Dear Mr. Pritt:
Please be advised that you are scheduled to appear before the Collier County Board of Commissioners at
the meeting of June 14,2.011, regarding the above referenced subject.
Your petition to the Board of County Commissioners will be limited to ten minutes. Please be advised
that the Board will take no action on your petition at this meeting. However, your petition may be
placed on a future agenda for consideration at the Board's discretion. If the subject matter is currently
under litigation or Is an on-going Code Enforcement case, the Board will hear the item but will not
discuss the item after it has been presented. Therefore, your petition to the Board should be to advise
them of your concern and the need for action by the Board at a future meeting.
The meeting wlll begin at 9:00 a.m. in the Board's Chambers on the Third Floor of the W. Harmon Turner
Building (Building "F") of the government complex. Please arrange to be present at this meetIng and to
respond to inquiries by Board members.

Dear Mr. Ochs:

I am writing to request that this Public Petition be placed on the earliest possible agenda for the
meeting of the Board of County Commissioners under "Public Petitions" for the reasons set forth
in the attachment. We would like to move forward to facilitate modest mangrove trimming on a
portion of County-owned property adjacent to residential condominium units.
We respectfully request that the County Commission give staff direction to work with the
Petitioner to devise a program of mangrove trimming and maintenance in order to restore to
affected constituents a reasonable view of the waters of the adjacent bay, all of which will be
strictly in accordance with the FDEP mangrove trimming permit that has been issued to
Barefoot Beach Condominium Association, inc. The trimming and maintenance program is
proposed to be at no expense to the County.

Public Petition Summary
Barefoot Beach Mangrove Trimming
Summary of Request: That the Board of County Commissioners direct staff to work with
Petitioner to bring forward to the Commission a Plan for modest trimming of mangroves to
restore a view to the bay waters from the first living level of four residential condomiruums at
Barefoot Beach.
Background: Collier County owns a mangrove area adjacent to residential condominium
buildings on Barefoot Beach Boulevard (off of Bonita Beach Road), as a result of a Settlement
Agreement in litigation by The Conservancy, Inc. against the County and the developer in 1985.
The majority of the mangroves were originally small, sparse, and heavily infested by exotics. As
a condition of approval of the condominium project, the developer performed significant
enhancement and mitigation in the mangrove area. TIle enhancement and mitigation was
successful and the mangroves have since grown to a level that blocks the view of the adjacent
bay from the first residential level of four of the condominium structures, such level located on
the second floor ofthe buildings.
DEP Approval: Petitioner has received a mangrove trimming permit from Florida DEP that
includes conesponding trimming on Petitioner's common area. However. the County's
permission is required in order to trim those mangroves located on the County property.
Proposal: Details can be worked out with staff. However, Petitioner proposes to have the
trimming done at its expense, not the County's, and to have trimming done on both properties at
the same time. Petitioner also proposes to perform all periodic maintenance on the County
property. The County-owned property at issue serves no public purpose and does not provide
any recreational value to County residents.
Petitioner's proposed trimming is reasonable and less than the maximum allowed by State law.
Since the buildings are elevated over parking, the Petitioner proposes to trim less than would
otherwise be permitted. To be clear, only those areas that block the views of the second floor
residents are proposed for trimming.
All trimming would be done under the supervision of a licensed professional mangrove trimmer,
under the supervision of county staff or its designee, with input from the Conservancy and at no
cost to the COlUlty. Petitioner would enter into such legal documents as necessary for the
implementation ofth1s proposal.
