier County Land Development Code (LDC); and to insure that the community's interests are
maintained.
CONSIDERA TIONS:
The purpose of this petition is to obtain a Conditional Use approval to allow existing Coin-
Operated Amusement Devices to continue to operate at the Hitching Post Shopping Plaza, which
is located in the C-3 zoning district. Coin-Operated Amusement Devices have a Standard
Industrial Classification (SIC) number 7993. The land use is listed as a permitted use in the C-4
and C-5 zoning districts and as a Conditional Use in the C-3 zoning district.
The proposed use is subject to Florida Statute Section 849-161. The subject Coin-Operated
Amusement Devices have game machines into which players insert cash, a credit card or game
card that is purchased from the merchant. Player's who win may redeem winning points for
merchandise only. (That is, in accordance with Florida Statute Section 849-161, a player cannot
win cash).
The subject Coin-Operated Amusement Devices have been operating at this location since
autumn of2010. According to the Application, the business operating hours are 7 days per week
with proposed hours from 9:00 a.m. to 1 :00 a.m. The establishment is limited to adults who are
age 21 and over. The business is currently the subject of a Code Enforcement Case,
CEOCC2010002l455. (See Attachment A: Code Case Details) which resulted in the property
owner submitting this Conditional Use application.
FISCAL IMPACT:
Approval of the Conditional Use, in and of itself, would have no fiscal impact on Collier County.
There is no guarantee that the project, at build out, would maximize its authorized level of
development, however, if the use were approved, a portion of the existing land would be
developed and the new development would result in an impact on Collier County public
faciEties.

The County collects impact fees prior to the issuance of building permits to help offset the
impacts of each new development on public facilities. These impact fees are used to fund
projects identified in the Capital Improvement Element of the Growth Management Plan as
needed to maintain adopted Level of Service (LOS) for public facilities. Additionally, in order to
meet the requirements of concurrency management, the developer of every local development
order approved by Collier County is required to pay a portion of the estimated Transportation
Impact Fees associated with the project in accordance with Chapter 74 of the Collier County
Code of Laws and Ordinances. Other fees collected prior to issuance of a building permit include
building permit review fees. Please note that impact fees and taxes collected were not included
in the criteria used by staff and the Planning Commission to analyze this petition.
GROWTH MANAGEMENT PLAN (GMP) IMP ACT:
Future Land Use Element (FLUE): The subject property has a Future Land Use designation of
Urban Mixed Use District, Urban Coastal Fringe Subdistrict. The purpose of the Urban Coastal
Fringe Subdistrict is to provide transitional densities between the Conservation designated area
primarily located to the south of the subdistrict, with the remaining urban designated area located
to the north of the subdistrict.
The property is further depicted on map FLUE-II, Existing Zoning Consistent with FLUE by
Policy 5.9,5.10,5.11 and 5.12 of the Future Land Use Element. As such, FLUE policies under
Objective 5 allow development and re-development per the property's existing zoning
designation.
In addition, the subject site is located within the existing "Hitching Post Center" and the
Conditional Use may be considered an allowable use per Land Development Code (LDC)
Section 2.03.03 of the existing C-3 zoning district, and per SIC number 7993. No changes are
being proposed.
Based on the above analysis, staff finds the requested conditional uses consistent with the Future
Land Use Element of the Gwwth Management Plan.
ENVIRONMENTAL ADVISORY COUNCIL iliAC) RECOMMENDATION:
Pursuant to the Code of Laws and Ordinances, Chapter 2, Article VIII, Division 23, Section 2-
1193 (m)(5), the EAC did not review this petition because the site is less than ten acres and is not
in a Special Treatment (ST) area or an Area of Critical State Concem (ACSC).
COLLIER COUNTY PLANNING COMMISSION (CCPC) RECOMMENDATION:
The CCPC heard petition CU-PL2010-1949 on May 5, 2010, and by a vote of 9 to 0
recommended to forward this petition to the Board of Zoning Appeals (BZA) with a
recommendation of approval subject to the following Staff conditions of approval:

1. The Conditional Use approval is subject to the removal of the dead hedge material from the
Type D right-of-way landscape buffer along Tamiami Trail East (US 41). The dead hedge
material shall be replanted with 3-gallon, 18-24 inch height plant material.
2. The hours of operation are limited to 9:00 a.m. to 1 :00 a.m.
The CCPC added a third condition of approval which states:

LEGAL CONSIDERATIONS:
Before you is a recommendation by the Planning Commission for approval of a conditional use
authorizing a coin operated amusement arcade in the C-3 zoning district. A conditional use is a
use that is permitted in a particular zoning district subject to certain restrictions. All testimony
given must be under oath. The attached report and recommendations of the Planning
Commission required are advisory only and are not binding on you. Petitioner has the burden of
demonstrating that the necessary requirements have been met, and you may question Petitioner,
or staff, to satisfy yourself that the necessary criteria has been satisfied. In addition to meeting
the necessary criteria, you may place such conditions and safeguards as you deem appropriate to
allow the use, provided that there is competent, substantial evidence that these additional
conditions and safeguards are necessary to promote the public health, safety, welfare, morals,
order, comfort, convenience, appearance, or the general welfare of the neighborhood. As a
further condition of approval of the conditional use, you may require that suitable areas for
streets, public rights-of-way, schools, parks, and other public facilities be set aside, improved,
and/or dedicated for public use, subject to appropriate impact fee credits. Approval or denial of
the Petition is by Resolution. The proposed Resolution was prepared by the County Attomey's
Office and is legally sufficient for Board action. An affirmative vote of four is required for
Board approval. (STW)
RECOMMENDATION:
Staff recommends that the BCC approve CU-PL2010-1949, consistent with the CCPC
stipulations and as drafted in the attached resolution.

During aJ site inspection of this facility, Staff observed that the patrons had the potential to accrue
points arid win merchandise such as restaurant gift cards, retail gift cards, an American Express
gift cardJ and gasoline gift cards. There are no cash winnings at the subject property.

The subject Coin-Operated Amusement Devices have been operating at this location since
autumn ~f 2010. According to the Application, the business operating hours are 7 days per week
with proposed hours from 9:00 a.m. to 1 :00 a.In. The establishment is limited to adults who are
age 21 iand over. The business is currently the subject of a Code Enforcement Case,
CEOCC20100021455. (See Attachment A: Code Case Details) which resulted in the property
owner si1:bmitting this Conditional Use application.
Aerial P~oto records indicate that the Hitching Post Plaza has been in existence since 1985. The
shopping center is located on the southwest comer of Barefoot Williams Road and Tamiami
Trail Ea~t (US 41). The subject site is an approximately 5 acre site with 46,600 square feet of
commerqial space. The Coin-Operated Amusement Devices are located in a central tenant space
in the s~p shopping center. The required parking of 187 spaces will be met by the 222 existing
parking $paces. Vehicular access is provided by two access points on Tamiami Trail East (US
41) and along the Barefoot Williams Road frontage.
There is existing landscaping along Tamiami Trail East (US 41) and along the west property line. .
There is! dead hedge material in the landscape buffer along Tamiami Trail East, and the
replace1I\ent of the dead hedges has been made a condition of approvaL There is no existing
landscaping along Barefoot Williams Road as there are existing parking spaces that are accessed
off of Bdrefoot Williams Road. There is also no landscape buffer along the rear property line as
the prop~rty line runs through the middle of the alley. (See Site Plan on previous page and

ANALYSIS:
Before any Conditional Use recommendation can be offered to the Board of Zoning Appeals
(BZA), the Collier County Planning Commission (CCPC) must make findings that: 1) approval
of the Conditional Use will not adversely affect the public interest and will not adversely affect
other pr~perty of uses in the same district of the neighborhood; and 2) all specific requirements
for the ~dividual Conditional Use will be met; and 3) satisfactory provisions have been made
concemirg the following matters, where applicable:
1. Sectj,on 2.03.03 C.l.c.4., of the LDC permits Conditional Uses in the Commercial
Inte~mediate (C-3) zoning district.

The requested use for Coin-Operated Amusement Devices are permitted as conditional uses
in th~ Commercial Intermediate (C-3) zoning district, subject to the standards and procedures .
estab~shed in section 10.08.00, conditional uses procedures, of the LDC.

and ~ccess in case of fire or catastrophe.

Existing ingress and egress to the subject property is provided by two points along Tamiami
Trail lEast (US 41) and along the Barefoot Williams Road street frontage. There is a service
alleyjadjacent to the rear property line. There is a sidewalk along Tamiami Trail East (US
41) ap.d a covered walkway along the front of the stores.

As pteviously stated, the Coin-Operated Amusement Devices have been in existence since

econ0mic or noise effects. This is because activities at the subject property are generally

If approved, the Conditional Use for Coin-Operated Amusement Devices that have been in
existence for the past 6 months should have minimal impact on neighboring properties in
relation to glare, economic or noise effects.
5. Compatibility with adjacent properties and other property in the district.
This strip shopping center has been in existence for nearly 30 years and the Coin-Operated
Amusement Devices have been in existence for the past 6 months. As stated previously,
there has been one complaint in addition to the Code Enforcement Case.
Based on the above fmdings, this conditional use is recommended for approval.
ENVIRONMENTAL ADVISORY COUNCIL (RAC) RECOMMENDATION:
The EAC did not review this petition because the site is under the size threshold (10 acres) to
require an Environmental Impact Statement.
NEIGHBORHOOD INFORMATION l\1EETING (NIM):
The applicant duly noticed and held the required meeting on April 4, 2011, at 5:30 p.m. at the
Hitching Post Plaza, located at 11500 Tamiami Trail East, Naples, Florida. Approximately 10
people along with the applicant and County Staff attended the meeting. No complaints were
received from any of the neighbors at this meeting.
The meeting ended at approximately 6:00 p.m. For further information, please refer to
Attachment B: NIM Minutes.
COUNTY ATTORNEY OFFICE REVIEW:
The County Attorney Office has reviewed the staff report for CU-PL201O-1949 revised on April,
13, 2011.
RECOMMENDATION:
Staff recommends that the Collier County Planning Commissipn (CCPC) forward Petition CU-
PL2010-1949 to the Board of Zoning Appeals (BZA) with a recommendation of approval
subject to the following conditions:
1. The Conditional Use approval is subject to the removal of the dead hedge material from
the Type D right-of way landscape buffer along Tamiami Trail East (US 41). The dead

location.
I made a site visit on 12-2-2010 and observed
Palace Games is open and operating. I met
with Christopher Shucart, the building owner,
who stated that he is in the process of
applying for a Conditional Use and has been
working with Claudine Auclair. I explained to
him that the business cannot operate until
they have a current business tax license and
a zoning certificate and must close until then. I
am following up with Claudine Auclair and
Christine Willoughby

Attorney) infonned them that if they continue
to operate the business prior to obtaining the
tax license and zoning certificate it would be
at their own risk and subject to fines which
may imposed by the Code Enforcement
Board.

trafJ:ic signal at Barefoot Williams Rd and US 41.
Reakon for meeting is to discuss a c'onditional use that will be presented to the board of
COl~ty Commissioners on June 28th. A resolution of the Board of Zoning Appeals of
Collier County, Florida, providing for the establishment of a Conditional Use to allow a
com operated amusement arcade within a C-3 Zoning District.

Man asks question about age limitations. He has some concerns about the age group that
miglIt go to the arcade. Christopher stated that he believes the minimum age is 21.
Cb;istopher also stated that even with a minimum age of 21 the majority of all patrons are
mid~le aged to seniors. A lady in the audience concurred with Christopher's statement

Coniunissioner Fiala asked how the people felt. Received positive feedback. Some people
saidithey just really wanted to know what this was about. No one was opposed to the

A q~estion is asked if the games are slot machines and was told no, they are video games.

N~by explains there are two upcoming hearings. One for the BOCC in June and one on
May 5th for CCPC.

MJ. asks if the CU Approvals is a done deal because the tenant had told him that he was
plmfumg to expand his unit and had a few questions about this expansion. Was told no
the ~U approval was not a done deal and both Christopher and Nancy stated that doing
the ~provements was taking a risk if the CD does not get approved. A building permit
was !issued for the proposed expansion/work.

CodF enforcement case was brought up. It's about operating a business that's not
alloyved. Businesses like Palace Games cannot operate in the current zoning district
witq.out having a Conditional Use and that the case remains open until the CD is
app-*>ved.

Christopher advised the attendees that the way they are trying to get a Conditional Use is
not the normal way. Going this way because he thought the tenant had put the proper
proqedures in place, but found out after the fact there were miscommunications and
mis~derstandings between the Tenant and County Staff therefore Christopher is
invdlved in the process now to make sure everything is done the right way.

Applicant must conduct at least one Neighborhood Informational Meeting (NIM) after initial
staff review and comment on the application and before the Public Hearing is scheduled with
thei Planning Commission.

W~itten notice of the meeting sholl be sent to all property owners who are required to receive
legpl notification from the County pursuant to Section 10.03.05.8.8.

Notification sholl also be sent to property owners, condominium and civic associations whose
metnbers are impacted by the proposed land use change and who hove formally requested
thei County to be notified. ~
A ~py of the list of 011 parties noticed, and the date, time, and location of the meeting, must
be ifumished to the Land Dev~lopment Services Deportment and the Office of the Boord of
Co*nty Commissioners no less than ten (l 0) days prior to the scheduled dote of the NIM.
Th~ applicant must make arrangements for the location of the meeting. The location must be .
reqsonably convenient to those property owners who are required to receive notice and the
fa~lities must be of sufficient size to accommodate expected attendance.

Th~ applicant must place an advertisement of the meeting in that portion of the newspaper
wh~re legai' notices and classified advertisements appear stating the purpose, location, time
of the meeting and legible site location mop of the property for which the zoning change is
be1rg requested. The display advertisement must be one-fourth page, in type no smaller than
1 21 point and must be placed within a newspaper of general circulation in the. County at least
se~en {7} days prior to, but no sooner than five (5) days before, the NIM.
ThJ Collier County staff planner assigned to the project must attend the NIM and shall serve
as ~e facilitator of the meeting; however, the applicant is expected to make a presentation
of ~ow jf intends to develop the subject property.

Th~ applicant is required to audio or video tape the proceedings of the meeting and provide
a c;opy to the Land Development Services Deportment.
i
As:a result of mandated meetings with the public, any commitments made by the applicant
shqll be reduced to writing and made a port of the record of the proceedings provided to the
larid Development Services Department. These written commitments will be made a port of
th~ stoff report of the County's review and approval bodies and mode 0 part of the
corisideration for inclusion in the conditions of approval.

COIN OPERATED AMUSEMENT ARCADE WITHIN A C-3
ZONING DISTRICT PURSUANT 'TO SUBSECTION
2.03.03.C.1.c.4 OF THE COLLIER COUNTY LAND
DEVELOPMENT CODE FOR PROPERTY LOCATED IN
SECTION 33, TOWNSHIP 50 SOUTH, RANGE 26 EAST,
COLLIER COUNTY, FLORIDA.
WHEREAS, the Legislature of the State of Florida in Chapter 67-1246, Laws of Florida,
and Chapter 125, Florida Statutes, has conferred on Collier COlmty the power to establish,
coordinate and enforce zoning and such business regulations as are necessary for the protection
of the public; and
WHEREAS, the County pursuant thereto has adopted a Land Development Code
(Ordinance No. 2004-41, as amended) which includes a Comprehensive Zoning Ordinance
establishing regulations for the zoning of particular geographic divisions of the County, among
which is the granting of Conditional Uses; and
WHEREAS, the Board of Zoning Appeals (Board), being the duly appointed and
constituted planning board for the area hereby affected, has held a public hearing after notice as
in said regulations made and provided, and has considered the advisability of a Conditional Use
of a Coin Operated Amusement Arcade within a C-3 Zoning District pursuant to Subsection
2.03.03.C.1.c.4 of the Collier County Land Development Code 011 the property hereinafter
described, and the Collier County Planning Commission has made findings that the granting of
the Conditional Use will not adversely affect the public interest and the specific requirements
governing the Conditional Use have been met and that satisfactory provision and arrangement
have been made concerning all applicable matters required by said regulations and in accordance
with Subsection 10.08.00.D. of the Land Development Code; and
VlHEREAS, all interested parties have been given opportunity to be heard by this Board
in a public meeting assembled and the Board having considered all matters presented.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ZONING APPEALS
OF COLLIER COUNTY, FLORIDA that:
Petition Number CU..PL2010-1949 filed by Christopher Shucart, representing JCS Realty
Group, LLC, with respect to the property hereinafter described in Exhibit "A", be and the same is
hereby approved for a Conditional Use for a Coin Operated Amusement Arcade within a C-3
Zoning District pursuant to Subsection 2.03.03.C.1.c.4 of the Collier County Land Development

1. The Conditional Use approval is subject to the removal of the dead hedge material from the
Type D right-of way landscape buffer along Tamiami Trail East (US 41). The dead hedge
