EXECUTIVE SUMMARY
Recommendation to approve and ratify Staff's extension of Contract # 06-3969 "Fixed Term
Professional Engineering Services" with Pitman-Hartenstein, Inc. and approval of a time extension
change to Work Order # 4500117579 in order to process the Consultant's final invoice for work
completed for the "Progress Avenue 1 Livingston Road Intersection Improvements."
OBJECTIVE: For the Board to approve and ratify Staff's authorization of a time extension to
an expired work order.
CONSIDERATIONS: Collier County entered into Contract #06-3969 with Pitman-
Hartenstein, Inc., on September 26, 2006, for "Fixed Term Professional Engineering Services."
On May 5, 2010, the County issued Pitman-Hartenstein, Inc. a Notice to Proceed to provide
design and construction inspection services for the Progress Avenue / Livingston Road
Intersection Improvements using Work Order #4500117579. A letter of extension was issued for
an additional 270 days e>..'tending the work order until March 31, 2011. This change order is to
extend the contract time for the work order due to a 3-month delay in the construction phase of
the project, which resulted from the contractor waiting for the delivery of project materials. The
Contract expired on September 25,2010. Work Order #4500117579 was issued while the master
agreement between Collier County and Pitman-Hartenstein, Inc. was still in effect. Staff is
seeking the approval of a change to that Work Order to extend it an additional 90 days. Pitman-
Hartenstein, Inc. continues the work at Staff's request, to the benefit of the County, and staff
recommends approval.
FISCAL IMP ACT: The fiscal impact is estimated at $740.00. These costs are included in the
current work order amount.
GROWTH MANAGEMENT IMP ACT: There is no growth management impact associated
with this Executive Summary.
LEGAL CONSIDERATIONS: The County Attorney is providing an "after the fact" review
of staff's prior e>..'tension of the referenced contract and associated work order. The Board is
authorized to detennine the validity of equitable claims such as quantum meruit and determine
that the relief sought equitably reflects the fair value of the work perfonned and furnished to the
County, for which the County has benefited, and approve and ratify the extension of the contract,
work order and authorize any remaining payment owed to the vendor.
RECOMMENDATION: That the Board approve and ratify Staff's extension of Contract # 06-
3969 "Fixed Term Professional Engineering Services" with Pitman-Hartenstein, Inc. and
approve the change to Work Order # 4500117579 to extend the time an additional 90 days
through and including June 29,2011.
