EXECUTIVE SUMMARY
Recommendation to adopt a resolution authorizing the condemnation of those perpetual and
temporary easement interests necessary for the construction of storm water improvements for the
US-41 Ditch segment of the Lely Area Stormwater Improvement Project. (project No. 51101.)
Estimated fiscal impact: $1,927,569.
OBJECTIVE: To adopt a resolution authorizing the condemnation of those perpetual and temporary
easements necessary for the construction of stormwater improvements known as the US-41 Ditch segment of
the Lely Area Storm water Improvement Project. (LASIP.)
CONSIDERATIONS: On March 22nd, 2011 the Board adopted Resolution No. 2011-63, authorizing the
acquisition by gift or purchase of the easement interests necessary for the construction of the US-41 Ditch.
This resolution will authorize the condemnation of these easements.
The Board of County Commissioners has clearly stated its concern over the extreme flooding issues during
the rainy season in the East Naples area. The Lely Area Stormwater Improvement Project has been in the
design and permitting phase for 18 years. During this period, a significant amount of time and effort has
been spent on the analysis of dozens of considerations resulting in LASIP's final alignment. This alignment
is based on the natural overland flow of storm water working in concert with existing wetlands as well as
existing ditches and canals constructed many years ago. The majority of this final alignment is in the same
location as the existing ditches and canals. LA SIP will deepen and widen these existing facilities providing
the ability to drain the abundant stormwater we receive in the rainy season and to retain the limited
stonnwater that falls in the dry season.
The natural direction of sheet flow in the LASIP area is in a generally southwesterly direction toward the
coastal zone and the headwaters of Sandhill and Rookery Bays. Nearly all of the existing conveyance
ditches and public canals previously constructed within the LASIP area since the 1950's have been
"designed" to convey water to the south and to the west. Eighteen years of analysis has revealed that the
most viable approach to construct stormwater improvements within the area is to follow these existing
conveyance alignments. Since the entire LASIP area is virtually at "build-out," any alternative alignment
would have serious negative and costly real estate impacts. The only practical method for increasing
stormwater discharge and alleviating flooding is to improve the capacity of the existing ditches and canals.
The attached map shows the approximate location of the US-41 Ditch easement acquisition area for which
this authorization is being sought. The various easement interests necessary to complete this segment of
LASIP are drainage easements and temporary construction easements. Construction is scheduled for FY
2012. Project scheduling requires that authority be granted for the condemnation of the easement interests
required to complete the project, so as to ensure that construction is not delayed if these parcels are not
acquired in a timely manner by negotiation.
A technical memorandum is attached from Nathan 1. West, P.E., project manager with the firm Atkins
North America, Inc., the consultant engineering firm designing and permitting the project. By its review,
concurrence and approval of this Executive Summary, the back-up documentation, and the proposed
resolution, the Board will have determined that the legal descriptions, and the interest in real property
specified on each legal description attached to the resolution, represent the most feasible location. and are
necessary for the construction of the US-4l Ditch segment of the LASIP proj ect.

FISCAL IMPACT: The cost of acquiring the easements necessary to complete this segment of LASIP is
estimated to be $1.927,569. This amount includes not just the direct cost of all easements required for
construction; it also includes an estimate of severance damages to remaining properties caused as a result of
the part taken to construct the project, as well as all expenses for title work, real estate appraisals, and those
expenses related to condemnation when necessary, such as property owner attorney fees and expert witness
fees, which the County is required to pay according to Sections ~3:091 and 73.092, F.S. To the extent
settlements are achieved in lieu of litigation, this figure may be reduced significantly. All such payments
will be made from the Stonnwater Capital Improvement Fund 325 under the Lely Area Stonnwater
Improvement Project, Project No. 511 01. The balance of funds necessary will be programmed into the
project as the multi-year acquisition effort proceeds. Source of funds is Ad Valorem taxes.
LEGAL CONSIDERATIONS: This item requires a duly noticed public hearing. It is ready for Board
consideration. A majority vote is needed for approvaL - HF AC
GROWTH MANAGEMENT IMPACT: This recommendation is consistent with the County's Growth
Management Plan.
RECOMMENDATION: That the Board of County Commissioners of Collier County:
1. Adopt the attached Resolution;
2. Authorize its Chainnan to execute same on behalf of the Board; and
3. Authorize any budget amendments that may be necessary to implement the collective will of the Board
as evidenced by the adoption of the attached Resolution and the approval of this Executive Summary.

of the I County Attorney to file pleadings in eminent domain as a precursor to the taking of

properiy interests necessary to construct storm water management improvements known as the
I
"US-4~ Ditch & Naples Manor Ditch Enclosure" which is an integral part of the overall Lely
Area ~tormwater Improvement Project (LA~IP). The following pages contain important .
!
inform~tion that the Board of County Commissioners must consider before adopting this
I
resolution.
,
The a~sence of a comprehensive drainage outfall system in the LASIP area while development
!
has 09curred over the years has adversely impacted flood levels as well as water quality.
Available data indicates that water quality is generally good at present but is expected to
i
,
deteriorate unless an improved water management outfall system for the area is developed.
I
!
The L~SIP system, as a whole, will provide a comprehensive stormwater outfall system for an
area or East Naples formerly known as Water Management District #6 which has for years
i
experienced an increasing level of drainage related problems as growth has continued in the area.
I
The drFage area of LASIP consists of about 11,135 acres and consists of two sub-basins known
as theiLely Canal Basin (LCB) system and the Lely Manor Basin (LMB) system. The Lely
Canal iBasin discharges into an estuarine coastal zone along the intercoastal waterway near
Dollar!Bay. The Lely Manor Canal discharges into an estuarine coastal zone near the headwaters

of Sandhill Bay and eventually into Rookery Bay. A description of both the LCB and LMB
systems, the component parts of each system, and how they will work together to alleviate
flooding problems and enhance water quality, follows the considerations that are relevant to the
Board's decision to authorize the condemnation of private property for the construction of the
US-41 Ditch & Naples Manor Ditch Enclosure.
While the Naples Manor Ditch Enclosure proj ect consists of installing and then covering parallel
elliptical pipes in an existing drainage easement, and much of the US-4l Ditch project will be
constructed within the existing Tamiami Trail right-of-way, still new easements will be required
for the construction of a large portion of the US-4l Ditch. Legal descriptions of the proposed
easements are attached to the resolution authorizing condemnation; and before its adoption, the
Board must have given due consideration to the following factors:
1. Alternate Routes.
Alternate alignments and configurations of the LASIP proposed improvements have been
exhaustively analyzed as part of the design and permitting process for the LASIP system. The
US-4l and Naples Manor Ditch portion of the project calls for improvements to existing ditches
and is therefore the most practical location for the improvements resulting in the least amount of
cost and environmental impacts. The proposed easements along US-4l are sized to be just wide
enough to accommodate the required ditch widening and area needed for maintenance and
construction.
There are two main design segments associated with US-4l Ditch and Naples Manor Ditch
Enclosure. The first segment abuts .the east side of US-4l along the commercial property
frontage of Naples Manor. Through this section, it will be necessary to acquire additional
drainage easements on the east of the canal so that the existing ditch may be widened to improve
conveyance and capacity of the flow way. The west side of the canal is constrained by US 41.
The second segment extends east and west along the existing 30 foot easement through Naples
Manor. In this portion of the project, the existing open ditch will be replaced with a closed
drainage system consisting of underground pipe and a stormwater treatment system.

the grbatest extent possible, thereby restricting the need for new right-of-way to the absolute
minimum, while at the same time ensuring that the ditch meets stormwater outfall capacity

requirements.

All in!a1l the project consists of approximately 7,200 linear feet (LF) of open channel and closed
chann~l flow systems along US-4l and within Naples Manor. In addition, the segment of the
,
I
project along US-4l will consist not only of open ditches but approximately 1,900 LF of box
!
culvert and stormwater inlet structures as well.

2. Sa~ety Factors
Construction of the LASIP improvements will provide needed stormwater outfall capacity for the
i
Basin ias well as Naples Manor and thereby reduce the threat and damage of flooding. The US-
41 an~ Naples Manor Ditch Enclosure is a vital component of the system linking upstream .
portio~s of the Main Canal Basin to the downstream portion of the Main Canal.

3. Lo~g Range Planning Factors

The JASIP improvements including the US-4l and Naples Manor Ditch Enclosure are part of
the C~unty-wide plan to improve the level of service for flooding and flow-way enhancement
i
wi1:b.iri the Basin and further the stated goals, obj ectives, and policies of the drainage/stormwater
i
management sub-element of the Collier County Growth Management Plan to unify and
i
impletnent the County-wide Stormwater Management Plan that provides an acceptable level of
I
servic~ for stormwater controls and environmental management objectives. The project
!
improyes the LASIP regional stormwater management system and natural flowways within the
i
area i
!
4. En~ronmental Factors
,

The r)ASIP system has been designed to limit the amount of environmental disturbance as much
!
as p01sib~e. Natural flowways and sloughs have been preserved and incorporated into the design .

as much as possible. A stormwater treatment device has been included in the design to treat
stormwater runoff within the LASIP system within the Naples Manor Ditch prior to outfall into
the slough. As mentioned above, the US-4l and Naples Manor Ditch project consists of
improvements to existing ditches and the design of US-4l Ditch has been adjusted resulting in
the least amount of environmental disturbance possible while still meeting the conveyance goals
of the project.
Throughout the permitting process each alternative configuration was reviewed and debated and
it has been determined that the current design is the one that provides the most public benefit
with the least environmental impacts.
5. Costs
The cost to provide the LASIP improvements including the US-4l and Naples Manor Ditch
Enclosure has been carefully considered as part of the alternatives analysis and design of the
project. As the project has been refined during the design and permitting process, more specific
costs have been developed and considered as part of developing a financially feasible
construction phasing and Capital Improvement Program. The design of the US-4l and Naples
Manor Ditch Enclosure along these existing ditches maximizes the improvement benefits while
minimizing the amount of impact to the environment and to adjacent properties, thereby
minimizing costs.
The Lelv Canal Basin
The existing Lely Main Canal flows from Rattlesnake Hammock Road south then west and
parallel to Rattlesnake Hammock Road, then south again and through the bridges at u.s. 41 and
south until it discharges into an estuarine coastal zone along the intercoastal waterway near
Dollar Bay. The LASIP Lely Main Canal Extension improvements consist of the portion of the
Lely Main Canal system located south of and parallel to Rattlesnake Hammock Road between a
point approximately 1.:1 mile east of County Barn Road, thence south for approximately 344 feet,
and thence westerly approximately 1 mile to the southern bend of the Main canal. The flow

capacity of the canal and structures in the Main upstream of the u.s. 41 bridges will be
,
increaSed. At the downstream discharge of the Main canal a spreader lake with a control berm
i
elevatibn of 2.5 NGVD has been constructed to eliminate current over drainage, salt water
I
intrusi~m, and provide a broader distribution of fresh water instead of the existing concentrated
point discharge. South of Rattlesnake Hammock Road a weir will be constructed at Doral Circle
to rais6 the normal stage elevation to 4.0 to eliminate current over drainage.

The U,ASIP overall plan will extend the Main canal system upstream using the stormwater
management system of the Royal Wood Development. A network of smaller canals, weirs and
swale~ is proposed to provide appropriate flood relief without over draining existing wetlands.
One n~w canal system will be extended from the northeast comer of Royal Wood to serve the
!
northe~t portion of the Lely Canal Basin area. The canal will extend from Royal Wood
upstre$m to the southern edge of a wetland area near Cope Lane. Three weirs will be placed in
;
this c1fual to maintain water levels in the wetland areas and to cause flows to continue to pass
i
throug~ a historic slough lying in a northeast to southwest direction across Cope Lane, Country
;
Road ~d Whitaker Road to provide lateral distribution of excess flow into the proposed canal.
Water !levels in these swales will be maintained by the downstream weir control elevations. The .
I
weir structures have gates that allow lowering water levels if needed after or in preparation for a
i
major ~torm event. Also an east to west canal will collect part of the drainage from the area along
I
Sandy! Lane. It will also provide a cross-basin connection that will normally be closed, but in
speciat emergency situations can be opened to allow interconnection of the Lely Canal Basin and
the Lely Manor Basin systems. A culvert and canal system will also extend from the northwest
I
I .
comer! of Royal Wood up to Whitaker Road. It will provide added capacity for flood relief for
the dO}vnstream end of the slough and for the area between Royal Wood and Whitaker.
,

A trib*tary called the Branch joins the Lely Main Canal a short distance upstream of the U.S. 41
Bridg~ and east of the intersection of U.S. 41 and Rattlesnake Hammock Road. The Branch
,
,
provides drainage for the developed area along the Florida Power and Light Corporation right-
I
of-war north of Rattlesnake Hammock Road, the areas surrounding Loch Louise and Crown
Point ~evelopments located south of Davis Boulevard, and the developments along the north side
of D~~is Boulevard. The proposed plan calls for increasing the capacity of the Bran~h
down~tream of Loch Louise, reconstructing the Loch Louise weir, constructing a new weir at the .

northern end of the existing triple box culverts under Davis Boulevard, and extending the
collection system along the north side of Davis Boulevard to its full planned length east of Santa
Barbara Boulevard. The project along the Branch system also includes constructing a weir
structure at the intersection of the Haldeman Creek Basin system and enclosing an existing ditch
south of Loch Louise (the north ditch of Riviera) in a storm drain. Elsewhere in the Lely Main
Canal system, improvements associated with three road proj ects, Rattlesnake Hammock Road,
County Barn. Road and Santa Barbara Boulevard Extension will have LASIP drainage features
either constructed or made active.
The majority of wetland impacts associated with the Lely Main Canal portion of the LASIP
project are related to modifications involving excavating existing canals. However, there are
some areas where new canal and swale construction will create new wetland impacts, although
extensive effort was made to avoid or minimize these impact areas.
The capacity of the Main Canal downstream of u.S. 41 is to be increased by excavation to a
larger cross section and the construction of an outlet spreader lake designed to flow into existing
. wetlands immediately to the south, west and east of the canal.. Wetlands will be impacted by this
construction but impacts are offset by the improved flow conditions into the existing receiving
estuarine wetland area.
The Lelv Manor Basin
The Lely Manor Main Canal collects stormwater from within the Naples Manor subdivision,
developments to the north, and from the drainage area to the northeast of Naples Manor
subdivision. Storm water then flows west to the u.S. 41 culvert which discharges into a wide
canal oriented east to west eventually discharging into a large fresh water marsh. The lower main
begins south of the marsh and discharges into an estuarine coastal zone near the headwaters of
Sandhill Bay and eventually into Rookery Bay. A number of smaller canals provide internal
drainage for the Naples Manor subdivision and discharge into the U.S. 41 road ditch. Stormwater
in the road ditch flows through three additional culverts and to the south and then to the west to
the lower main canal.

The p~oposed plan downstream of U.S. 41 is to increase the capacity of the main canal to provide .
flood relief for upstream areas. Additionally, a weir will be constructed to prevent over drainage
of a l~ge wetland marsh and a spreader lake will be constructed to prevent over drainage while
elimin;ating the current problem of a freshwater point discharge. The plan will also create a new
!
north/$outh canal system roughly along the east side of sections 30 and 31 of Township 50 South
i
Rang~ 26 East. The existing canals that currently divide a historic slougb/flowway will be
,
aband{med (by future development plans of the land owner), a pump station will be installed to
re-hycjrate the slough, capacity improvement will be made to the existing canals extending from
i
U.S. 41, and a new discharge point will be created by constructing a spreader lake adjacent to
,
anoth~r wetland flowway system that has been cut off from historic sheet flow for many years.
Upstream of U.S. 41 the proposed plan will make capacity improvements to the north perimeter
,
I
canal bf Naples Manor, including construction of a weir at Warren Street to reduce current over
drainage impacts to adjacent wetlands. Capacity improvements will be made to the canal along
!
the north side of U.S. 41 to allow for lateral distribution of stormwater to all the culverts crossing
i
beneath. U.S. 41. For safety and capacity reasons, one existing channel within the Naples Manor
subditision will be enclosed in a pipe. .
Upstr~am of the Naples Manor subdivision, the southern end. of the eXlstmg Rattlesnake
HaIIUJiock slough will be bermed and a discharge weir constructed to prevent current over
drainage into the north perimeter ditch of the Naples Manor subdivision. North of Rattlesnake
HannJj.ock Road the existing piecemeal system of ditches will be modified to create a
!
manageable stormwater system. Strategically located culverts, weirs, and channel improvements
will direct stormwater flow into the northern remnants of the Rattlesnake Hammock slough.

of this basin. A weir is proposed at the upper end of the lower main canal to maintain water
levels in the fresh water marsh. A weir is also proposed north of the Wing South Airpark to
maintain water levels in the extensive wetland preserve areas of developments to the north.
The majority of wetland impacts associated with the Lely Manor Basin portion of the LASIP
project are related to modifications involving excavating existing canals. However, there are
some areas where new canal and spreader lake construction will create new wetland impacts,
although extensive effort was made to avoid or minimize these impact areas.

A RESOLUTION AUTHORIZING THE CONDEMNATION OF THOSE
PERPETUAL AND TEMPORARY EASEMENT INTERESTS
NECESSARY FOR THE CONSTRUCTION OF STORMWATER
IMPROVEMENTS KNnWN AS THE US-41 DITCH SEGMENT OF THE
LELY AREA STORMWATER IMPROVEMENT PROJECT. (PROJECT
NO. 51101).

: WHEREAS, the Board of County Commissioners desires to improve the treatment and
contrql of stormv.'ater in the East Naples Area in order to alleviate flooding; and
,
! WHEREAS. the Lely Area Stonnwater Improvement Project consists of improvements to
an ex/sting drainage system for an approximately 11,100 acre area located in East Naples, of
whiclj the US-4l Ditch (hereinafter refen-ed to as the "Project") is one phase; and
i WHEREAS, the Project includes the expansion of existing ditches to improve conveyance
and c~pacity of the flow way; and
i
i WHEREAS. the Lely Area Stormwater Improvement Project is in accordance with both
the C~pital Improvement Element and Drainage Sub-element of the Growth Management Plan;
and i
i

I WHEREAS. the location for the construction of the proposed improvements has been .
fixed ~y survey and is collectively represented by the legal descriptions comprising Exhibit "A"
attachFd hereto and incorporated herein; and
i .
! WHEREAS, after consideration of the availability of alternate routes and locations, the
comp~rative costs of Project alternatives, various impacts upon the environment, long range
plann~ng options. and public safety considerations, the Board desires to exercise its right to
condemn the property for public purposes.
! NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COM~ISSIONERS OF COLLIER COUNTY, FLORIDA( that it has been determined by the
Boardj that it is necessary and in the public's best interest to acquire the property described in
Ex.hib~t "A" (the "Property") for the purpose of constructing the improvements proposed as part
of the! US-4 I Ditch segment of the Lely Area Stormwater Improvement Project located in East
Naple~. and for providing access to the improvements, in order to protect the health, safety and
welfate of the citizens of Collier County.

! AND IT IS FURTHER RESOLVED that acquisition of the Property and construction
upon ~he Property is pm1 of the County's long range planning effort to alleviate flooding in the
East Naples area.

: AND IT IS FURTHER RESOLVED that the Board has reviewed the staff report and
consi4ered the presentation concerning alternative locations for the Project. various impacts to

construction of the Project, and the costs associated with the design, property rights acquisition,
and construction of the Project; and the Board finds that after consideration of these issues, the
most feasible location for construction of the proposed improvements is collectively represented
by the legal descriptions comprising Exhibit "A" attached hereto and incorporated herein.
AND IT IS FURTHER RESOLVED that the perpetual, non-exclusive drainage easements
include the right to place andior excavate materials for the purpose of constructing, operating, and
maintaining drainage structures and facilities, including but not limited to ditches. swales, earthen
berms, rip-rap and retaining wall systems, undergrolmd pipes, culverts and various types of water
control structures within the easement areas. These easements also include the right to remove
and lIse any and all excavated material and the right to perpetual maintenance of drainage
facilities thereon and adjacent thereto.
AND IT IS FURTHER RESOLVED that the temporary construction easements include
the right to construct drainage facilities within the public right-of-way immediately adjacent
thereto and to restore driveways beyond the existing US-41 right-of-way. These easements also
include the right to remove and use any and all excavated mateliaI.
AND IT IS FURTHER RESOLVED that foresaid easement interests, more fully
described in Exhibit '.A" attached hereto and incorporated herein, are necessary for the
construction of the US-41 Ditch segment ofthe Lely Area Stormwater Improvement Project.
AND IT IS FURTHER RESOLVED that all of the Property shall be put to public
purposes.
AND IT IS FURTHER RESOLVED that County staff is hereby authorized to
immediately acquire by gift. purchase or condemnation, in accordance with the provisions of
Chapters 73, 74 and 127, Florida Statutes, the real propelty interests more particularly described
in Exhibit "A", attached hereto and incorporated herein.
AND IT IS FURTHER RESOLVED that no mobile homes are located on the Property
and therefore it 'will not be necessary to remove any mobile homes from the Property to be
acquired.
