EXECUTIVE SUMMARY
Recommendation to approve and ratify Staff's extension of Contract # 01~3290 ~~Fixed
Term Professional Engineering Services" with Johnson Engineering, Inc., and approval of
a time extension change to Work Order # JEI-T-3290~06-01 in order to process the
Consultant's final invoice for work completed for the "Rich King Memorial Greenway."
OBJECTIVE: For the Board to approve and ratify Staff's authorization of a time extension to
Contract # 01-3290 and a time extension change to expired Work Order # JEI~T-3290~06-01
issued there under,
CONSIDERATIONS: Collier County entered into Contract #01-3290 with Johnson
Engineering, Inc" on September 10,2002, for "Fixed Term Professional Engineering Services."
On November 7, 2005, the County issued Johnson Engineering, mc" a Notice to Proceed to
provide design plans for the Rich King Memorial Greenway (the "Greenway") using Work
Order #JEI-T-3290-06-01. Subsequently, the County put the Greenway project on hold due to
insufficient funding for construction, which in turn caused the design by Johnson Engineering,
Inc" to be placed on hold, Subsequently, funding for the construction of the Greenway
developed and Johnson Engineering, Inc" was authorized to proceed with the final design.
The plans were further delayed due to changes made necessary by South Florida Water
Management District in order to obtain a General Permit for the project. Additional days were
necessary for the work order because the bidding and construction took longer than first
estimated.
Contract #01-3290 between Collier County and Johnson Engineering, Inc" had not terminated
when staff issued Work Order # JEI-T-3290-06-01. Staff issued two time extension only change
orders to cumulatively extend the Work Order 1,635 days. The most recent staff authorized
change to the Work Order extends the Work Order completion date to April 30, 2011. Johnson
Engineering completed the work required by the Work Order, at Staff's request, to the benefit of
the County, and staff recommends approval. Construction of the Greenway is complete and
currently being used extensively by the residents of Collier County.
FISCAL IMP ACT: The fiscal impact is estimated at $5,300.00. These costs are included in the
current work order amount.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated
with this Executive Summary.
LEGAL CONSIDERATIONS: The County Attorney is providing an "after the fact" review
of staff's prior extension of the referenced contract and associated work order, The Board is
authorized to detennine the validity of equitable claims such as quantum meruit and determine
that the relief sought equitably reflects the fair value of the work performed and furnished to the
County, for which the County has benefited, and approve and ratify the extension of the contract,
associated change to the Work Order and authorize any remaining payment owed to the vendor,

RECOMMENDATION: That the Board approve and ratify Staffs extension of Contract # 01-

authorize payment of any remaining sums owed to the vendor.
